SCHEDULE I (COMPUTATION OF PAY) SCHEDULES II-XX (SALARY SCHEDULES) SCHEDULE XXI (AUTO ALLOWANCE) SCHEDULE XXII (UNIFORM ALLOWANCE) SCHEDULE XXIII (COURT APPEARANCES & STANDBY STATUS) 13 13 13 13 14 14 14 15 15 =1■ 2 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FIXING THE COMPENSATION, COSTS AND BENEFITS 4 OF ITS EMPLOYEES AS OF JULY 6, 2008, AND REPEALING 5 ALL RESOLUTIONS IN CONFLICT THEREWITH 6 7 WHEREAS, on June 25, 2007, the City Council of the City of 8 Vernon adopted Resolution No. 9342 fixing the compensation, costs and 9 benefits of employees of the City of Vernon as of July 8, 2007; and 10 WHEREAS, on July 16, 2007, the City Council of the City of 11 Vernon adopted Resolution No. 9362 amending and restating Resolution 12 No. 9342 to be effective July 8, 2007 (the "Salary Resolution"), as 13 amended by Resolution Nos. 9373, 9389, 9453, 9469, 9491, 9526, 9549, 14 9568, 9581, 9607 and 9613; and 15 WHEREAS, the City of Vernon has a contract with the Public 16 Employees Retirement System ("PERS") to provide retirement benefits 17 for its employees and pays the employees' total contribution; and 18 WHEREAS, on April 12, 1988, by voter approval, the City of 19 Vernon became a Charter City; and 20 WHEREAS, all employees of the City of Vernon not otherwise 21 under contract serve at the will and pleasure of the City Council; and 22 WHEREAS, on January 19, 1971, the City Council of the City of 23 Vernon adopted Resolution No. 4027 relating to employer -employee 24 relations within the City of Vernon; and 25 WHEREAS, the City Council intends to continue to provide a 26 PERS long-term health care benefit with comprehensive lifetime 27 inflation protection for the City Councilmembers, and their spouses and 28 that said benefit shall be provided at no cost to them; and -1- 1 WHEREAS, the City Council of the City of Vernon wishes to f_ix 2 the compensation, costs and benefits of its employees as indicated in 3 their respective schedules as of July 6, 2008. 4 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 5 CITY OF VERNON AS FOLLOWS: 6 SECTION 1: EMPLOYEES SERVE AT WILL AND PLEASURE OF THE CITY 7 COUNCIL. 8 The City Council of the City of Vernon hereby declares that 9 its intention in adopting Resolution No. 4027, Section 5(h), was to 10 reserve for the City Council complete and exclusive discretion to 11 determine matters relating to the discharge, suspension or other manner_ 12 of discipline of all employees in conformance with its long standing 13 view and policy that all employees of the City of Vernon not under 14 contract serve at the will and pleasure of the City Council. 15 SECTION 2: EFFECTIVE DATE. 16 Effective July 6, 2008, there is hereby established and 17 approved compensation, costs and benefits provided for herein as set 18 forth below for employees and officers of the City of Vernon. Payments made by the City on behalf of said 9 employees shall be credited to said employee's account with PERS. 10 SECTION 5: AUTO INSURANCE PROGRAM. 11 The City has established an auto insurance program pursuant 12 to Resolution No. 5741. All officers, employees and police (including 13 Group 2 employees) who participate in said program effective July 6, 14 2008, will receive a contribution by the City of Thirty -Five Dollars 15 ($35.00) per month per employee. 16 SECTION 6: VISION CARE. 17 The City shall provide a vision care benefit to employees 18 only and not dependents. Employees shall have the option of 19 purchasing vision care for their dependents at a cost of $6.95 for one 20 dependent or $13.95 for two or more dependents. 21 SECTION 7: LONGEVITY PROGRAM FOR EMPLOYEES EMPLOYED ON OR 22 BEFORE JUNE 30, 1994. 23 The City has established a longevity program for all 24 employees. The longevity program described in Section 7 herein will 25 apply to all employees, except Department Heads and police employees in 26 Group 2, employed on or before June 30, 1994. 27 a. Five (5) Years of Service. 28 All eligible employees who have five (5) years of consecutive -4- 2 additional five percent (5%) per month of their base salary effective 3 July 1, 1986, and every year thereafter until reaching the next step. 4 Employees upon reaching their 5th anniversary date after July 1, 1986, 5 shall be entitled to said five percent (5%) per month upon said 6 anniversary date. 7 b. Ten (10) Years of Service. 8 All eligible employees who have ten (10) years of consecutive 9 uninterrupted service on or before July 1, 1987, shall receive an 10 additional ten percent (10%) per month of their base,salary effective 11 July 1, 1987, and every year thereafter until reaching the next step. 12 Employees upon reaching their loth anniversary date after July 1, 1987, 13 shall be entitled to said ten percent (10%) per month upon said 7.4 anniversary date. 15 C. Fifteen (15) Years of Service. 16 All eligible employees who have fifteen (15) years of 17 consecutive uninterrupted service on or before July 1, 1988, shall 18 receive an additional fifteen percent (15%) per month of their base 19 salary effective July 1, 1988, and every year thereafter until reaching 20 the next step. Employees upon reaching their 15th anniversary date 21 after July 1, 1988, shall be entitled to said fifteen percent (15%) per 22 month upon said anniversary date. 23 d. Twenty (20) Years of Service. 24 All eligible employees who have twenty (20) years of 25 consecutive uninterrupted service on or before July 1, 1989, shall 26 receive an additional twenty percent (20%) per month of their base 27 salary effective July 1, 1989, and every year thereafter. Employees 28 upon reaching their 20th anniversary date after July 1, 1989, shall be 5 2 date. 3 e. Thirty (30) Years of Service - Firemen. 4 All eligible firemen who have been appointed to the position 5 of Captain or above and who have thirty (30) years of consecutive 6 uninterrupted service on or before July 1, 1991, shall receive an 7 additional twenty-five percent (250) of their base salary per month 8 effective July 1, 1991, and every year thereafter. Employees in said 9 position upon reaching their 30th anniversary date after July 1, 1991, 10 shall be entitled to said twenty-five percent (250) per month upon said 11 anniversary date. 12 f. Compensation Not Cumulative. 13 Payment of the aforesaid longevity compensation shall not be 14 cumulative and only the highest applicable longevity pay shall be 15 paid. 16 g. Police Employees in Group 2 on or Before June 30, 1995. 17 18 The longevity program described in Section 7 will also apply 19 to the police employees in Group 2 employed on or before June 30, 20 1995. 21 h. Employees Employed After June 30, 1994 and Exceptions Pertaining to Police Employees in Group 22 2• 23 All employees, except Department Heads and police employees 24 in Group 2, employed on or after July 1, 1994, and police employees in 25 Group 2 employed on or after July 1, 1995, shall only be entitled to 26 longevity benefits provided for in Section 8. 27 28 -6- 2 JULY 1, 1994. 3 a. Miscellaneous and Fire Employees Employed on or After July 1, 1994 - Five (5) Years of Service. 4 5 All eligible employees who are employed on or after July 1, 6 1994, who attain five (5) years of consecutive uninterrupted service 7 shall receive an additional five percent (50) per month of their base 8 salary. Such employees upon reaching their 5th anniversary date shall 9 be entitled to receive said five percent (50) per month upon said 10 anniversary date. Further, such employees will not be entitled to 11 receive any additional percentage increase to their base salary for 12 further service. This subsection shall only apply to employees hired 13 on or after July 1, 1994 and shall not apply to Department Heads. 14 b. Police Employees in Group 2 Employed on or After July 1, 1995 - Five (5) Years of Service. 15 16 All employees classified in Group 2 who are employed on or 17 after July 1, 1995, who attain five (5) years of consecutive 18 uninterrupted service shall receive an additional five percent (50) per 19 month of their base salary. Such employees upon reaching their 5th 20 anniversary date shall be entitled to receive such five percent (50) 21 per month upon said anniversary date. Further, such employees will not 22 be entitled to receive any additional percentage increase to their base 23 salary for further service. This subsection shall only apply to all 24 police employees in Group 2 hired on or after July 1, 1995. 25 SECTION 9: COMPUTATION OF PAY. 26 For all non-exempt officers and employees except forty-eight 27 (48) hour shift Fire Department employees, an hourly rate computed in 28 accordance with Schedule I shall be used for pay purposes. The monthly -7- 2 latter equivalents assume that the total scheduled hours are worked or 3 taken as excused paid leave, sick leave, vacation or holidays. Unexcused 4 leave hours shall not be included for the purpose of computing pay. 5 a. Hourly Employees. 6 All non-exempt officers and employees except forty-eight (48) 7 hour shift Fire Department employees, shall be paid on an hourly basis. 8 The employee shall be paid the amount computed by multiplying the 9 hourly salary rate by the number of hours worked or taken as excused 10 paid leave or holiday. The total hours to be paid shall be certified 11 by the Department Head, or by an employee designated by the Department 12 Head, each pay period prior to payment. Such certification shall be in 13 a form approved by the City Administrator. 14 b. 48-Hour Shift Fire Department Employees. 15 Fire Department personnel who serve on a forty-eight (48) 16 hour shift would be paid a widely fluctuating amount each pay period if 17 they were paid for hours actually worked; therefore, such employees 18 shall be paid for the average number of hours in a two (2) week period, 19 one hundred and twelve (112) hours. Exceptions for leave without pay 20 hours shall be reported and deducted from the average when pay is 21 computed. The "Exception Report" shall be in a form approved by the 22 City Administrator. 23 C. Bilingual Pay. 24 A program is hereby established for miscellaneous employees 25 whose regular job duties as described in their job description provide 26 for interaction with the public allowing said employee to be 27 compensated for bilingual skills after the employee demonstrates 28 proficiency in speaking Spanish (the ability to read and write in 8- 2 determined by successful completion of the Los Angeles County 3 proficiency test currently used by the Vernon Police Department. Those 4 employees who successfully demonstrate this skill would be eligible to 5 receive an additional One Hundred Twenty -Five Dollars ($125.00) per 6 month for bilingual pay. 7 SECTION 10: AUTOMOBILE ALLOWANCES. 8 a. Exceptions to Allowance. 9 Wherever an allowance is made -to any officer or employee for 10 the use of his personal automobile, such an allowance shall not be 11 payable whenever the employee is on vacation, leave of absence, or 12 otherwise absent the entire calendar month, unless otherwise specified 13 by the City Council. 14 b. Personal Vehicle Allowance. 15 In addition to the salaries set forth in the attached 16 schedules, certain employees serving in specified classifications shall 17 receive, when using their own motor vehicles in the service of the 18 City, an additional sum per month as provided for in Schedule XXI, 19 Exhibit U. 20 Employees who, with Department Head approval, use their 21 personal automobile during the performance of their assigned duties 22 shall be compensated with an automobile allowance as provided for 23 herein. In the event that the automobile allowance for a particular 24 month provides less than fifty and one-half cents (50.50) a mile 25 reimbursement or, if no automobile allowance is provided, then the 26 employee shall receive a sum equal to fifty and one-half cents (50.50) 27 a mile for reimbursement for use of his/her personal automobile and 28 said sum shall be based upon actual miles traveled by said automobile. -9- 2 The City shall not be responsible for repairs or any 3 additional costs for upkeep, fuel, lubrication, replacement in whole or 4 in part, or other expenses in connection with any such vehicle beyond 5 the respective amounts set forth in Schedule XXI, Exhibit U. 6 SECTION 11: FIRE DEPARTMENT. 7 a. Fire Science Certificate. 8 All employees who hold a Fire Science Certificate or have 9 completed courses equivalent thereto shall receive an additional two 10 and one half percent (2 1/2%) per month of their base salary after 11 satisfactory completion of their evaluation period. 12 (1) AA or AS Degree. 13 All employees who hold an AA or AS Degree in Fire Science or 14 Fire Technology with completion of five (5) years of uninterrupted 15 service with the Fire Department shall receive an additional two and 16 one half percent (2 1/2%) per month of their base salary. 17 b. Uniform Allowance. 18 The City shall provide a uniform allowance as specified in 19 Schedule XXII, Exhibit V, for the 2008-2009 fiscal year of the City, 20 for the purchase of Uniforms and related equipment. 21 C. Haz Mat Pay. 22 In addition to said salaries as set forth in the attached 23 schedules, each Haz Mat team member shall receive an additional One 24 Hundred Twenty -Five Dollars ($125.00) per month. Said payment shall 25 not be considered to be part of the employee's base monthly salary when 26 computing fire science certificate incentives or AA or AS degree 27 incentives. 28 / / / 10 2 A program is hereby established that allows any employee 3 within the department, including those in Group 2, to be compensated 4 for bilingual skills after the employee demonstrates proficiency in 5 speaking a foreign language (the ability to read and write in a foreign 6 language may also be tested, if necessary), which proficiency would be 7 determined by successful completion of the Los Angeles County 8 proficiency test currently used by the Vernon Police Department. Those 9 employees who successfully demonstrate this skill would be eligible to 10 receive an additional One Hundred Twenty -Five Dollars ($125.00) per 11 month for bilingual pay. 12 SECTION 12: POLICE DEPARTMENT. 13 a. CLASSIFICATION OF EMPLOYEES IN GROUP 2. 14 (1) MOU. 15 For purposes of this resolution, all of the provisions in the 16 Memorandum of Understanding ("MOU") dated March 1, 1988, adopted by the 17 City Council of the City of Vernon on March 15, 1988, pursuant to 18 Resolution No. 5489, as amended, are referenced herein as though fully 19 set forth at length and Group 2 employees shall be paid in accordance 20 therewith. 21 (2) Court Appearances and Standby Status. 22 Employees in the classifications represented by the Police 23 Association in Group 2 shall be compensated for court appearances and 24 standby status as specified in Schedule XXIII, Exhibit W. 25 (3) Uniform Allowance. 26 Vernon shall provide a uniform allowance as specified in 27 Schedule XXII, Exhibit V for the 2008-2009 fiscal year of Vernon, for 28 the purchase of Uniform and related equipment. -11- 2 Employees in the classifications represented by the Police 3 Association in Group 2 who have been employed as sworn safety personnel 4 for a minimum of twenty (20) years and a minimum of ten (10 years of 5 that service has been in the employ of the City shall receive lifetime 6 medical benefits for themselves and their spouses. 7 b. POLICE MANAGEMENT EMPLOYEES. 8 (1) Payment of Incentive Compensation Peace 9 Officers' Standard Training Certificate. 10 Police management sworn employees (Police Chief, Police 11 Captains and Lieutenants) shall be eligible to receive peace officers' 12 standard training certificate incentive pay as follows: 13 (a) POST Intermediate Certificate. 14 Three percent (3%) of the employee's base monthly salary, 15 excluding all other compensation, for the employee earning and 16 possessing a POST intermediate certificate. 17 (b) POST Advanced Certificate. 18 Six percent (6%) of the employee's base monthly salary, 19 excluding all other compensation, for the employee earning and 20 possessing a POST advanced certificate. 21 (c) Incentive Compensation. 22 Payment of the aforesaid incentive compensation shall not be 23 cumulative and only the highest applicable incentive pay shall be paid. 24 Incentive pay shall be payable the month following the month during 25 which the certificate is received, or the month following completion of 26 the employee's evaluation period, whichever is latest. 27 28 -12- 1 2 Police management sworn employees (Police Chief, Police Captains 3 and Lieutenants) who have been employed as sworn personnel for a 4 minimum of twenty (20) years and a minimum of ten (10 years of that 5 service has been in the employ of the City shall receive lifetime 6 medical benefits for themselves and their spouses. 7 C. UNIFORM ALLOWANCE FOR POLICE MANAGEMENT SWORN AND 8 MISCELLANEOUS EMPLOYEES. 9 Vernon shall provide a uniform allowance as specified in 10 Schedule XXII, Exhibit V for 2008-2009 fiscal year of Vernon for the 11 purchase of uniforms for police management sworn employees (Police 12 Chief, Police Captains and Lieutenants), dispatchers, Records 13 Personnel, Department Secretary and Administrative Aide positions in 14 the Police Department. 15 d. BILINGUAL PAY. 16 A program is hereby established that allows any employee 17 within the department, including those in Group 2, to be compensated 18 for bilingual skills after the employee demonstrates proficiency in 19 speaking a foreign language (the ability to read and write in a foreign 20 language may also be tested, if necessary), which proficiency would be 21 determined by successful completion of the Los Angeles County 22 proficiency test currently used by the Vernon Police Department. Those 23 employees who successfully demonstrate this skill would be eligible to 24 receive an additional $125 per month for bilingual pay. 25 SECTION 13: CITY COUNCIL DEPARTMENT. 26 a. PERS Long -Term Health Care Benefit. 27 The City shall provide or reimburse the City Councilmembers 28 for expenses incurred relating to a PERS long-term health care benefit -13- 2 Councilmembers and their spouses. The City shall pay or reimburse all 3 other medical -related health, vision and dental costs not reimbursed by 4 the City's insurance program or Medicare for City Councilmembers and 5 their dependents. 6 b. Medical and Dental Expenses. 7 One hundred percent (100o) of all medical and dental expenses 8 to be paid or reimbursed by the City after insurance has paid. In 9 addition, upon retirement and with at least twenty-five (25) years of 10 continuous uninterrupted service, (i) the City will pay the insurance 11 premium for the City's medical and dental insurance program for the 12 City Councilmembers as well as their spouses and (ii) the City will 13 continue to pay one hundred percent (1000) of all medical and dental 14 expenses after insurance has paid. The City shall pay or reimburse all 15 other medical -related health, vision and dental costs not reimbursed by 16 the City's insurance program or Medicare for the City Councilmembers 17 and their dependents. 18 C. Compensation. 19 In accordance with Article III, Section 3.11 of the Charter 20 of the City of Vernon, the City Council hereby establishes the 21 compensation for the Councilmembers as set forth in the attached 22 schedules. Longevity and attendance allowances have been incorporated 23 into the City Councilmembers' base compensation. 24 (1) Expense Reimbursement. 25 Each Councilmember shall be reimbursed per month for actual 26 and necessary expenses incurred in the performance of their official 27 duties as members of the City Council based upon submittal of the 28 appropriate expense substantiation as defined in the Internal Revenue -14- 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 14: Repeal of Certain Resolutions. All resolutions, or parts of resolutions not consistent with or in conflict with this resolution are hereby repealed. SECTION 15: Certification of Passage. The City Clerk of the City of Vernon shall certify to the passage of this resolution and thereupon and thereafter the same shall be in full force and effect. It is the intention that all pay is earned at an hourly 8 rate and paid at an hourly rate on a biweekly basis.
