RESOLUTION NO. 9793
A RESOLUTION OF THE CITY COUNCIL'OF THE CITY OF
VERNON AUTHORIZING THE.SALE OF SURPLUS PROPERTY
FROM THE FOLLOWING DEPARTMENTS: COMMUNITY SERVICES
& WATER, FIRE, LIGHT AND POWER AND TREASURY
PURSUANT TO SECTION 2.31 OF THE VERNON CITY CODE
AND AUTHORIZING THE DONATION OF SURPLUS PROPERTY
FROM THE LIGHT AND POWER DEPARTMENT
WHEREAS, pursuant to Vernon City Code Section 2.31 and
Government Code Section 37350, the City of Vernon may dispose of
surplus property for the common benefit; and
WHEREAS, the City Council of the City of Vernon desires to
declare the property from the following departments to be surplus to
the needs of the City of Vernon as said items are damaged, obsolete, or
in poor and irreparable condition and/or are no longer useful to the
needs of the City:
1. Community Services & Water Department, more particularly
described on Exhibit A which is attached hereto and incorporated by
reference;
2. Fire Department, more particularly described on Exhibit
B which is attached hereto and incorporated by reference;
3. Light and Power Department, more particularly
described on Exhibit C which is attached hereto and incorporated by
reference;
4. Treasury Department, more particularly described on
Exhibit D which is attached hereto and incorporated by reference; and
WHEREAS, the City Council of the City of Vernon
desires to donate the copier described in Exhibit C to the
Vernon Elementary School (the "School"); and

WHEREAS, the City Council of the City of Vernon has
determined that the donation of said surplus property to the School
will serve a public purpose by (i) promoting the general municipal
welfare; (ii) providing public beneficial effect; and (iii) being in
the best interests of the constituents of the City of Vernon; and
WHEREAS, the donated surplus property shall be on an "as is"
"where is" basis, without warranty of any kind; and
WHEREAS, the School accepts the donation with the
understanding that it will have to pay for the costs of repair and
maintenance; and
WHEREAS, it is in the best interests of the City of Vernon
that the property described in the above -referenced Exhibit A, B, C and
D be sold as surplus property pursuant to Section 2.31 of the Vernon
City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: In accordance with Government Code Section 37350
and Section 2.31 of the Vernon City Code, the City Council of the City
of Vernon hereby finds and determines that the property described in
the attached Exhibits A, B, C and D, is surplus to the needs of the
City of Vernon.
SECTION 3: The Purchasing Agent is hereby authorized to
contract with an auction company, to obtain bids or to make other
arrangements for the sale of the property described in said Exhibits
as surplus property pursuant to Section 2.31 of the Vernon City Code.

I SECTION 4: The City Council of the City of Vernon hereby
2 finds and determines that the donation of the property described in
3 the attached Exhibit C to the Vernon City Elementary School for the
4 educational needs of the children serves a public purpose.
5 SECTION 5: The City Council of the City of Vernon hereby
6 donates the property described in the attached Exhibit C to the School
7 on an "as is" "where is" basis without warranty of any kind and the
8 School accepts said donation on said basis with the understanding that
9 it will have to pay for the costs of repair and maintenance.
10 SECTION 6: The Purchasing Agent is hereby authorized to
11 donate said surplus property described in attached Exhibit C to the
12 Vernon City Elementary School.
13 SECTION 7: The City Council of the City of Vernon hereby
14 authorizes the City Administrator, or his designee, to execute any
15 documents necessary to complete the transfer of the donated property.
16 SECTION 8: The City Clerk of the City of Vernon shall
17 certify to the passage of this resolution, and thereupon and
18 thereafter the same shall be in full force and effect.
19 APPROVED AND ADOPTED this 15th day of December, 2008.
