RESOLUTION NO. 9679
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE CITY'S
PARTICIPATION IN THE FISCAL YEAR 2006 CHEMICAL
BUFFER ZONE PROTECTION PROGRAM BY THE VERNON POLICE
DEPARTMENT
WHEREAS, on April 2, 2007, the City Council of the City of
Vernon adopted Resolution No. 9285 approving the City's participation
in the fiscal year 2005 Buffer Zone Protection Grant program under
which the City obtained $93,000.00 to cover the cost of radios to
enhance the communication capabilities of the Vernon Police
Department; and
WHEREAS, the FY 2006 Chemical Buffer Zone Protection Program
Grant, Grant No. 2006-OGT-078-1389 (the "2006 Chem-BZPP Grant"),
developed through partnerships with the Office for Domestic
Preparedness and the Information Analysis and .Infrastructure
Protection Directorate and the Department of Homeland Security
("DHS"), provides funds to build security and risk management
capabilities through the implementation of preventive and preparedness
efforts at the state and local levels to protect and secure critical
infrastructure and key resource sites from threats or acts of
terrorism; and
WHEREAS, the City of Vernon is one of the jurisdictions that
are eligible to participate in the grant process; and
WHEREAS, the Los Angeles County Office of Emergency
Management ("OEM") is coordinating the grant process for recipients
within Los Angeles County and will reimburse the City of Vernon for
all authorized equipment purchases; and

WHEREAS, all purchases made under this 2006 Chem-BZPP Grant
must be processed by OEM by September 30, 2008, unless the period is
extended for six (6) months; and
WHEREAS, on March 21, 2008, the DHS advised the OEM of
funding in the amount of $6,267,245 for chemical site -specific
facilities under the 2006 Chem-BZPP Grant; and
WHEREAS, in May of 2008, the Vernon PoliceDepartment
prepared and submitted a Vulnerability Reduction Purchasing Plan (the
"VRPP") identifying items that were intended to be purchased to
enhance their capabilities, a copy of which is attached hereto as
Exhibit A and incorporated by reference; and
WHEREAS, the DHS has advised that the City has been approved
for the sum of $820,108 for equipment purchases to improve its
response and deployment capabilities; and
WHEREAS, participation in the 2006 Chem-BZPP Grant would
enhance the capability of the Vernon Police Department to better
safeguard and minimize the potential for terrorist attacks at
identified facilities, thereby enhancing the services provided to
citizens, residents, businesses and employees in Vernon and
neighboring communities; and
WHEREAS, by memo dated July 17, 2008, the Police Chief has
recommended the City's participation in the 2006 Chem-BZPP Grant; and
WHEREAS, the City Council of the City of Vernon desires to
approve and ratify the City's participation in the 2006 Chem-BZPP
Grant and declare its intention to purchase the equipment identified
in the VRPP.
NOW, THEREFORE,- BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:

SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves, authorizes and ratifies the City's participation in the 2006
Chem-BZPP Grant.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the City Administrator, or his designee, to execute any and
all documents necessary for the purpose of security grant funds and to
implement and carry out the purposes specified in the 2006 Chem-BZPP
Grant for, and on behalf of, the City of Vernon
SECTION 4: the City Council of the City of Vernon hereby
declares its intention to purchase the equipment identified in the
VRPP.
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 4th day of August, 2008.
