Resolution No. 9690I 1 2 3 4 5 C%J 7 M. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9690 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON FINDING THE CITY OF VERNON TO BE IN CONFORMANCE WITH THE CONGESTION MANAGEMENT PROGRAM (CMP) AND ADOPTING THE CMP LOCAL DEVELOPMENT REPORT, IN ACCORDANCE WITH CALIFORNIA GOVERNMENT CODE SECTION 65089 WHEREAS, the Congestion Management Program ("CMP") statute requires the Los Angeles County Metropolitan Transportation Authority ("LACMTA"), acting as the Congestion Management Agency for Los Angeles County to annually determine that the County and cities within the County are conforming to all CMP requirements; and WHEREAS, the LACMTA requires submittal of the CMP Local Development Report by September 1 of each year; and WHEREAS, the City Council of the City of Vernon held a noticed public hearing on August 18, 2008, at which time all interested persons were given an opportunity to be heard; and WHEREAS, the City Council has heard and considered all evidence, both written and oral, presented respecting Vernon's conformance with the criteria in the CMP as established by the LACMTA. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true land correct. SECTION 2: The City Council finds and determines that the City of Vernon has taken all of the following actions, and that the City is in conformance with all applicable requirements of the 2004 CMP 1 adopted by the LACMTA Board on July 22, 2004. 2 A. The City of Vernon has locally adopted and continues to 3 implement a transportation demand management ordinance, consistent with 4 the minimum requirements identified in the CMP Transportation Demand 5 Management chapter. 6 B. The City of Vernon has locally adopted and continues to 7 implement a land use analysis program, consistent with the minimum 8 requirements identified in the CMP Land Use Analysis Program chapter. 9 C. The City of Vernon has adopted a Local Development 10 Report ("LDR"), attached hereto as Exhibit A and incorporated by 11 reference, consistent with the requirements identified in the 2004 CMP. 12 This report balances traffic congestion impacts due to growth within 13 the City with transportation improvements, and demonstrates that the 14 City is meeting its responsibilities under the Countywide Deficiency 15 Plan consistent with the LACMTA Board adopted 2003 Short Range 16 Transportation Plan. 17 SECTION 3: The City Council of the City of Vernon hereby 18 directs the City Clerk, or her designee, to forward a certified copy of 19 this Resolution with the attached LDR to: 20 Attn: Stacy Alameida, CMP Manager Los Angeles County Metropolitan Transportation Authority 21 Congestion Management Program, Mail Stop 99-23-2 22 1 Gateway Plaza Los Angeles, CA 90012-2952 23 24 25 26. 27 28 - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 4: The City Clerk of the City of Vernon shall 'certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
