FROM SECTION 26.5.1-6 OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2923 FRUITLAND AVENUE IN THE CITY OF VERNON WHEREAS, Owens -Brockway Glass Container, Inc. (hereinafter referred to as "Owens -Brockway") owns and occupies the property located at 2923 Fruitland Avenue in the City of Vernon (hereinafter referred to as the "Property"); and WHEREAS, on December 17, 2007, the City Council of the Vernon enacted Ordinance No. 1139, which became effective on January 16, 2008, adopting the Comprehensive Zoning Ordinance of the City of Vernon (the "Zoning Ordinance"); WHEREAS, the Property is located in the I -Zone, Industrial; and WHEREAS, on February 19, 2003,.the Council of the City of Vernon adopted Resolution No. 8152, granting a variance to Owens Brockway Glass'Container, Inc. from the Zoning Ordinance for the Property; and WHEREAS, on December 3, 2007, the City Council of the City of Vernon adopted Resolution No. 9484 adopting the City Of Vernon General Plan and the various elements included therein (the "General Plan"); and WHEREAS, Owens -Brockway is requesting an amendment to its variance from the Zoning Ordinance, approved by Resolution No. 8152; and WHEREAS, Owens -Brockway intends to sell an approximate 2.89- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 acre portion of the Property, specifically a portion of Lot 30 (hereinafter referred to as the "Subject Property"), and proposes to construct a new building (warehouse) approximately 17,000 square feet in size which will require additional automobile parking spaces to be 1provided; and WHEREAS, due to the unique industrial nature of Owens- Brockway's operation, it meets the intent of the Zoning Ordinance by providing sufficient parking and loading for its actual need; and WHEREAS, the Property is used for manufacturing and warehousing of the manufactured product which is consistent with the Jobjectives of the General Plan and Zoning Ordinance; and WHEREAS, the lot that will be sold will comply with the City's parking and loading requirements, since all existing buildings will be demolished; however, the remaining Property not being sold will not comply; and WHEREAS, by selling the Subject Property, the remaining Property will be made less conforming; WHEREAS, Section 26.5.1-6 of the Zoning Ordinance specifies that adequate off-street parking and loading space shall be provided for each use, development or property, or for each building, to accommodate all automobiles or similar vehicles of the employees, consultants, agents, buyers, vendors, salesmen, visitors, and other persons normally transacting business at such enterprise or building; and WHEREAS, a particular area of the facility, Building A2, is used exclusively for housing equipment and operations and is not normally occupied by employees or stored product; and WHEREAS, under a strict application of the parking - 2 - 1 2 3 4 5 6 7 8 6012 10 11 12 13 14 15 16 17 18 19 20 21 PIPPA 23 24 25 26 27 28 requirement in 26.5.1-6, Owens -Brockway would need to provide an additional 116 automobile parking spaces; and WHEREAS, there is no physical area in which to place those additional spaces; and WHEREAS, in addition, Owens -Brockway was not able to locate any available parking on adjacent sites; and WHEREAS, another alternative would be to reduce the number of parking and loading spaces required by tearing down a building, which would cause,an unreasonable hardship to the applicant, since the actual need of Owens -Brockway is far less then the number of parking stalls that is being provided; and WHEREAS, Owens -Brockway has been operating on the site for over 80 years; and WHEREAS, this building has been used for manufacturing and warehousing of the manufactured product and it continues to be used for the same purpose; and WHEREAS, Owens -Brockway currently employs 80 people on day shift, 60 people on swing shift, and 60 people on graveyard shift; and WHEREAS, according to Owens -Brockway, the maximum number of employee vehicles at the site at one time is 78, which would occur during a shift change and if the variance were granted, Owens -Brockway would still be providing 200 parking spaces of which a maximum of 78-' would be used at any one time; and WHEREAS, since there is ample room to accommodate the employee parking, there will be no parking overflow onto adjacent side streets and the surrounding area; and WHEREAS, Owens -Brockway has advised the City that it has sufficient parking at 2923 Fruitland Avenue for its actual need and has - 3 - 2 3_ 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Irequested that its variance be amended to allow Owens -Brockway to provide parking spaces based on its actual need and not on the code required number; and WHEREAS, City Staff has determined, based on its observations, that Owens -Brockway currently has sufficient parking for its employees and visitors to the site; and _ WHEREAS, consequently, the existing use does not and will not adversely affect the interests of the public or vicinity of the premises; and WHEREAS, the purpose of the parking requirement is to accommodate all automobiles or similar vehicles of employees, consultants, agents, buyers, vendors, salesmen, visitors, and other persons normally transacting business at the enterprise or building; and WHEREAS, the rationale for excluding Building A2 from the calculation of the parking requirement is also consistent with the policy behind the parking requirement in Section 26.5.1-6, which is to accommodate the automobiles of those transacting business at the enterprise or building; and WHEREAS, the strict application of the off-street parking, access and loading requirements of the Zoning Ordinance at this time would cause an unreasonable hardship to the applicant; and WHEREAS, the City Council has received a Staff Report dated November 19, 2008, upon which it has relied in making the foregoing recitals; and WHEREAS, the Director of Community Services & Water has recommended that the City find that the Project is categorically exempt from the California Environmental Quality Act because it is an existing - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 facility pursuant to Section 15301 and a Notice of Exemption will be prepared and filed with the County Clerk; and WHEREAS, the City Council of the City of Vernon held a hearing on said variance amendment on December 1, 2008. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby finds that the proposed project is categorically exempt pursuant to Section 15301 of the California Environmental Quality Act and directs the City Clerk, or her designee, to file a Notice of Exemption in regard to the environmental impact of said project with the County Clerk of the County of Los Angeles. SECTION 3: A variance from Section 26.5.1-6, parking and loading of the Zoning Ordinance, specifying that adequate off-street parking and loading space shall be provided for each use, development or property, or for each building, to accommodate all automobiles or similar vehicles of the employees, consultants, agents, buyers, vendors, salesmen, visitors, and other persons normally transacting business at such enterprise or building, is hereby granted to Owens -Brockway located at 2923 Fruitland Avenue. SECTION 4: The variance granted is subject to the following conditions: a) The facility shall be operated in accordance with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a variance. - 5 - 1 2 3 4 5 6 7 8 9 10 11 RIVA 13 14 15 16 17 18 19 P111A 21 22 23 24 25 26 28 b) The applicant shall maintain the yard clean, free of debris, and prevent the off -site migration of debris. c) The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. 1d) This variance shall automatically expire at the time of any expansion (except that Owens -Brockway shall be permitted to add a structure not exceeding 17,000 square feet in size as shown on the approved site plan) or structural alteration of any building on the Property (for purposes of these conditions, the "Property" means that portion of the real property located at 2923 Fruitland Avenue that remains intact after the subject parcel is sold), or upon change of use or ownership, or if the covenant and agreement restricting the use of Building A2 is breached or terminated, whichever occurs first, at which time the occupancy of the structures shall be discontinued unless the site is brought into compliance with all applicable standards for parking, access and loading areas set forth in the Zoning Ordinance. e) Upon any change in use or ownership of all or a portion of the Property, the entire Property shall be made to conform to all truck and automobile parking requirements and all truck loading requirements, unless a new variance is requested and granted by the City Council. if) All parking and loading facilities shall be paved with a concrete or asphalt concrete paving and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street a concrete wall or landscape strip shall be installed and maintained to meet City standards. - 6 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 g) The project site shall be maintained substantially in compliance with the site plan submitted, as part of this variance application. h) All existing and future tenants shall be notified of these restrictions on the Property and a condition stating this shall be placed in all future leases. i) The second floor of Building A, known as Building A2, shall remain unoccupied by people with the exception of a conveyor line. No warehousing or manufacturing areas shall be maintained in this area. Owens -Brockway shall maintain a covenant restricting the occupancy of Building A2 to a conveyor line. j) Noncompliance with any of the conditions herein shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require Owens -Brockway to comply with the parking and loading requirements of the Zoning Ordinance. SECTION 5: The provisions of Resolution No. 8152 not consistent with or in conflict with this resolution are hereby repealed; in all other respects Resolution No. 8512 shall remain in full force and effect. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect. That this facility be granted consideration of its unique nature and historical use by accepting a site -specific parking requirement based on the ability to provide minimum yet ample and sufficient numbers of on -site parking stalls of city standard size and configuration as shown on the plan exhibit consistent with the maximum number of employees and anticipated guests. The nature of the 0-1 operations is equipment intensive and the numbers of operating personnel required to perform such operations require significantly less parking then that contemplated by the city's building area based parking ordinance. 2. That the required loading docks and designated truck parking for this facility be reduced to a site -specific as -needed basis, shown by the plan exhibit, to satisfy the actual demand of the 0-1 facility. 3. That an entitlement reservation for the proposed construction of a future warehouse of approximately +1-17,000 square feet be granted for this facility, to be constructed in the future and at the discretion of Owens -Brockway, as shown on the plan exhibit. The final size, specific location, and character of the construction, under this entitlement reservation, shall be subject to the permit requirements and applicable building codes at the time of permit application. 4. That the existing non -conforming conditions as relate to the letter of code, as they are not correctable by any practical means available to Owens -Brockway nor exacerbated by any prescription under this transaction, shall remain non- conforming yet acceptable for practical conformance with the intent of the code by those having jurisdiction for however long the operations exist and such accommodations are required therefore. (Applies to the no -build easement and the provision of the code that states such yard be unencumbered and clear to the sky). OWENS-BROCKWAY GLASS CONTAINER INC 2923 FRUITLAND AVENUE, CITY OF VERNON VARIANCE APPLICATION EXHIBIT B: Justifications 1 - Special circumstances exist regarding Item A of the application whereby the nature of the existing operations conducted at this facility do not demand continuous occupancy by operational, maintenance or repair personnel. Personnel are housed adequately elsewhere on the site, To apply a parking demand for areas housing essential equipment would impose hardship on the operation and limit its future growth. Parking in support of this operation based on use has been surveyed and parking as shown by the attached site plan is adequate for its current and future needs. 2. The parking demand imposed by strict application of the code would be restrictive in terms of the ability of the operator to use its land for future expanded operations. 3. The special condition subject of this variance is not imposed by the applicant but is more the nature of the manufacturing operations in which it is engaged. 4. The grant of variance would not bestow any special privileges on the applicant. The nature of the request pertains to a condition regarding equitable application of the intent of the zoning ordinance as to satisfying off-street parking demands within the bounds of any property. The applicant has demonstrated its ability to satisfy this intent. 5. The grant of variance should have no material impact regarding the general plan, All parking required under the intent of the applicable ordinance to support the specific parking demands of this facility will be adequately housed on site. OWENS-BROCKWAY GLASS CONTAINER INC 2923 FRUITLAND AVENUE, CITY OF VERNON VARIANCE APPLICATION EXHIBIT C: Lot Line Adjustment and Reservations 1 . Owen -Brockway shall submit a separate application for lot line adjustment as generally shown on the plan exhibit. The lot line adjustment will be applied for in accordance with current subdivision requirements, with the intent of positioning this parcel in proper form as to be disposed of separately and legally by Owens - Brockway. 2. Certain easement reservations as shown by the plan exhibit, for the purpose of maintaining building area justification under the building code; serving fire access requirements for the existing facilities located on the retained parcel; preserving in place certain existing electrical substations, existing electrical appurtenances, existing electrical distribution system and the like; and accommodating related access for the maintenance of said equipment, shall be applied to the subject parcel in favor of Owens -Brockway, its successors and assigns. These easement reservations shall remain in place over the subject parcel for however long such operations exist and whereby such easements are required therefore. I An all-weather surface shall be constructed by Owens -Brockway as required by the city's fire department to accommodate the fire access over the limits of the easement so reserved in favor of Owens -Brockway, its successor or assigns for however long such operations exist and whereby such easement is required therefore. 4. The existing building which occupies a portion of the subject area as shown by the plan shall be demolished and that the land there under shall be graded to the approximate level of the existing finish floor at the expense of the owner.
