RESOLUTION NO. 9664
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 9639 BY AMENDING
VARIOUS SECTIONS WITHIN THE RESOLUTION AND AMENDING
SCHEDULES VIII, XVII AND XXII OF SAID RESOLUTION
REGARDING THE COMPENSATION, COSTS AND BENEFITS OF
ITS EMPLOYEES
WHEREAS, on June 16, 2008, the City Council of the City of
Vernon adopted Resolution No. 9639 to be effective July 6, 2008
regarding the compensation, costs and benefits of its (the "Salary
Resolution"); and
WHEREAS, certain items were inadvertently omitted from the
schedules concerning the Fire Department, the Police Department and
the Uniform Allowance and the City Council of the City of Vernon
desires to amend Schedule Nos. VIII (Exhibit H), XVII (Exhibit Q) and
XXII (Exhibit V), to rectify the error; and
WHEREAS, City staff have recommended that the Salary
Resolution be amended to add, delete or modify certain provisions in
order to clarify any ambiguity.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
(finds and determines that the recitals contained hereinabove are true
land correct.
SECTION 2: Effective July 6, 2008, Schedule No. VIII
(Exhibit H), Schedule No. XVII (Exhibit Q) and Schedule No. XXII
(Exhibit V), of the Salary Resolution are hereby amended as indicated
on Exhibit A which is attached hereto and made a part hereof by this

SECTION 3: The City Council of the City of Vernon hereby
amends the Salary Resolution by adding and deleting provisions as set
forth in Exhibit B which is attached hereto and incorporated by
reference.
SECTION 4: The provisions of Resolution No. 9639 not
consistent with or in conflict with this resolution are hereby
repealed; in all other respects, Resolution No. 9639, shall remain in
full force and effect.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.

(SECTION 5: AUTO INSURANCE PROGRAM.
The City has established an auto insurance program pursuant
to Resolution No. 5741. All employees who participate in said program
effective July 6, 2008, will receive Thirty -Five Dollars ($35.00) per
month per employee from the City. Such payment shall not be payable
whenever the employee is on vacation, leave of absence, or otherwise
absent the entire calendar month, unless otherwise specified by the
City Council.
SECTION 6: BILINGUAL PAY.
A program is hereby established for all employees whose
regular job duties as described in their job description provide for
interaction with the public on a regular basis, allowing said employee
to be compensated for bilingual skills after the employee demonstrates
proficiency in speaking Spanish (the ability to read and write in
Spanish may also be tested, if necessary), which proficiency would be
determined by successful completion of the Los Angeles County
proficiency test currently used by the Vernon Police Department. Those
employees who successfully demonstrate this skill would be eligible to
receive an additional One Hundred Twenty -Five Dollars ($125.00) per
month for bilingual pay. Bilingual pay is only applicable for Spanish
speaking proficiency at this time due to the nature and locality of the
public in the City of Vernon.
Former SECTION 6, VISION CARE, is renumbered to Section 7.
Former SECTION 7, LONGEVITY PROGRAM FOR EMPLOYEES EMPLOYED ON OR
BEFORE JUNE 30, 1994, is renumbered to Section 8.

Former SECTION 8, LONGEVITY PROGRAM FOR EMPLOYEES ON OR AFTER JULY 1,
1994, is renumbered to Section 9.
SECTION 10: COMPUTATION OF PAY.
For all non-exempt officers and employees except forty-eight
(48) hour shift Fire Department employees, an hourly rate computed in
accordance with Schedule I shall be used for pay purposes. The monthly
amounts stated in the schedules are for comparative purposes only. The
latter equivalents assume that the total scheduled hours are worked or
taken as excused paid leave, sick leave, vacation or holidays. Unexcused
leave hours shall not be included for the purpose of computing pay.
a. Hourly Employees.
All non-exempt officers and employees except forty-eight (48)
hour shift Fire Department employees, shall be paid on an hourly basis.
The employee shall be paid the amount computed by multiplying the
hourly salary rate by the number of hours worked or taken as excused
paid leave or holiday. The total hours to be paid shall be certified
by the Department Head, or by an employee designated by the Department
Head, each pay period prior to payment.. Such certification shall be in
a form approved by the City Administrator.
b. 48-Hour Shift Fire Department Employees.
Fire Department personnel who serve on a forty-eight (48)
hour shift would be paid a widely fluctuating amount each pay period if
they were paid for hours actually worked; therefore, such employees
shall be paid for the average number of hours in a two (2) week period,
one hundred and twelve (112) hours. Exceptions for leave without pay
hours shall be reported and deducted from the average when pay is
computed. The "Exception Report" shall be in a form approved by the
(City Administrator.

c.
All employees eligible for overtime shall be paid said
overtime pursuant to the regulations set forth in the Federal Fair
Labor Standards Act.
SECTION 11: AUTOMOBILE ALLOWANCES.
a. Personal Vehicle Allowance.
In addition to the salaries set forth in the attached
schedules, certain employees serving in specified classifications shall
receive, when using their own motor vehicles in the service of the
City, an additional sum per month as provided for in Schedule XXI,
Exhibit U.
Employees who, with Department Head approval, use their
personal automobile during the performance of their assigned duties
shall be compensated with an automobile allowance as provided for
herein. In the event that the automobile allowance for a particular
month provides less than fifty-eight and a half cents (58.50) a mile
reimbursement or, if no automobile allowance is provided, then the
employee shall receive a sum equal to fifty-eight and a half cents
(58.50) a mile for_.reimbursement for use of his/her personal automobile
and said sum shall be based upon actual miles traveled by said
automobile.
b. Exceptions to Allowance.
Wherever an allowance is made to any employee for the use of
their personal automobile, such an allowance shall not be payable
whenever the employee is on vacation, leave of absence, or otherwise
absent the entire calendar month, unless otherwise specified by the
City Council.
1 C. Responsibility For Upkeep of Personal Vehicle.
2 The City shall not be responsible for repairs or any
3 additional costs for upkeep, fuel, lubrication, replacement in whole or
4 in part, or other expenses in connection with any such vehicle beyond
5 the respective amounts set forth in Schedule XXI, Exhibit U.
6 SECTION 12: FIRE DEPARTMENT.
7 a. Fire Science Certificate.
8 All employees who hold a Fire Science Certificate or have
9 completed courses equivalent thereto shall receive an additional two
10 and one half percent (2 1/20) per month of their base salary after
11 satisfactory completion of their evaluation period.
12 (1) AA or AS Degree.
13 All employees who hold an AA or AS Degree in Fire Science or
14 Fire Technology with completion of five (5) years of uninterrupted
15 service with the Fire Department shall receive an additional two and
16 one half percent (2 1/20) per month of their base salary.
17 b. Uniform Allowance.
18 The City shall provide a uniform allowance as specified in
19 Schedule XXII, Exhibit V, for the 2008-2009 fiscal year of the City,
20 for the purchase of Uniforms and related equipment.
21 C. Haz Mat Pay.
22 In addition to said salaries as set forth in the attached
23 schedules, each Haz Mat team member shall receive an additional One
24 Hundred Twenty -Five Dollars ($125.00) per month. Said payment shall
25 not be considered to be part of the employee's base monthly salary when
26 computing fire science certificate incentives or AA or AS degree
27 incentives.

1 d. Merit Step.
2 Promotions or salary increases to higher grades are merit
3 step only and shall be available to employees as recognition and reward
4 for satisfactory services after one (1) year of service at present
5 grade. The promotion or salary increase to said grade shall remain at
6 the sole discretion of the City Council.
7 e. Anniversary Date.
8 All firefighters hired as of June 26, 1989, or later, shall
9 start at the bottom step in the salary range and shall be eligible for
10 an initial merit step increase on a merit basis after six (6) months
11 of satisfactory continuous service. However, said firefighters shall
12 still be required to satisfactorily complete an evaluation period of
13 at least twelve (12) months. Any person who qualifies for said
14 increase shall have his/her anniversary date for future merit increase
15 established as of the date said firefighter is appointed to said
16 grade.
17 f_. Physical Fitness/Wellness Program.
18 This program is mandatory for all fire safety personnel. Any
19 individual who after one (1) year of participation has completed a pre-
20 program fitness evaluation, minimum participation requirements, bi-
21 annual fitness evaluations and verification of participation by the
22 Battalion Chief will receive Two Hundred Fifty Dollars ($250.00).
23 g. Service Adjustment Increase.
24 In the event there is an inequity between ranks or between
25 employees within a Department, upon reviewing the performance of an
26 employee, the Department Head may incorporate a service adjustment
27 increase up to ten percent (100) per month of their base salary.

1 SECTION 13: POLICE DEPARTMENT.
2 a. CLASSIFICATION OF EMPLOYEES IN GROUP 2.
3 (1) MOU.
4 For purposes of this resolution, all of the provisions in the
5 Memorandum of Understanding ("MOU") dated March 1, 1988, adopted by the
6 City Council of the City of Vernon on March 15, 1988, pursuant to
7 Resolution No. 5489, as amended, are referenced herein as though fully
8 set forth at length and Group 2 employees shall be paid in accordance
9 therewith.
10 (2) Court Appearances and Standby Status.
11 Employees in the classifications represented by the Police
12 Association in Group 2 shall be compensated for court appearances and
13 standby status as specified in Schedule XXIII, Exhibit W.
14 (3) Shooting Pay.
15 All sworn personnel who achieve the following qualifications
16 shall receive compensation as follows:
17 Marksman: $3.00 per month
18 Sharpshooter $5.00 per month
19 Expert: $7.50 per month
20 Distinguished Expert: $10.00 per month
21 (4) Uniform Allowance.
22 The City will pay each sworn member of the Police Department,
23 who has completed his or her first year of service with the City and
24 who is on the active payroll of the Vernon Police Department, One
25 Thousand Dollars ($1,000.00) per fiscal year for the purchase of
26 uniforms and related equipment, in accordance with Schedule XXII,
27 Exhibit V.

(5) Field Training Officer Pay (FTO).
Police Officers assigned by the Chief of Police, or his
designee, as Field Training Officer will receive a differential of five
percent (50) of their base salary for the period so assigned. Each
Officer assigned as a Field Training Officer shall complete a P.O.S.T.
approved Field Training Officer School prior to assignment. The number
of Field Training Officers, qualifications, and training for such
assignment shall be determined by the Chief of Police. Such assignment
shall be revoked at any time without recourse to the disciplinary
procedure (Article 23).
(6) Premium Pay.
In the event a Police Officer or a Sergeant is assigned to
the Detective Division, a Professional Standards or an outside detail
or task force, he/she shall receive premium pay equal to five percent
(50) of his/her base pay per month and the premium pay shall not be
considered to be part of the employee's base monthly salary when
computing Peace Officers Standards and Training certificate. However,
it shall be considered as part of the base monthly salary for purposes
of computing overtime pay.
(7) Merit Steps.
Promotions or salary increases to higher grades are merit
steps only and shall be available to employees as recognition and
reward for satisfactory service after one (1) year of service at
present grade. The promotions or salary increase to said grade shall
remain the sole discretion of the City Council.
(8) Anniversary Date.
Not withstanding the above provision, any person employed in
a position of Police Officer Step 6 shall be appointed to Step 5 upon

his/her successful completion in an assigned training academy and any
person employed in a position of Step 5 shall be appointed to Step 4
after serving at least six (6) months in'the field and upon receiving a
merit evaluation of high competent. Any person who qualifies for said
increase shall have his/her anniversary date for future merit increase
established as of the date said Officer is appointed to said grade.
(9) Lifetime Medical.
Employees in the classifications represented by the Police
Association in Group 2 who have been employed as sworn safety personnel'',
for a minimum of twenty (20) years and a minimum of ten (10) years of
that service has been in the employ of the City shall receive lifetime
medical benefits for themselves and their spouses.
(10) Uniform Allowance for Miscellaneous Personnel
in the Police Department.
Vernon shall provide a uniform allowance as specified in
Schedule XXII, Exhibit V, for 2008-2009 fiscal year of Vernon for the
purchase of uniforms for dispatchers, Records Personnel, Department
Secretary and Administrative Aide positions in the Police Department.
(11) Service Adjustment Increase
In the event there is an inequity between ranks or between
employees within a Department, upon reviewing the performance of an
employee, the Department Head may incorporate a service adjustment
increase up to ten percent (100) per month of their base salary.
1 b. POLICE MANAGEMENT EMPLOYEES.
2 (1) Payment of Incentive Compensation Peace Officers'
3 Standard Training Certificate.
4 Police management sworn employees (Police Chief, Police
5 Captains and Lieutenants) shall be eligible to receive peace officers'
6 standard training certificate incentive pay as follows:
7 (a) POST Intermediate Certificate.
8 Three percent (30) of the employee's base monthly salary,
9 excluding all other compensation, for the employee earning and
1.0 possessing a POST intermediate certificate.
11 (b) POST Advanced Certificate.
12 Six percent (6%) of the employee's base monthly salary,
13 excluding all other compensation, for the employee earning and
14 possessing a POST advanced certificate.
15 Payment of the aforesaid POST certificate shall not be
16 cumulative and only the highest applicable POST pay shall be paid.
17 POST pay shall be payable the month following the month during which
18 the certificate is received, or the month following completion of the
19 employee's evaluation period, whichever is latest.
20 (c) Lifetime Medical.

23
