RESOLUTION NO. 9733
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND RATIFYING ACTIONS TAKEN
REGARDING RENEWAL OF POLLUTION LEGAL LIABILITY
INSURANCE FROM AMERICAN INTERNATIONAL SPECIALTY
LINES INSURANCE COMPANY
WHEREAS, the City of Vernon has evaluated its liability
insurance policies in light of the acquisition of properties by the
City; and
WHEREAS, the City's current Pollution Legal Liability
Insurance Policy with American International Specialty Lines Insurance
(Company ("American") for insurance for pre-existing conditions of
acquired properties expired on September 15, 2008; and
WHEREAS, the City desired to renew the policy of insurance
to protect the City; and
WHEREAS, the City of Vernon needed to purchase the necessary
pollution legal liability insurance before September 15, 2008; and
WHEREAS, the City employed the services of Arthur J.
Gallagher & Co. Insurance Brokers of California, Inc. ("Arthur J.
(Gallagher") to act as the City's broker to structure and obtain the
appropriate insurance coverage for the period September 15, 2008
through September 15, 2009; and
WHEREAS, Arthur J. Gallagher has recommended that the City
enter into an arrangement with American for the provision of insurance
for an annual premium amount of $12,931.67; and
WHEREAS, in order to meet the urgent need for renewal of the
insurance policy, the Risk Manager authorized the renewal and executed
any forms necessary to implement the insurance with American, subject

1 to ratification by the, City Council; and
2 WHEREAS, the City Council of the City of Vernon desires to
3 approve and ratify the actions taken by the Risk Manager in obtaining
4 the renewal of the pollution legal liability insurance for pre-
5 existing conditions of acquired properties and any document executed
6 by the Risk Manager and approve and authorize the payment of the
7 annual premium in accordance therewith; and
8 WHEREAS, the City Council of the City of Vernon has
9 determined that, pursuant to the provisions of subsection (a) of
10 Section 2.27 of the Vernon City Code, it is in the public interest and
11 necessity to ratify renewal of the Pollution Legal Liability Insurance
12 with American, through Arthur J. Gallagher.
13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
14 CITY OF VERNON AS FOLLOWS:
15 _ SECTION 1: The City Council of the City of Vernon hereby
16 finds and determines that the recitals contained hereinabove are true
17 and correct.
18 SECTION 2: The City Council of the City of Vernon hereby
19 ratifies and authorizes the Risk Manager, or his designee, to execute
20 any and all documents necessary for the purpose of securing the
21 renewal of the insurance and to implement and carry out the purposes
22 specified in the insurance renewal on behalf of the City of Vernon.
23 SECTION 3: The City Council of the City of Vernon hereby
24 approves and authorizes the annual premium payment of $12,931.67 in
25 accordance with the terms of the insurance renewal.

SECTION 4: The City Council of the City of Vernon hereby
directs the City Clerk, or her designee, to send a copy of this
Resolution to:

Insurance Brokers of California, Inc.

Glendale, CA 91203-3944
SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
