3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
4 PROGRAM SUPPLEMENT NO. M002 REV. l TO ADMINISTERING
5 AGENCY -STATE AGREEMENT FOR FEDERAL -AID PROJECTS NO.
07-5139 BY AND BETWEEN THE CITY OF VERNON AND THE
6 STATE OF CALIFORNIA, ACTING BY AND THROUGH THE
DEPARTMENT OF TRANSPORTATION

8 WHEREAS, on August 18, 1998, the City Council of the City of
9 Vernon adopted Resolution No. 7206 approving and authorizing the
10 execution of an Administering Agency -State Agreement for Federal -Aid
11 Projects No. 07-5139 and Program Supplement Agreement No. 006 to Local
12 Agency -State Agreement (the "Agreements") with the State of California,
1.3 acting by and through the Department of Transportation ("State"); and
14 WHEREAS, in accordance with the Agreements, the City of
15 Vernon received federal funds for a feasibility study of congestion
16 and traffic management in the Alameda Corridor; and
17 WHEREAS; on April 17, 2002, the City Council of the City of
18 Vernon adopted Resolution No. 7944 approving and authorizing the
19 execution of Program Supplement No. M001 to the Agreements providing
20 for special covenants allowing additional funding for future phases of
21 the intersection improvements project at Atlantic and Bandini
22 Boulevards to be encumbered by use of a State approved "Authorization
23 to Proceed" and Finance Letter rather than revisions to the Program
24 Supplement Agreement; and
25 WHEREAS, on March 5, 2003, the City Council of the City of
26 Vernon adopted Resolution No. 8167 approving and authorizing the
27 execution of Program Supplement No. M002 to the Agreements providing
28 for special covenants allowing additional funding for future phases

of a bridge study at Atlantic Boulevard over the LA River to be
encumbered by use of a State approved "Authorization to Proceed" and
Finance`Letter rather than revisions to the Program Supplement
�JAgreement; and
WHEREAS, the State has requested that the City execute
Program Supplement No. M002 Rev. 1 to the Agreements providing for
special covenants allowing additional funding for future phases of
bridge rehabilitation and widening at Atlantic Boulevard over the LA
River (the "Project") to be encumbered by use of a State,approved
"Authorization to Proceed" and Finance Letter rather than revisions to
the Program Supplement Agreement and a matching fund contribution of
$273,508.00; and
WHEREAS, the Director of Community Services & Water_ has
recommended that Program Supplement No. M002 Rev. 1 to the Agreements
with the State for funding of the Project be approved and executed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1:_ The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the Program Supplement No. M002 Rev. 1 to the Agreements with
the State, in substantially the same form as the copy which is
attached hereto as;Exhibit A and incorporated by reference.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor or Mayor Pro-Tem to execute said Supplement for,
and on behalf of, the City of Vernon and the City Clerk is hereby
authorized to attest thereto.

1 SECTION 4: The City Council of the City of Vernon hereby
2 directs the City Clerk, or her designee, to send two executed
3 Supplements together with a certified copy of this Resolution to:

9 SECTION 5: The City Council of the City of Vernon hereby
10 authorizes the City Administrator, or his designee, to make whatever
11 nonsubstantive, administrative and/or text changes, upon advice of
12 counsel, to the Agreement.
13 SECTION 6: The City Council of the City of Vernon hereby
14 authorizes the City Administrator, or his designee, to take any action
15 deemed necessary to carry out or to perform such other acts and deeds
16 a:s may be necessary or convenient to effect the purposes of this
17 Resolution and the transactions herein authorized.
18 SECTION 7: The City Clerk of the City of Vernon shall
19 certify to the passage of this resolution, and thereupon and
20 thereafter the same shall be in full force and effect.
