RESOLUTION NO. 9786
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON RATIFYING THE DETERMINATION FOR EMPLOYER
PAID MEMBER CONTRIBUTIONS TO THE PUBLIC EMPLOYMENT
RETIREMENT SYSTEM
WHEREAS, the Public Employees' Retirement Law permits the
participation of public agencies and their employees in the Public
Employees' Retirement System (PERS) by the execution of a contract, and
sets forth the procedure by which public agencies may elect to subject
themselves and their employees to amendments to said Law; and
WHEREAS, the PERS Board of Administration and the City of
Vernon entered into a contracteffective November 1, 1948, and witnessed
October 23, 1948 (the "Contract"), which provides for participation of
the City of Vernon and its employees in the PERS, and have made various
amendments to the Contract since that time; and
WHEREAS, effective July 1, 1984, pursuant to Resolution No.
5120 adopted on June 28, 1984, the City Council of the City of Vernon
provided that the City of Vernon would make payment to the PERS to
satisfy the employees' obligation to make contribution to the PERS; and
WHEREAS, the City Council of the City of Vernon has the
authority to implement Government Code Section 20691; and
WHEREAS, the City Council of the City of Vernon has a policy
or agreement which specifically provides for the normal member
contributions to be paid by the employer; and
WHEREAS, one of the steps in the procedures to implement
Section 20691 is the adoption by the governing body of the City of
Vernon of a resolution to commence said Employer Paid Member
lContributions ("EPMC""); and
1 WHEREAS, the City Council of the City of Vernon -desires to
2 ratify its determination to commence EPMC effective July 1, 1984; and
3 WHEREAS, the City Council of the City of Vernon has
4 identified the following conditions for the purpose of its election to
5 pay EPMC:
6 (a) This benefit shall apply to all employees of Local
7 Fire Fighters (herein referred to as "Local Safety Members"), Local
8 Police Officers (herein referred to as "Local Safety Members"), Local
9 Prosecutors (included as Local Safety Members) and Employees other than
10 local safety members (herein referred to as "Local Miscellaneous
11 Members"); and
12 WHEREAS, the effective date of this Resolution shall be
13 July 1, 1984.
14 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
15 CITY OF VERNON AS FOLLOWS:
16 SECTION 1: The City Council of the City of Vernon does
17 hereby find and determine that the recitals contained hereinabove are
18 true and correct.
19 SECTION 2: The City Council of the City of Vernon hereby
20 ratifies its determination to commence and pay EPMC effective July 1,
21 1984.
22 SECTION 3: The City Council of the City of Vernon elects to
23 pay EPMC, as set forth above.

SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and thereafter
the same shall be in full force and effect.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 9786 REGARDING THE
DETERMINATION FOR EMPLOYER PAID MEMBER
CONTRIBUTIONS TO THE PUBLIC EMPLOYEES' RETIREMENT
SYSTEM (-EPMC RESOLUTION-), BY AMENDING THE
ELECTION CONDITIONS OF THE EPMC RESOLUTION
(AMENDMENT NO. 1)
WHEREAS, on December 15, 2008, the City Council of the City
of Vernon adopted Resolution No. 9786 to be effective on July 1, 1984,
providing for employer paid member contributions (EPMC) to the
California Public Employees' Retirement System; and
WHEREAS, the City Administrator has recommended that the
City continue paying the EPMC for those employees in the Vernon.Police
Officers Benefit Association bargaining unit; and
WHEREAS, the City Council of the City of Vernon desires to
identify new conditions for the purpose of its election to pay EPMC;
and
WHEREAS, the City Council of the City of Vernon has
identified the following conditions for the purpose of its election to
pay EPMC:
(a) This benefit shall apply to all Local Safety Employees
in the Vernon Police Officer Benefit Association bargaining unit; and
WHEREAS, the City Council of the City of Vernon wishes to
amend the EPMC Resolution to implement the aforementioned changes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF,VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained hereinabove
are true and correct.
SECTION 2: Effective March 1, 2010, the City Council of the
City of Vernon hereby amends the identified conditions for the purpose
of its election to pay EPMC to read as follows:
"The City Council of the City of Vernon has identified the
following conditions for the purpose of its election to pay EPMC:
(a) This benefit shall apply to all Local Safety
Employees in the Vernon Police Officer Benefit Association bargaining
unit."
SECTION 3: The provisions of Resolution No. 9786, not
consistent with or in conflict with this Resolution are hereby
repealed; in all other respects, Resolution No. 9786, shall remain in
full force and effect.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this Resolution, and
the City Clerk of the City of Vernon shall cause this Resolution and
the City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.
