Resolution No. 96341 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9634 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROVIDING FOR THE IMPLEMENTATION OF THE CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM FOR 2007-2008 WHEREAS, Assembly Bill 1913 (AB 1913) (Cardenas) was chaptered into law on September 7, 2000, for supplemental local law enforcement funding pursuant to the bill; and WHEREAS, AB 1913 provides $100,000,000 statewide for the Citizens for Public Safety (COPS) Program; and WHEREAS, the County of Los Angeles has established a Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061 of the Government Code to receive AB 1913 funds which have been allocated for use in Los Angeles County; and WHEREAS, the City has established its own Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061 of the Government Code; and WHEREAS, Assembly Bill 823 (AB 823) (Poochigian) was chaptered into law on April 8, 2002, amending Sections 30061 and 30063 of the Government Code relating to law enforcement funding; and , WHEREAS, AB 823 provides that funds received be expended no later than June 30 of the following fiscal year; and WHEREAS, the City of Vernon has participated in the COPS Program since 2001 and receives its share of any funds available for the purpose of ensuring public safety through the procurement of equipment to deter juvenile crime and improving frontline municipal police services and enhancing the effectiveness of its officers; and WHEREAS, by memo dated May 28, 2008, the Chief of Police has I recommended that the Police Department be authorized to purchase two 2 motorcycles, equipment, training, and all maintenance associated with 3 the Police Department's Traffic Enforcement Unit and other items as 4 needed in support of future frontline law enforcement needs by using 5 11COPS grant funds; and 6 WHEREAS, the City Council has conducted a public hearing to 7 consider 2007-2008 funding requests from the Chief of Police to use 8 COPS grant funds by June 30, 2010, for frontline law enforcement needs, 9 including but not limited to personnel, equipment and programs and 10 shall determine each submitted request as required by AB 823 in order 1111to enhance the effectiveness of its officers. 12 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 13 CITY OF VERNON AS FOLLOWS: 14 SECTION 1: The City Council of the City of Vernon hereby 15 finds and determines that the recitals contained hereinabove are true 16 Hand correct. 1711 SECTION 2: The City Council of the City of Vernon hereby 18 directs that the City maintain its own Supplemental Law Enforcement 19 Service Fund (SLESF) as required by AB 823 and State law pursuant to 20 Government Code Sections 30061 and 30063. 21 SECTION 3: The City Council of the City of Vernon finds 22 that all persons have had the opportunity to be heard or to file 23 written comments to the expenditure of 2007-2008 COPS grant funds 24 provided by AB 823, and after due consideration of any and all 25 evidence submitted at the public hearing determines that there are 26 compelling reasons to justify the expenditure of COPS grant funds for 27 the equipment requested by the Chief of Police. 28 SECTION 4: The City Council of the City of Vernon hereby - 2 - 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 requests that the City's share of the funding be allocated to SLESF for purposes of frontline law enforcement needs. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or her designee, to hand deliver a copy of this Resolution to: Ms. Patricia Vallejo County of Los Angeles Chief Administrative Office 500 West Temple Street, Room 754 Los Angeles, CA 90012 SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
