Resolution No. 09803on 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9803 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ADOPTING AN AMENDED AND RESTATED RESOLUTION ESTABLISHING PERMIT FEES, CERTIFICATE OF OCCUPANCY FEES, INSPECTION FEES AND OTHER RELATED FEES PURSUANT TO SECTIONS 7.12(L), 24.4, 24.11, 24.16, 24.21, 24.26, 24.42, 26.6.2-2, 26.6.3-1, 28.9 AND 28.10 OF THE VERNON CITY CODE RELATING TO ZONING, BUILDING AND FIRE PREVENTION WITHIN THE CITY AND REPEALING ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT THEREWITH WHEREAS, Sections 7.12(L), 24.4, 24.11, 24.16, 24.21, 24.26, 24.42, 26.6.2-2, 26.6.3-1, 28.9 and 28.10 of the Vernon City Code provide for the establishment by resolution of permit fees for building, electrical, mechanical, plumbing, and fire; application fees for variances and conditional use permits; and filing fees for any map, lot line adjustment, or certificate of compliance; and WHEREAS, on February 21, 1984, the City Council of the City of Vernon adopted Resolution No. 5086 establishing fees for building, electrical, plumbing, heating, ventilating, cooling, refrigeration and fire prevention permits issued by the City and for special inspections, certificates of occupancy, temporary use of commercial coaches, conditional use permits and for review and approval of tentative parcell maps for division of property; and WHEREAS, on March 20, 1984, the City Council of the City of Vernon adopted Resolution No. 5097 establishing fees for variances; ands WHEREAS, on October 1, 1968, the City Council of the City of Vernon adopted Resolution No. 2985 establishing checking fee for map checking services for parcel maps; and WHEREAS, on December 17, 2007, the City Council of the City of Vernon adopted Ordinance No. 1139 adopting a Comprehensive Zoning 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Ordinance effective January 16, 2008; and WHEREAS, the fees established by the foregoing resolutions are inadequate to cover the current cost to process applications for conditional use permits, building code variances, lot merger and covenants, zoning variances, parcel maps, certificates of compliance �jand inspections ; and WHEREAS, on May 19, 2008, the City Council of the City of Vernon adopted Resolution No. 9605 establishing fees for building, electrical, plumbing, heating, ventilating, cooling, refrigeration and fire prevention permits issued by the City and for special inspections, certificates of occupancy, temporary use of commercial coaches, conditional use permits, variance and for review and approval of final parcel and tentative parcel maps for division of property; and WHEREAS, the State of California signed into law SB 1473 which requires each City to collect a fee from an applicant for a building permit to fund the creation of the Building Standards Administration Special Revolving Fund; and WHEREAS, City staff is requested to provide Zoning Verification letters, which are time consuming to prepare and the person requesting the Verification letter should fund the cost for the services rendered by City staff on its behalf; and WHEREAS, the Director of Community Services & Water has recommended that a permit fee be created to collect the Building Standard Administration Special Fund and create a new fee for Zoning Verification both to be effective January 5, 2009, and that the City Council of the City of Vernon adopt an amended and restated resolution to establish the new fee and reaffirm the remaining fee schedules; and WHEREAS, the amount of the proposed fees does not exceed the - 2 - 1 2 3' 4 5 6 7 8 9 10 11 12 13 14 15 16 17 or:A 19 20 21 22 23 24 25 26 27 reasonable cost of providing the services necessary for the activity for which the fees are charged; and WHEREAS, the proposed fees are not levied for unrelated revenue purposes; and WHEREAS, the City Council of the City of Vernon wishes to amend and restate Resolution No. 9605 to establish new fees as set (forth herein to be effective January 5, 2009; and WHEREAS, the City Council intends that this Resolution supersede and replace the Resolution No. 9605 adopted May 19, 2008, in its entirety. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby Ifinds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby establishes the permit fees for building, electrical, plumbing, heating, cooling, refrigeration, fire prevention permits, plan check fees and establishes a new fee for the Building Administration Special Fund as set forth in Table 1-A attached hereto as Exhibit A and incorporated by reference. The fees shall be collected by the Director of Business Services & Purchasing and deposited into the general fund of the City of Vernon. The fees collected will be for (i) plan check and inspection of private construction projects; (ii) any required fire protection hydraulic calculations that are required to be submitted for review or for plan check, or as a substantiation to an existing system; (iii) any required plan to be submitted for checking for compliance with the State of California rules and - 3 - 1 2 3 4 5 6 7 8 X 10 11 12 13 14 11� 16 17 18 19 20 21 22 23 24 25 26 27 28 regulations for energy insulation standards for residential buildings or nonresidential buildings; (iv) any building permit in conjunction with the energy insulation standards for residential buildings and for the energy conservation standards for nonresidential buildings; and (v) Strong -Motion Instrumentation Program of the State of California as set forth in Chapter 8 of Division 2 of the Public Resources Code. The Finance Director, or his designee, is hereby directed to remit the portion of the fees allocable for the Strong -Motion Instrumentation Program to the State of California in accordance with said Chapter; and (vi) the Building Standards Administration Special Revolving Fund Fee collected as set forth in the State of California Health and Safety Code Section 18931.6 and shall be forwarded by the Finance Director, or his designee, for distribution to the State of California. SECTION 3: The City Council of the City of Vernon hereby establishes occupancy fees as set forth in Table 2-A attached hereto as Exhibit B and incorporated by reference. The fees shall be collected by the Director of Business Services & Purchasing and deposited into the general fund of the City of Vernon. The fees collected will be for special inspections if required or requested to determine compliance with the provisions of the ordinances of the City of Vernon for a proposed use or occupancy or for a Certificate of Occupancy as required under Appendix Chapter 1 Section 110.1 of the California Building Code, latest edition. This inspection fee is in addition to any permit fees that may be applicable for work required to comply with City ordinances or resolutions. - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 SECTION 4: The City Council of the City of Vernon hereby lestablishes inspection fees and other related fees, the permit fees for (maps; conditional use permits, zoning variances, building code (variances, covenant and lot merger review fees, certificate of compliance fees, and special inspections and creates a new Zoning Verification Fee as set forth in Table 3-A attached hereto as Exhibit C and incorporated by reference. The fees shall be collected by the Director of Business Services & Purchasing and deposited into the general fund of the City of Vernon. The fees collected will be for (i) temporary use of a commercial coach (electrical, mechanical and plumbing permit fees for said coach, when applicable, shall be in additional to and in accordance with Table 1-A); (ii) parcel map, tentative map, lot line adjustment or a certificate of compliance plus any County Clerk fixing fees and Fish and Gable Section 711.4 fees; (iii) conditional use permits plus the cost to retain a consultant to prepare the environmental document for the project, plus any County Clerk filing fees and Fish and Game Section 713 fees; (iv) zoning variance and building code variance; (v) covenant and lot merger review; (vi) certificate of compliance fee; (vii) map checking; and (viii) Zoning Verification. SECTION 5: A fee shall not be required for the issuance of a permit to perform work in a structure designed and used exclusively as an emergency fallout shelter. SECTION 6: In addition to the foregoing, the applicant or permittee shall pay all other necessary fees or deposits which may be required by other ordinances or resolutions of the City of Vernon or applicable State law. - 5 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 SECTION 7: The fees provided for herein shall be effective January 5, 2009, and all resolutions, or parts of resolutions, not consistent with or in conflict with this Resolution, including specifically Resolution No. 9605, are hereby repealed. SECTION 8: The City Clerk of the City of Vernon shall certify to the passage of this resolution, and thereupon and thereafter the same shall be in full force and effect.
