1 2 3 4 5 6 7 8 9 10 11 12 13 WE 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9746 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO HANSEN FAMILY TRUST FROM SECTION 26.5.1-6(f) AND (h) OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTIES LOCATED AT 4410 and 4404 DISTRICT BOULEVARD IN THE CITY OF VERNON WHEREAS, Hansen Family Trust owns and occupies two (2) separate and adjoining properties located at 4410 District Boulevard and 4404 District Boulevard, in the City of Vernon (collectively, the "Property") and is requesting a variance from Section 26.5.1-6(f) and (h), Development Standards of the Comprehensive Zoning Ordinance; and WHEREAS, the Property is located in the I —Zone, Industrial, and consists of two (2) parcels; and WHEREAS, 4404 District Boulevard contains a portion of the existing building and all the proposed parking stalls; and WHEREAS, 4410 District Boulevard contains the other portion of the building that will be used for office, manufacturing, warehousing and distribution which is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, Hansen Family Trust is in the process of constructing approximately 1,452 square feet of new office area which will be located.on•the north end of the existing building on the Property; and WHEREAS, due to the amount of office area being constructed, additional parking and loading spaces are required, which also includes maneuvering; and WHEREAS, the owner's development proposal would bring the Property into conformity with the applicable regulations with two (2) 1 exceptions involving the required maneuvering aisle for automobile 2 parking and required size of truck stalls, thus prompting this variance 3 application; and 4 WHEREAS, the existing building on the Property is 5 approximately 4,190 square feet in size, on a lot of approximately 6 15,840 square feet and in order for the owner to fully comply with the 7 auto parking and maneuvering requirements of the Comprehensive Zoning 8 Ordinance, a significant portion of the building would need to be 9 demolished; and 10 WHEREAS, the most efficient way for the owner to provide the 11 required parking and maneuvering is by reducing the aisle width from 12 the required 27 feet to 24.6 feet, to compensate for this shortened 13 maneuvering aisle, the owner is proposing to widen each automobile 14 parking space from the required 8.5 feet to a minimum of 9.6 feet, in 15 effect, the proponent is providing a larger turning radius for the 16 automobiles to enter and exit the parking stalls to compensate for the 17 shorter aisle width; and 18 WHEREAS, the Community Services Department has determined 19 that the additional width will allow the vehicles to enter and exit 20 the parking stalls and that the parking arrangement is consistent with 21 parking provisions of neighboring communities; and 22 WHEREAS, the Property shares a common driveway with the 23 neighbor to the east, and due to the narrow lot and existing building 24 which limits the length of truck spaces to 55, feet in length instead 25 of the 75' feet required by the Code, both of these truck stalls are 26 10, feet wide, the owner is providing the unobstructed maneuvering 27 area (50, feet) for both stalls; and 28 WHEREAS, the owner has requested permission to allow the use 2 1 2' 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 Wz 23 24 25 26 27 28 of these two (2) truck stalls with the understanding that all trucks entering the site shall be limited to a maximum of 40 feet in length at the non -conforming truck -loading spaces; and WHEREAS, as previously mentioned, due to the space constraints on their existing lot, the possibility of providing full conformity with truck parking and maneuvering is remote without the demolition of onsite improvements; and WHEREAS, Section 26.5.1-6(f) of the Zoning Ordinance specifies that each truck loading space shall be a minimum of 10 feet wide, 75 feet long; and WHEREAS, Section 26.5.1-6, Adequate Off -Street Parking and Loading Facilities, specifies that the facility is required to have six (6) automobile parking spaces, one (1) truck loading space, and one (1) truck parking space, and the proposed site complies with this section by providing (six) 6 automobile parking spaces, one (1) truck loading space and one (1) truck parking space; and WHEREAS, the proposed project complies with the required number of automobiles and truck parking and loading spaces as stated by the Comprehensive Zoning Ordinance; and WHEREAS, the existing use does not and will not adversely affect the surrounding area because the site has historically been used for office, manufacturing, warehousing and distribution; and WHEREAS, Hansen Family Trust has agreed to use shorter trucks that will not extend into the public right-of-way; and WHEREAS, the City Council has received a Staff Report dated October 8, 2008, upon which it has relied in making the foregoing recitals; and WHEREAS, the City Council of the City of Vernon held a - 3 - I 2 3 4 5 6 rA 8 9 10 11 12 13 14 15 16 17 18 19 20 21 OPPA 23 24 25 26 27 28 hearing on said application for variance on October 20, 2008; and WHEREAS, the circumstances surrounding the applicant's situation are unique in that other properties in the area do not have the same physical constraints that preclude installation of automobile parking stalls with a maneuvering aisle conforming to Section 26.5.1- 6(f), and such circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of his building merely because it is infeasible to provide the required maneuvering aisle with the required 1width of 27 feet, while it is feasible to provide a maneuvering aisle of 24.6 feet; and WHEREAS, in order for the building to conform to the current Comprehensive Zoning Ordinance, a significant portion of the building would need to be demolished, therefore; strict application of the off- street parking, access and loading requirements of the Ordinance at this time would cause an unreasonable hardship to the applicant; and WHEREAS, the variance will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the premises; the proposal is consistent with the objectives of the General Plan and Zoning Ordinance; the granting of a variance will not constitute the granting of a special privilege in that the effects, if any, of the decreased width of the maneuvering aisle will be confined to the property, and the applicant will be required to install and maintain parking stalls that are wider than required under Section 26.5.1-6(f) to compensate for the decreased maneuvering aisle and provide the functional equivalent of a conforming parking layout, as previously mentioned; the Property shares a common driveway with the neighbor to the east; and due to the narrow lot and - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 existing building which limits the length of truck spaces to 55, feet in length instead of the 75, feet required by the Code, the owner will be providing the unobstructed maneuvering area (50, feet) for both stalls; and WHEREAS, the owner has requested permission to allow the use of these two (2) truck stalls with the understanding that all trucks entering the site shall be limited to a maximum of 40 feet in length at the non -conforming truck -loading spaces to avoid protruding into the public right-of-way and should the City Council approve this variance, the site shall retain its legal non -conforming status; and WHEREAS, the applicant's building at 4410 District Boulevard will be providing two (2) non -conforming truck loading spaces measuring 10.0 feet in width and 55.0 feet in length and for these non -conforming truck loading spaces to conform to the current Comprehensive Zoning Ordinance, a significant portion of the building would need to be demolished; and WHEREAS, the applicant has stated that all trucks entering the site shall be limited to a maximum of 40 feet in length at the shorter non -conforming truck loading spaces to ensure that vehicles will not extend into the street right-of-way while in the loading spaces, and all automobile aisles will be maintained unobstructed at all times; and WHEREAS, as long as the applicant complies with the above conditions, the variance will be consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby - 5 - v 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 11finds and determines that the recitals contained hereinabove are true (land correct. SECTION 2: A variance from Section 26.5.1-6(f) and (h), Development Standards of the Comprehensive Zoning Ordinance, is hereby granted to Hansen Family Trust for the property located at 4410 District Boulevard. SECTION 3: The variance granted is subject to the following Ilconditions: a) The facility shall be operated in accordance with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a variance. b) All parking and loading areas shall be striped in a manner acceptable to the Director of Community Services & Water and shall be paved with a hard durable surface material and shall be IC) adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be maintained to meet City standards. The building and parking area shall be maintained substantially in compliance with the site plan submitted, as part of this variance application. d) A covenant shall be recorded with the Los Angeles County Recorder's office prior to construction advising all future property owners that all trucks entering the site to park or unload are limited to a maximum of 40 feet in length, that any violation of this requirement is subject to a maximum $500.00 fine, and that signs regarding the maximum length of the trucks permitted on the - 6 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 property are.to be posted. e) The owner shall post a sign with a minimum 2" type adjacent to each driveway entrance that states "Maximum Length of trucks allowed in this site is 40 feet in length. REASON FOR VARIANCE As previously mentioned, Hansen Family Trust is proposing to increase their office area. As a result of this expansion additional parking spaces were required to be provided. Due to the space constraints on their existing lot, the possibility of providing full conformity with truck parking and maneuvering is remote without the demolition of onsite improvements. The property is an infill site with an existing concrete tilt -up —2— building; the lot is square and is approximately 0.36 acres in size. Due to the layout of the building it limits the size of trucks that the building could accommodate. The owner has mentioned that the property shares a common driveway with the neighbor to the east, and due to the narrow lot and existing building which limits the length of truck spaces to 55' feet in length instead of the 75' feet required by the Code. Nevertheless, the owner will be providing the unobstructed maneuvering area (50' feet) for both stalls. The owner has requested permission to allow the use of these two truck stalls with the understanding that all trucks entering the site shall be limited to a maximum of 40 feet in length at the non- conforming truck -loading spaces. Hansen Family Trust is requesting a variance from the requirements of Section 26.5.1-6(f) be issued to it at this time for the non -conforming truck loading spaces with the condition that the spaces be utilized by smaller trucks. The arrangement of the trucks stalls will not allow the trucks to extend in the street right-of-way. According to the Comprehensive Zoning Ordinance Section 26.5.1-6, adequate off-street Parking and Loading Facilities, specifies that the facility is required to have 6 automobile parking spaces, 1 truck loading space, and 1 truck parking space. The proposed site complies with this section by providing 6 automobile parking spaces, 1 truck loading space and 1 truck parking space. Therefore, the proposed project complies with the required number of automobiles and truck parking and loading spaces as stated by the Comprehensive Zoning Ordinance. —3— However, as previously mentioned, in order for the owner to fully comply with the auto parking and maneuvering requirements, a significant portion of the building would need to be demolished. The most efficient way for the owner to provide the required parking and maneuvering is by reducing the aisle width from the required 27 feet to 24.6 feet, to compensate for this shortened maneuvering aisle, the owner has proposed to widen each automobile parking space from the required 8.5 feet to a minimum of 9.6 feet. Therefore, Hansen Family Trust is requesting a variance from Section 26.4.5-1(f) and (h) of the Comprehensive Zoning Ordinance, Development Standards. VALIANCE METHODOLOGY The applicant is requesting a variance from Section 26.5.1-6(f) of the current City of Vernon Comprehensive Zoning Ordinance, which specifies that each truck loading space shall be a minimum of 10' feet wide and 75' feet long. Section 26.5.1-6(h) of the current City of Vernon Comprehensive Zoning Ordinance, which specifies that each automobile parking stall angled at 90 ° degrees, shall provide an aisle/unobstructed maneuvering area of 27' feet. The nature of the Property and the circumstances surrounding the applicant's situation are unique in that other properties in the area do not have the same physical constraints that preclude installation of automobile parking stalls with a maneuvering aisle conforming to Section 26.5.1-6(h), and Section 26.5.1-6(f) of the current City of Vernon Comprehensive Zoning Ordinance, which specifies that each truck loading space shall be a minimum of 10' feet wide and 75' feet long. Such circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of his building merely because it is infeasible to provide the required maneuvering aisle with the required width of 27 feet, while it is feasible to provide a maneuvering aisle of 24.5 feet and 55 foot long truck stalls instead of the required 75' feet. As previously mentioned, the applicant has agreed that only vehicles of smaller lengths will be used at the shorter non -conforming truck loading spaces to ensure that vehicles will not extend into the street right-of-way while parked in the loading spaces. In addition, they will provide wider automobile parking stalls. As long as the applicant complies with this condition, the variance will be consistent with the objectives of the Comprehensive Zoning Ordinance and General Plan. CEQA The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from noise, odor, dust, smoke, light or glare from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared and filed with the County —5— Clerk's office. STAFF FINDING AND CONDITIONS Staff finds the following to be true: a) The circumstances surrounding the applicant's situation are unique in that other properties in the area do not have the same physical constraints that preclude installation I f automobile parking stalls with a maneuvering aisle conforming to Section 26.5.1-6(f), and such circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of his building merely because it is infeasible to provide the required maneuvering aisle with the required width of 27 feet, while it is feasible to provide a maneuvering aisle of 24.6 feet. In order for the building to conform to the current Comprehensive Zoning Ordinance, a significant portion of the building would need to be demolished. Therefore, strict application of the off-street parking, access and loading requirements of the ordinance at this time would cause an unreasonable hardship to the applicant at this time. b) The variance will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the premises, the proposal is consistent with the objectives of the general plan and zoning ordinance, and the granting of a variance will not constitute the granting of a special privilege in that the effects, if any, of the decreased width of the maneuvering aisle will be confined to the property, and the applicant will be required to install and maintain parking stalls that are wider than IL required under Section 26.5.1-6(f) to compensate for the decreased maneuvering aisle and provide the functional equivalent of a conforming parking layout. As previously mentioned, the property shares a common driveway with the neighbor to the east, and due to the narrow lot and building which limits the size of truck spaces to 55' feet in length instead of the 75' feet required by the Code. Nevertheless, the owner will be providing the unobstructed maneuvering area (50' feet) for both stalls. The owner has requested permission to allow the use of these two truck stalls with the understanding that all trucks entering the site shall be limited to a maximum of 40 feet in length at the non -conforming truck -loading spaces to avoid protruding into the public right-of-way. However, should the City Council approve this variance the site shall retain its legal non -conforming status. c) The applicant's building at 4410 District Boulevard will be. providing two non- conforming truck loading spaces measuring 10.0 feet in width and 55.0 feet in length. The applicant has stated that all trucks entering the site shall be limited to a maximum of 40 feet in length at the shorter non -conforming truck loading spaces to ensure that vehicles will not extend into the street right-of-way while in the loading spaces. The applicant has also stated that all automobiles aisles shall be maintained unobstructed at all times. As long as the applicant complies with these conditions, the variance will be consistent with -7- the objectives of the Comprehensive Zoning Ordinance and the General Plan. Therefore, it is recommended that the variance be granted with the following conditions imposed on the permit to adequately protect the public interests: a.
