A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON GRANTING A VARIANCE TO VAZGEN GALADJIAN FROM
SECTION 26.5.1-6(b) OF THE COMPREHENSIVE ZONING
ORDINANCE, FOR THE PROPERTY LOCATED AT 5820 ALAMEDA
STREET IN THE CITY OF VERNON
WHEREAS, Vazgen Galadjian is requesting a variance from
Section 26.5.1-6(b) of the Comprehensive Zoning Ordinance; and
WHEREAS, 5820 Alameda Street is located in the I -Zone,
Industrial, and the operation is consistent with the objectives of the
General Plan and Comprehensive Zoning Ordinance; and
WHEREAS, Vazgen Galadjian owns the proposed two-story
building located at 5820 Alameda Street and occupies only the first
floor of the building (approx. 26,000 sq. ft.); and
WHEREAS, the second floor (approx. 23,900 sq. ft.) of the
building has been vacant for more than two (2) years; and
WHEREAS, Section 26.5.3-2 of the Comprehensive Zoning
Ordinance of the City of Vernon requires that if more than twenty-five
percent (250) of a non -conforming building is left vacant for more than
two (2) years, then the vacant spaces shall not thereafter be occupied
until it has been brought into conformity with all of the regulations
lof the zone which it is located; and
WHEREAS, according to the current parking requirements,
fifty (50) parking stalls, two (2) truck parking spaces and five (5)
truck loading spaces are required by the Code; and
WHEREAS, the subject site is providing fifty-seven (57)
parking spaces, two (2) truck parking spaces and four (4) truck
loading spaces, which is one (1) truck loading space short of the
requirements; and

WHEREAS, due to the space constraints on their existing lot,
the possibility of providing additional truck loading is remote
without the demolition of on -site improvements; and
WHEREAS, the owner has indicated it would be rare that more
than two (2) truck loading spaces at the facility would be used, at
any one (1) time; and
WHEREAS, the current occupant, Westaire Engineering, Inc.,
only receives one (1) truck per day, therefore, it is requesting a
variance from Section 26.5.1-6(b) of the Vernon City Code; and
WHEREAS, according to owner, the maximum number of employee
vehicles at the -site at one time would be ten (10), plus one (1) truck
trip per day and if the variance were granted, Vazgen Galadjian would
still be providing forty-seven (47) parking spaces and four (4) trunk
stalls for any future occupants; and
WHEREAS, since there is ample room to accommodate the
owner's current parking needs, there will be no parking overflow onto
adjacent side streets and the surrounding area; however, if at anytime
Vazgen Galadjian needs additional truck loading or parking spaces
beyond the number provided, Vazgen Galadjian will be required to meet
the minimum standards; and
WHEREAS, given the physical conditions of the property,
strict compliance with Section 26.5.1-6(b) would force Vazgen
Galadjian to demolish a portion of its existing building in order to
provide an additional required truck loading space, thus creating an
unreasonable hardship; and
WHEREAS, Vazgen Galadjian proposes to pave and stripe the
lot and provide fifty-seven (57) automobile parking spaces and six (6)
truck spaces; and

1 WHEREAS, the project is categorically exempt from the
2 California Environmental Quality Act pursuant to Section 15301; and
3 WHEREAS, the City Council has received a Staff Report dated
4 October 8, 2008, upon which it has relied in making the foregoing
5 recitals; and
6 WHEREAS, the City Council of the City of Vernon held a
7 hearing on said application for a variance on October 20, 2008.
8 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
9 CITY OF VERNON AS FOLLOWS:
10 SECTION 1: The'City Council of the City of Vernon hereby
11 finds and determines that the recitals contained hereinabove are true
12 and correct.
13 SECTION 2: Section 26.5.3-2 of the Comprehensive Zoning
14 Ordinance of the City of Vernon requires that if more than twenty-five
15 percent (250) of a non -conforming building is left vacant for more
16 than two (2) years, then it shall not thereafter be occupied until it
17 has been brought into conformity with all of the regulations of the
18 zone which it is located.
19 SECTION 3: The variance from the requirement of Section
20 26.5.1-6(b) is granted subject to the following conditions:
21 a) The facility shall be operated in accordance with all current
22 codes, rules, and regulations and subject to permit fees as
23 adopted by the City of Vernon.
24 b) All parking and loading areas necessary for Vazgen Galadjian
25 operations shall be striped in a manner acceptable to the
26 Director of Community Services & Water and shall be paved with
27 a hard durable surface material and shall be adequately
28 drained, and kept free of dust, mud, trash and weeds. Where

parking or maneuvering areas adjoin the public street, a
barrier wall or landscaping shall be maintained to meet City
standards. Adequate on -site parking shall be maintained so
that no on -street parking or staging will occur. The facility
shall be operated in a manner that will not impede traffic on
Alameda Street and 1st Street. All vehicles: shall enter and
exit the site in a front forward manner. No maneuvering or
vehicle parking or staging associated with the facility shall
take place off -site or on the public street without prior
approval from the Community Services Department.
c) Prior to occupancy of the 2nd floor all parking and loading
spaces shall be provided and maintained substantially in
compliance with the site plan submitted, as part of this
variance application.
d) Noncompliance with any condition shall constitute sufficient
grounds for the City Council of the City of Vernon to void
this variance and require the applicant, Vazgen Galadjian, to
comply with the truck loading requirements of the
Comprehensive Zoning Ordinance.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.

Vazgen Galadjian has requested a variance from Section 26.5.1-6(b) of the Comprehensive

VARIANCE APPLICATION

The owner of the property, located at 5820 Alameda Street in the City of Vernon,
Vazgen Galadjian has requested a variance from Section 26.5.1-6(b) of the
Comprehensive Zoning Ordinance, Minimum Truck loading requirements.
The proposed site is a preexisting building located at 5820 Alameda Street. The
property contains a two story building approximately 50,000 square feet in size. The total
size of the parcel is approximately 1.26 acres. However, a portion of the building has
been vacant for more than two years (The 2nd Floor — approx. 23,900 sq. ft.). So in order
to occupy the vacant portion it must be brought into compliance with all the current
codes, which includes automobile parking, truck parking, loading, and maneuvering.
Section 26.5.3-2 of the Comprehensive Zoning Ordinance of the City of Vernon requires
that if more than 25% of non -conforming building is left vacant for more than two years,
then it shall not thereafter be occupied until it has been brought into conformity with all
of the regulations of the zone which it is located.
According to the current parking requirements, 50 parking stalls, 2 truck parking
spaces and 5 truck loading spaces are required by the Code. The subject site is providing
57 parking spaces, 2 truck parking spaces and 4 truck loading spaces, which is one truck
loading space short from the requirements. Due to the space constraints on their existing
lot, the possibility of providing an additional truck loading space is remote without the
demolition of onsite improvements. The owner has indicated that it has no plans for
expansion or alteration of the building configuration. The operation is in conformance
with the Zoning Ordinance and General Plan. Therefore, Vazgen Galadjian is requesting
a variance from Section 26.5.1-6(b) of the municipal code.
REASON FOR VARIANCE
As previously mentioned, a portion of this building (The 2nd Floor— approx.
23,900 sq. ft.) has been vacant for more than two years. In order to occupy that portion of
the building as a manufacturer or warehouse it must be brought into compliance with all
the current codes, which includes automobile parking, truck parking, loading, and
maneuvering. According to the current parking requirements, 50 parking stalls, 2 truck
parking spaces and 5 truck loading spaces are required by the Code. The subject site is
providing 57 parking spaces, 2 truck parking spaces and 4 truck loading spaces, which is
one truck loading space short from the requirements. Due to the space constraints on their
existing lot, the possibility of providing additional truck loading is remote without the
demolition of onsite improvements. The owner has indicated it would be rare that the use
of more than two truck loading spaces at the facility, at any one time. The current
occupant, Westaire Engineering, Inc, only receives one truck per day. Therefore,
requesting a variance from Section 26.5.1-6(b) of the municipal code.

VARIANCE METHODOLOGY
Vazgen Galadjian is requesting a variance from the truck loading requirements of
Section 26.5.1-6(b) of the Comprehensive Zoning Ordinance. Section 26.5.1-6(b) states
that all buildings and uses shall provide adequate off-street Loading Spaces and areas to
accommodate trucks being loaded, unloaded, or waiting to be loaded or unloaded in
accordance with the following standards. Truck Loading Spaces in excess of the required
number may be counted as required parking spaces.
PARKING ANALYSIS
The amount of automobile parking spaces required by the Vernon Code is 50, the
amount of truck parking required is 2 spaces, and the amount of truck loading required is
5 spaces. Vazgen Galadjian will, be providing:57 parking spaces (seven spaces over the
required amount) and a total of 2 truck parking and 3 truck loading stalls (one short from
the required amount). Due to the space constraints on their existing lot, the possibility of
providing an additional truck loading space is remote without demolishing a significant
portion of the existing building.
The City's parking requirements are based, in part, on the type of use to which the
building is being put. Industrial and manufacturing uses, warehouses, wholesale uses, and
similar uses require one space per 1,000 square feet of gross floor area for automobiles.
The truck loading requirements are based, in part, on the type of use to which the building

Floor area is defined as "the total of all floors contained within the exterior walls of all
buildings measured by the exterior dimensions of the building, on a lot or parcel of land".
The owner has indicated that given that a total of the vehicle and truck trips per day would
be spread throughout the day, thus traffic impacts are expected to be minor. Most of the
traffic generated by the subject site will be from the employees.
According to Vazgen Galadjian, the maximum number of employee vehicles at the
site at one time is 10, plus one truck trip per day. If the variance were granted Vazgen
Galadjian would still be providing 47 parking spaces and 4 truck stalls for any future
occupants. Since there is ample room to accommodate his current parking needs, then
there will be no parking overflow onto adjacent side streets and the surrounding area.
However, if at anytime Vazgen Galadjian needs .additional truck loading or parking
spaces beyond the number provided, Vazgen Galadjian will be required to meet the
minimum standards. Consequently, the existing use does not and will not adversely affect
the interest of the public or vicinity of the premises.
CEQA REVIEW
The proposed site is surrounded by industrial uses compatible with the proposed
operation. No potentially significant impacts are expected to result from noise, odor, dust,
smoke, light or glare from the project. The project is categorically exempt under Section
15301 of the California Environmental Quality Act because it is an existing facility. A
Notice of Exemption will be prepared and filed with the County Clerk.
STAFF FINDING AND CONDITIONS
Staff proposes the following findings as required by Section 26.5.1-6, of the City
of Vernon Comprehensive Zoning Ordinance:
a) A portion of the building has been vacant for a continuous period of more
than two years and therefore it is required to come into complete compliance with the
automobile parking, truck parking, truck loading, and maneuvering requirements of the
City's Zoning Ordinance. The strict application of the truck loading requirements of the
Comprehensive Zoning Ordinance would create a hardship on Vazgen Galadjian, by
requiring him to demolish a portion of their already existing manufacturing facility to
construct an unneeded truck loading space.
b) The facility does not meet the minimum number. of truck loading spaces,
however, as previously indicated it would be rare that the use of more than two truck
loading spaces at the facility, at any one time.
c) This variance will not adversely affect the interest of the public or the interests
of other residents and property owners within the vicinity of the premises because the
applicant's existing loading spaces are enough to satisfy its needs. In addition, adequate
on -site parking and loading shall be maintained so that no on -street parking or staging
will occur. The operation is in conformance with the Comprehensive Zoning Ordinance
and the General Plan.
Therefore it is recommended that the variance be granted with the following
conditions imposed on the permit to adequately protect the public interests:

SUBJECT: Variance — Vazgen Galadjian located at 5820 Alameda Street
The owner of the property, located at 5820 Alameda Street in the City of Vernon, Vazgen
Galadjian has requested a variance from Section 26.5.1-6(b) of the Comprehensive Zoning Ordinance,
Minimum Truck loading requirements. The proposed site is a preexisting building located at 5820
Alameda Street. The property contains a two story building approximately 50,000 square feet in size.
The total size of the parcel is approximately 1.26 acres. However, a portion of the building has been
vacant for more than two years (The 2" a Floor — approx. 23,900 sq. ft.). So in order to occupy the
vacant portion it must be brought into compliance with all the current codes, which includes
automobile parking, truck parking, loading, and maneuvering. Pursuant to Section 26.5.3-2 of the
Comprehensive Zoning Ordinance of the City of Vernon requires that if more than 25% of a non-
conforming building is left vacant for more than two years, then it shall not thereafter be occupied
until it has been brought into conformity with all of the regulations of the zone which it is located.
According to the current parking requirements, 50 parking stalls, 2 truck parking spaces and 5
truck loading spaces are required by the Code. The subject site is providing 57 parking spaces, 2 truck
parking's and 4 truck loading spaces, which is one truck loading space short from the requirements.
Due to the space constraints on their existing lot, the possibility of providing an additional truck
loading space is remote without the demolition of onsite improvements. The owner has indicated that
it has no plans for expansion or alteration of the building configuration. The operation is in
conformance with the Zoning Ordinance and General Plan. Therefore, Vazgen Galadjian is requesting
a variance from Section 26.5.1-6(b) of the municipal code.
It is recommended that a public hearing for this variance be held on October 20, 2008.
Enclosed herewith is a Notice of Public Hearing. Please execute the notice. My Department will
ensure that the notice is mailed and posted. Thank you.
