Resolution No. 97441 2 3 4 5 6 7 8 9 14 15 16 17 18' 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9744 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON INSTRUCTING ALL CITY DEPARTMENT HEADS TO CONSIDER THE PROCUREMENT OF ENVIRONMENTALLY PREFERABLE VEHICLES WHEREAS, buying climate -friendly vehicles harnesses the purchasing power of public agencies to.reduce greenhouse gas emissions and combat climate change, both in its own operations and throughout the community, while at the same time encouraging others to do WHEREAS, the City Council of the City of Vernon believes that the City has an opportunity to serve as a community model for environmental leadership by incorporating a plan of action that will conserve precious resources, reduce the burden on the local and global environment, reduce the use of hazardous substances from its operations, protect public health and help develop markets for environmentally responsible vehicles as well as potentially improve the environmental quality of the region by incorporating environmental consideration in the purchasing of its vehicles; and WHEREAS, for_the purposes of this resolution, environmentally preferable vehicles means vehicles that have a lesser or reduced effect on human health and the environmental when compared to competing vehicles that serve the same purpose; and WHEREAS, for the purposes of this resolution, practicable means whenever possible and compatible with local, state and federal law and specified operation, without reducing performance, public safety, quality, or effectiveness and where the vehicle is available at a reasonable cost in a reasonable period of time; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, the City Council of the City of Vernon desires to encourage and increase the use of environmentally preferable vehicles including, but not limited to, flexible fuel vehicles, alternative fuel vehicles and advanced technology vehicles in order to promote practices that improve public and worker health, conserve natural resources and reward environmentally conscious manufacturers, while remaining fiscally responsible; and WHEREAS, while the City is committed to procuring climate - friendly vehicles that meet its performance standards and requirements at a competitive cost, nothing in its policy regarding climate -friendly purchasing of vehicles may be construed as requiring the acquisition of goods or services that do not perform adequately for their intended use, exclude adequate competition, or are not available at a reasonable price in a reasonable period of time; and WHEREAS, the City has determined that it is to the City's advantage, and in the public interest of the inhabitants of the City, to instruct its Department Heads to purchase, as far as practicable, environmentally preferable vehicles. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herei.nabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby instructs the Department Heads of the City of Vernon to consider, when practicable, the purchase of environmentally preferable vehicles. SECTION 3: The City Council of the City of Vernon is not requiring its departments to procure vehicles that do not perform - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2.8 adequately for their intended use, exclude adequate competition or -are not available at a reasonable price in a reasonable period of time. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
