Resolution No. 96001 2 3 4 5 6 7. 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9600 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A LETTER IN SUPPORT OF ASSEMBLY BILL 2546 RELATING TO THE AIR TOXICS "HOT SPOTS" INFORMATION AND ASSESSMENT ACT WHEREAS, the City of Vernon (the "City") is a municipal corporation and a chartered city of the State of California organized and existing under its Charter and the Constitution of the State of California; and WHEREAS, the Air Toxics "Hot Spots" Information and Assessment Act (the "Hot Spots Act") was enacted in September 1987 requiring the reporting of certain substances that facilities routinely release into the air, including but not limited to, continuous and intermittent releases and predictable process upsets or leaks; and WHEREAS, Assembly Bill 2546 ("AB 2546") introduced by Assembly Member De La Torre aims to reduce harmful diesel emissions by requiring the State Air Resources Board to adopt standards for heavy- duty motor vehicles and off -road vehicle engines, including off -highway vehicles and locomotives by requiring adequate and complete reporting of emission at facilities deemed to be toxic hot spots; and WHEREAS, the purpose of AB 2546 is to assist in decreasing harmful pollution and informing communities of the health risks and WHEREAS, City staff have recommended that the City support AB 2546 to provide cleaner air in Vernon, the surrounding communities and throughout California and protect the health, safety and welfare of City residents and businesses; and WHEREAS, after analyzing the bill, City staff have 1 recommended that a letter in support of AB 2546 be sent to the Chairman 2 and Members of the Assembly Committee on Transportation on behalf of 3 the City. 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 5 CITY OF VERNON AS FOLLOWS: 6 SECTION 1: The City Council of the City of Vernon hereby 7 finds and determines that the recitals contained hereinabove are true 8 and correct. 9 SECTION 2: The City Council of the City of Vernon hereby 10 states its support of AB 2546 (De La Torre) and directs the City 11 Administrator, or his designee, to send a letter of support, in 12 substantially the form attached hereto as Exhibit A and incorporated by 13 reference to Mark DeSaulnier, Chair of the Assembly Committee on 14 Transportation, and Members of the Assembly Committee on 15 Transportation. 16 SECTION 3: The City Clerk of the City of Vernon shall 17 certify to the passage of this resolution, and thereupon and thereafter 18 the same shall be in full force and effect. 19 APPROVED AND ADOPTED this 215t day of April, 2008. 20 21 22 Name: Leonis C.
