WASH RACK, INC. FOR THE OPERATION OF A TRUCK WASH FACILITY LOCATED AT 4317 DOWNEY ROAD IN THE CITY OF VERNON WHEREAS, L.A. Wash Rack, Inc. ("L.A. Wash") has applied for a conditional use permit to operate a truck facility at 4317 Downey Road; and WHEREAS, the City Council of the City of Vernon held a (hearing on said application for a conditional use permit on January 12, 2009; and WHEREAS, L.A. Wash is proposing to expand its use by constructing a new tanker maintenance building and a new 3-bay tanker wash facility; and WHEREAS, the proposed site is located in the Slaughtering Overlay of the I -Zone, Industrial, and given the nature of L.A. Wash's business operation, it would be classified as a Truck Wash Facility and allowed with approval of a conditional use permit; and WHEREAS, the proposed site is adequate in size, shape and topography for the proposed operation, and has adequate parking, loading facilities, and drainage; and WHEREAS, the proposed site is surrounded by industrial and warehousing uses compatible with the proposed use and adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is not anticipated from the proposed operation; and WHEREAS, the project is categorically exempt from the 1 California Environmental Quality Act (CEQA) under Class 32, In -fill 2 Development, and City staff have recommended that a Notice of Exemption 3 be filed with the County Clerk pursuant to Section 15332 of the 4- California Environmental Quality Act Guidelines; and 5 WHEREAS, the site has adequate on -site parking and loading 6 facilities in accordance with the Zoning Ordinance; and 7 WHEREAS, City staff has determined that the proposed site and 8 development of the property is consistent with the applicable 9 development standards, and therefore, all parking activities will be 10 maintained on -site within the premises and will supply adequate parking 11 and loading on -site for the proposed development; and 12 WHEREAS, the site has access to Vernon Avenue, a collector 13 roadway with a proposed right-of-way of 60 feet and to Downey Road, an 14 arterial roadway with a right-of-way of 60 feet; and 15 WHEREAS, the streets and highways surrounding the proposed 16 use are adequate in width and are improved as necessary to carry the 17 traffic expected by this proposed operation; and 18 WHEREAS, the proposed use as to location, operation, and 19 design is consistent with the General Plan and the Zoning Ordinance of 20 the City of Vernon; and 21 WHEREAS, the conditions imposed in the conditional use permit 22 will adequately protect the public health, safety and general welfare 23 and the operation is consistent with all applicable rules and laws of 24 the City of Vernon; and 25 WHEREAS, the City Council has received a Staff Report dated 26 January 7, 2009, upon which it has relied on making the foregoing 27 recitals. 28 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE - 2 - 1 CITY OF VERNON AS FOLLOWS: 1 2 SECTION 1: The City Council of the City of Vernon 3 hereby finds and determines that the recitals contained hereinabove 4 are true and correct. 5 SECTION 2: The City Council of the City of Vernon hereby 6 finds and determines that the proposed project is exempt from CEQA and \7 hereby directs the City Clerk, or her designee, to file a Notice of 8 Exemption with the County Clerk of the County of Los Angeles. 9 SECTION 3: Subject to the conditions set forth below, the 10 conditional use permit is hereby granted to L.A. Wash for the operation 11 of a truck wash use located at 4317 Downey Road in the City of Vernon. 12 SECTION 4: In order to adequately protect the public health 13 and general welfare the following conditions are required: 14 a. The facility shall be operated in accordance with, and 15 made'to conform with all current codes, rules, and 16 regulations and subject to permit fees and taxes as 17 adopted by the City of Vernon. 18 b. All required federal, state, local and regulatory 19 agency permits shall be obtained prior to operation 20 and shall be operated in compliance with all federal, 21 state and local regulations. Prior to occupancy a 22 business license and occupancy permit shall be 23 obtained. 24 C. Any hazardous substances used, handled or stored shall 25 have prior approval from the Vernon Fire and Health 26 Departments. A Health Permit shall be obtained from 27 the Health Department if there are reportable 28 quantities of hazardous materials on the site. - 3 - 1 d. No engine repair or any other type of vehicle repair 2 shall be performed on the site. L.A. Wash shall be 3 limited only to the interior or exterior repair of the 4 tank portion of a tanker trailer. No inoperative 5 vehicles shall be stored on -site. All vehicles 6 operated at the facility shall be tuned and maintained 7 in accordance with applicable emission standards. 8 e. The facility shall be operated in a manner, which will 9 not impede traffic on Vernon Avenue or Downey Road. 10 All vehicles shall enter and exit the site in a front 11 forward manner. No vehicle parking or staging 12 associated with the facility shall take place on any 13 public street within Vernon. 14 f. Adequate written plans and materials shall be 15 maintained for cleaning up of leaks or spills of 16 substances associated with L.A. Wash operation. Upon 17 notification by the City of a spill associated with 18 L.A. Wash operation, it shall immediately clean up the 19 spill to the City's satisfaction. 20 g. The project site shall be constructed and maintained 21 substantially in compliance with the site plans 22 submitted as part of this conditional use permit 23 application. 24 h. All on -site construction or improvements shall be in 25 compliance with the most current Building Codes 26 (Building, Fire, Mechanical, Plumbing and Electrical) 27 and current Health and Safety Codes and Regulations. 28 L.A. Wash shall obtain all necessary building, fire, - 4 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department in addition to any required Vernon Environmental Health Department clearance prior to commencement of construction. i. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. j. All parking and loading areas shall be striped in a manner acceptable to the Director of Community Services & Water and shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Severely damaged pavement shall be replaced upon City's request. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on -site parking and loading shall be maintained so that on -street parking or staging will not occur. k. All facility buildings shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. The site shall maintain adequate drainage to eliminate potential mosquito harborage. - 5 - 1 1. The facility shall be operated in a manner that will 2 prevent unsanitary conditions, odors or other 3 nuisances.. 4 M. In accordance with National Pollutant Discharge 5 Elimination System permit regulations, L.A. Wash shall 6 submit a Notice of Intent to the State Water Resources 7 Control Board and shall prepare a prevention plan and 8 monitoring program within the Board's time 9 limitations. The facility shall be designed, 10 constructed and operated in a manner which prevents 11 non stormwater runoff to either the storm drain/sewer 12 system. All stormwater shall be treated in accordance 13 with NPDES requirements prior to being discharged to 14 the public storm drain system. 15 n. Adequate restroom facilities shall be provided for all 16 uses as approved by the Vernon Health Department. 17 0. No tankers or trucks shall be permanently staged at i 18 the site. Only those tankers that are scheduled for 19 washing or repair within a 4-hour period shall be 20 stored at the site. A maximum of 60 trucks shall be 21 permitted to enter this site per day. 22 P. L.A. Wash shall provide the City a 5 foot overhead 23 power line easement along the western property line. 24 In addition, a minimum of 10 foot clearance must be 25 maintained during the construction of the New Tanker 26 Maintenance Building and the lowest City of Vernon 27 power line conductor located along the west line of 28 the property. - 6 - 1 SECTION 5: Noncompliance with any condition set forth in 2 the conditional use permit shall be grounds for voiding the permit 3 pursuant to Section 26.6.3-9 of the Comprehensive Zoning Ordinance. 4 SECTION 6: L.A. Wash and any successors in interest shall 5 indemnify, hold harmless, and defend the City of Vernon, its officers, 6 agents, and employees from and against any and all claims, complaints, 7 or petitions for: (1) damages, losses, expanses resulting from bodily 8 injury, sickness, disease, disability or death arising from the 9 operation of the facility excluding therefrom any such claim resulting 10 from the gross negligence or intentional wrongdoing of the City of 11 Vernon, its officers, agents or employees; (2) a peremptory writ or 12 other relief by way of injunction,'mandamus, or administrative 13 mandamus; or (3) legal expenses and attorney's fees incurred by the 14 City of Vernon on behalf of any party in such actions or proceedings. 15 The City of Vernon does not waive its right to participate in the 16 defense of any such action. 17 SECTION 7: Not later than sixty (60) days from the date of 18 this Resolution, L.A. WASH RACK, INC CONDITIONAL USE PERMIT FOR THE OPERATION OF A TRUCK WASH AT 4317 DOWNEY ROAD January 7, 2009 L.A. Wash Rack, Inc ("L.A. Wash") has submitted an application for a conditional use permit to expand its operation by constructing a new tanker maintenance building, a new 3-bay tanker truck wash located at 4317 Downey Road. The proposed expansion will consist of a New Food Grade Tanker Wash Facility for sanitary washing of food grade tankers, and also a Maintenance Facility for light repairs to tankers trailer. The facility will operate 24 hours, 6 days a week. On Sundays, the facility will be closed from 2:00 a.m. to 5:00 a.m. 1. GENERAL PLAN The proposed use is consistent with the Zoning Ordinance and General Plan. The site is located in the Slaughtering Overlay of the (I) Zone, General Industrial. L.A. Wash is considered a Truck Wash Facility. A Truck Wash Facility use is not specifically permitted and is not specifically prohibited and therefore a conditional use permit is required. 2. SITE The total property area of the proposed project is approximately 3.05 acres in size. The applicant proposes to construct and operate a tanker maintenance bay approximately 8,800 square feet, ascetic/sanitary tanker wash approximately 5,420 square feet, and equipment pad approximately 990 square feet, which will be covered by a canopy. All new facilities will be situated on the same property. L.A. Wash has proposed to pave the site with an impermeable surface that meets City of Vernon standards. The truck wash facility will be supported by twenty-five (25) automobile parking stalls, eighteen (18) truck parking spaces and three (3) truck loading spaces. City staff has determined that the proposed site and development of the property is consistent with the applicable development standards. Therefore, it is anticipated all parking and loading activities will be maintained on -site within the premises and that an adequate supply of parking and loading on -site will be provided creating no impact to neighboring properties. The site plans for the proposed operation indicate that the site is adequate in size, shape, topography, including drainage and landscaping. 3. ADVERSE EFFECT The proposed site is surrounded by industrial, commercial and warehousing uses that are compatible with the proposed use. The project is categorical exempt under Section 15332, Class 32, In -fill Development, of the California Environmental Quality Act Guidelines ("CEQA"). Therefore, a Notice of Exemption will be filed with the County Clerks office. 4. ACCESS The proposed site has one driveway on Vernon Avenue located on the north side of the site and one driveway on Downey Road located on the east side of the site, which provide ingress and egress from both Vernon Avenue and Downey Road. The proposed site has sufficient access to streets and highways surrounding the proposed use, and is adequate in width and is improved as necessary to carry the traffic expected by this proposed use. The subject site is served by Vernon Avenue, a collector roadway with a proposed right-of-way of 60 feet and Downey Road, an arterial roadway with a right-of- way of 60 feet. 2 5. VEHICLE MOVEMENTS Approximately 40 to 60 vehicles will enter the premises during a typical 24-hour period to be washed or heated. The number of personal vehicle trips will be 11 per day spread over 3 shifts. Vehicles traveling to the site will generally exit the I-710 and travel westbound on Bandim Boulevard to Downey Road, then southbound on Downey Road to Vernon Avenue to the site. Vehicles exiting the site will utilize the same streets in the opposite direction. The facility will operate 24 hours, 6 days a week. On Sundays, the facility will be closed from 2:00 a.m. to 5:00 a.m. L.A. Wash anticipates 4 to 6 trucks being washed/serviced during the peak hours. Due to the fact that L.A. Wash is limited to an increase of 25% of wastewater discharge, this will limit the amount of trucks that would be serviced. Currently, L.A. Wash expects a small increase in discharge from the new facility, about 10 GPM. Based on the projected vehicular volume from the facility, a significant traffic impact will not be created. Therefore, the proposed use will not cause a significant traffic impact to neighboring properties or businesses. 6. OPERATIONS the existing facility will continue to operate as before and will not be any different from the new facility, except that the new truck wash facility will be located in an enclosed structure. All tankers will be inspected to ensure that they are authorized to haul food grade product, pass external inspection, make sure that the tankers have less than 5 gallons of material inside to be washed. Some hazardous chemicals that are used, such as 50% caustic, bleach, and sulfuric acid, throughout the cleaning process. A heating and hot water process is used to remove the product from inside the tank. All of the waste drains to various clarifiers and solids that are filtered out are removed offsite to appropriate disposal facilities. All waste that goes to the sewer system is within the limits outlined by the LA County Sanitation District. The proposed expansion will consist of a New Food Grade Tanker Wash Facility (approx. 5,420 sq. ft.) for sanitary washing of food grade tankers, and also a Maintenance Facility (approx. 8,800 sq. ft.) for maintaining the tankers trailers (not the motor truck or tractor). LA Wash has been in operation since 1984. Continuing market success has led to a need to expand their operation to meet customer demand. The truck wash operation started as a tanker washing service, which they also heated the product within the tanker so it can become viscous for delivery and this was provided for several companies in Vernon such as Continental commodities, Sugar Products, Coast Packing Company, Baker Commodities, Darling, Ralph's, Lubricating Specialty, Norfox, and more. L.A. Wash grew as other industries in Vernon started taking advantage of having a truck wash facility, and other transporters were attracted to the convenience of having a nearby delivery and pickup destination. The facility will operate 24 hours, 6 days a week. On Sundays, the facility will be closed from 2:00 a.m. to,,5:00 a.m. There will be three (3) shifts with a total of eleven (11) employees during a typical 24-hour period (Graveyard Shift — 1 employee, Night Shift — 4 employees, Day Shift — 6 employees). As previously mentioned, the proposed tanker wash bay will provide a tanker wash in sanitary conditions that specifically addresses the concerns for food -grade tankers. The new sanitary food -grade tanker wash will provide the ability to wash down the inside of three tankers at one time. The proposed tanker maintenance bay will provide repair services including: • Tanker trailer lighting repairs. • Tanker vessel repair. • Tanker safety appliance and appendage repair (splash dome, ladder, piping, etc). • Insulative skin repair (no asbestos). • No diesel engine or tractor repairs will be performed. Any maintenance performed to the tanker trailer will prompt a tanker wash. If during the safety check there are any obvious signs of damage to the tanker trailer or if the driver reports that there is damage to the tanker trailer, then the driver has the option to have repairs made onsite. Trucks arrive at the site and the driver will present the last two bills of lading of material transported. The reason for this is to ensure that the tanker has been used to haul food grade products only; otherwise, they are not authorized for food product transportation. After an external inspection, the tanker is drained of any small amount of fluid. The drained fluid is stored for proper disposal. A 30-60 second hot water rinse is used to remove any remaining residuals. The effluent from the hot water rinse is directed to a waste clarifying system. Next, a sanitary wash is preformed utilizing a sanitizing solution. The sanitizing solution is discharged into a stainless steel piping system via gravity from the wash bay to a sanitizing solution recirculating tank within the equipment pit. This allows the cleaning solution to be utilized up to 6-8 washes before requiring replacement. Next, the hose that directs the sanitizing solution to the pit is removed; another hot water rinse is preformed and the soap residue is drained to the clarifier. Afterwards, the discharge hose is reconnected to the tanker and another 160-180 degree sanitary flush of hot water is performed. The flush is for a specific amount of time (5, 7, 10, or 12 minutes), per customer specification. The effluent drains to a hot water recirculating tank for future rinses. A recording chart or readout will be attached to the washout ticket, which will be presented to a loading facility as verification of sanitary wash. Next, the truck is inspected internally. It is then air dried and cooled, and a tank seal may be applied as requested by transporter. The Tanker Repair operation will consist of an initial inspection of the tanker, any leaks or other mechanical damage that is found is noted immediately. L.A. Wash has stated that they will be accepting off the street tankers, only if the repairs are to the tanker trailer. If the repair is external, the tanker is repaired and then washed. If the problem is internal, the tanker is washed first, then repaired, then washed again. If the owner of the tanker does not want it repaired, they will not be turned down for a washing service so long as it does not interfere with washing operations. It is the driver's responsibility to ensure that they are operating a safe functional vehicle. Generally, the tankers leave on the same day it is brought in to be washed, however, the operation is open 24 hours and the process usually takes 1-6 hours. No trucks or tankers will be permanently staged at the site. It can take 6-8 hours to clean a tank if the tanker has severe coating issues, such as having latex inside which needs scraping. Any internal scraping will be within a confined space, and LA Wash utilizes specially trained people certified to work in these environments. The facility will be open to tank truck companies and local businesses that have a need to wash their tank trucks. 3 As previously mentioned L.A. Wash provides services for the cleaning and washing of tankers, both inside and outside. L.A. Wash does not manufacture any industrial or food products of any type. L.A. Wash Rack's Industrial Waste Permit with the Sanitation District of Los Angeles was approved only for the sewer disposal of wastewater generated from washing the inside of tanker trucks which have most recently transported non- hazardous materials and low-grade food, washing the outside of vehicles, and limited amounts of rainwater. 7. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. 8. CONDITIONS It is recommended that the following conditions be set on the permit to adequately protect the public health, safety and general welfare: a. The facility shall be operated in accordance with, and made to conform with all current codes, rules, and regulations and subject to permit fees and taxes as adopted by the City of Vernon. b. All required federal, state, local and regulatory agency permits shall be obtained prior to operation and shall be operated in compliance with all federal, state and local regulations. Prior to occupancy a business license and occupancy permit shall be obtained. C. Any hazardous substances used, handled or stored shall have prior approval from the Vernon Fire and Health Departments. A Health Permit shall be obtained from the Health Department if there are reportable quantities of hazardous materials on the site. d. No engine repair or any other type of vehicle repair shall be performed on the site. L.A. Wash shall be limited only to the interior or exterior repair of the tank portion of a tanker trailer. No inoperative vehicles shall be stored on -site. All vehicles operated at the facility shall be tuned and maintained in accordance with applicable emission standards. e. The facility shall be operated in a manner, which will not impede traffic on Vernon Avenue or Downey Road. All vehicles shall enter and exit the site in a front forward manner. No vehicle parking or staging associated with the facility shall take place on any public street within Vernon. f. Adequate written plans and materials shall be maintained for cleaning up of leaks or spills of substances associated with L.A. Wash operation. Upon notification by the City of a spill associated with L.A. Wash operation, it shall immediately clean up the spill to the City' satisfaction. g. The project site shall be constructed and maintained substantially in compliance with the site plans submitted as part of this conditional use permit application. h. All on -site construction or improvements shall be in compliance with the most current Building Codes (Building, Fire, Mechanical, Plumbing and Electrical) and current Health and Safety Codes and Regulations. L.A. Wash shall obtain all necessary building, fire, mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department in addition to any required 0 Vernon Environmental Health Department clearance prior to commencement of construction. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed 65db or vibration exceeds four hundredths of an inch per second particle velocity when measured at the property line. j. All parking and loading areas shall be striped in a manner acceptable to the Director of Community Services & Water and shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Severely damaged pavement shall be replaced upon City's request. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on -site parking and loading shall be maintained so that on -street parking or staging will not occur. k. All facility buildings shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. The site shall maintain adequate drainage to eliminate potential mosquito harborage. 1. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. M. In accordance with National Pollutant Discharge Elimination System permit regulations, L.A. The project site is located at the southwest corner of the intersection at Downey Road and Vernon Avenue. It is within one -quarter of a mile from the Los Angeles River Channel Basin. The zoning area is for industrial with a slaughter overlay district. The site is 3.05 acres and 2.69 acres have been developed. The developed portion is 100% impervious and rain water drains offsite, down the driveway, and into the streets. There are multiple structures on this site, including an existing truck wash, mechanical equipment, office and lounge, a change and shower room, and a corrugated metal shack. The remaining portion (proposed development area) is dirt with no structures, except a chain link fence located along the property line, and no vegetation. Rainwater for this area mostly drains south to cross the property line and infiltrate into the soil at the railroad lot. Because the undeveloped portion is dirt, some of the rainwater must infiltrate into the soil. There are no signs of animal life except birds and insects indigenous to the area. 29. See above. The north side of the property is adjacent to Vernon Avenue. The east side of the property is adjacent to Downey Road. The west side of the property is adjacent to a city of Vernon owned lot, which appears to be 100% impervious with one single -story office building and a large tank. The south side of the property is adjacent to a L.A. Junction Railroad Company owned lot which has a track that runs parallel to the property line. L.A. Wash Rack, Inc. Vernon, California Operation Report: Operating Hours Hours of operation shall be 24 hours, 6 days a week. On Sunday, the facility shall be closed from 2:00 a.m. to 5:00 a.m. Shift and Employees There shall be three shift operations with a total of eleven (11) employees. Graveyard Shift — 1 employee Night Shift — 4 employees Day Shift — 6 employees Proiect Description As you are aware, the food manufacturing industry is a major facet of the City of Vernon community. The proposed tanker wash bay will provide an invaluable service to the surrounding community in that it will be the closest facility to provide a tanker wash in sanitary conditions that specifically addresses the concerns for food -grade tankers. As fuel costs increase, the food manufacturing industry has to seek the nearest sanitary food -grade tanker wash. Our proposed tanker wash will direct business to Vernon and away from Orange County, the nearest location that provides this service, thereby reducing back and forth traffic congestion and pollution. The proposed tanker maintenance bay will also provide the City of Vernon the same benefits that the proposed tanker wash will. The new maintenance bay will not be used to modify, repair, or service the truck tractors, or their engines. Only the tankers will be serviced. These are the repair services that will be provided to the tankers: • Tanker trailer lighting repairs • Tanker vessel repair • Tanker safety appliance and appendage (splash dome, ladder, piping, etc • Insulative skin repair (no asbestos) Any maintenance performed to the tanker trailer will prompt a tanker wash. I feel that it is safer and more cost effective`to allow for a tanker wash and maintenance bay to be located within the same location. This prevents the driver from operating a potentially dangerous or faulty tanker trailer to an offsite maintenance facility offsite and return for a tanker wash, since maintenance on the tanker trailer will prompt a wash. The proposed expansion will consist of a New Food Grade Tanker Wash Facility for sanitary washing of food grade tankers, and also a Maintenance Facility for maintaining the tankers trailers (not the motor truck or tractor). Rieder Enterprises acquired a strip of land on behalf of LA Wash on September 2000 for the sole purpose of expanding the washing facility. LA Wash has been in operation since 1984. The truck wash started as a tanker washing service for several companies in Vernon such as Continental commodities, sugar products, Coast Packing Company, Baker Commodities, Darling, Ralphs, Lubricating Specialty, Norfox, and more. The company grew as other industries in Vernon started taking advantage of having a truck wash facility, and other transporters were attracted to the convenience of having a nearby delivery and pickup destination. Site Information This information is on the site plan. The existing office building is 2,115sf. The existing wash bay building is 6,150sf. The proposed wash bay will be 4,545sf. The proposed support facilities (part of the new wash bay building) will be 787sf. The new maintenance building will be 8,800sf, 1,725sf of which will be used for office and storage. The canopy covered equipment pit will be 990 sf. The new expansion will improve business and keep it in Vernon. LA Wash anticipates that some of the rules and regulations currently adopted independently by certain food manufacturing companies (such as many businesses in Vernon) will be implemented nationally by the FDA and USDA. These regulations have stringent requirements for sanitary food grade tanker washes. The proposed wash facility will meet these requirements and ensure that business will flow smoothly. The new maintenance facility will maintain the TANKERS ONLY. No maintenance will be done to the truck tractors or their engines, etc. Washing Process Truck arrives and the driver presents the last two bills of lading of material transport. The reason for this is to ensure that the tank has been used to haul food grade products only; otherwise, they are not authorized for food product transportation. After an external inspection, we drain any small amount of fluid from the tanker, which is stored for proper disposal. A 30-60 second hot water rinse is used to remove any remaining residuals. The affluent from the hot water rinse is directed to our waste clarifying system. Next, a sanitary wash is preformed utilizing a sanitizing solution. The sanitizing solution drains through stainless steel piping via gravity from the wash bay to a sanitizing solution recirculating tank within the equipment pit, which allows for an additional 6-8 washes before replacing the solution. Next, the hose that directs the sanitizing solution to the pit is removed; this allows for another hot water rinse that removes soap residue to drain to the clarifier. Afterwards, the discharge hose is connected to another stainless steel pipe to allow for another 160-180 degree sanitary flush of hot water, run for a specific amount of time (5, 7, 10, or 12 minutes), per customer specification, which drains to a hot water recirculating tank for future rinses. A recording chart or readout will be attached to the washout ticket, which will be presented to a loading facility as verification of sanitary wash. Next, the truck is inspected internally. It is then air dried and cooled, and a tank seal may be applied as requested by transporter. Tanker Repair Process During inspection, any leaks or other mechanical errors that are found are noted. If the repair is external, the tanker is repaired and then washed. If the problem is internal, the tanker is washed first, then repaired, then washed again. This keeps the truck on the site so that the driver does not have to utilize a tanker wash and then drive somewhere else for the tanker repair, and then return for another tanker wash. Generally, the tankers leave on the same day, however, the operation is open 24 hours and the process usually takes 1-6 hours. It can take 6-8 hours if the tanker has severe coating issues, such as having latex inside which needs scraping. Any internal scraping will be within a confined space, and LA Wash utilizes specially trained people certified to work in these environments. The facility is open to tank truck companies and local businesses that have a need to wash their tank trucks. As previously mentioned L.A. The following screening procedures assist L.A. Wash operators to determine acceptable trucks for cleaning. Evaluation Procedure After the arrival of the tanker at L.A. Wash Rack, Inc's facility, designated trained personnel are required to follow this procedure prior to initiating washout. 1. Request for review the most recent Bill of Lading from the transporter. If a Bill of Lading is not available, the tanker cannot be accepted for washing. 2. Make a copy of the Bill of Lading, and return the original to the transporter. 3. If the product is a food product or byproduct then the tanker is acceptable for washing. The driver shall complete the L.A. Wash Rack, Inc. invoice, and record the exact product description on the invoice as shown on the Bill of Lading. Record the date, time, transport company, tractor number, and again the exact description of the product in the log book. Begin the process to appropriately wash the inside of the tanker. See attachment for wash cycle information. 4. If the product is described in the Bill of Lading is not a food product or byproduct, continue with items 5 through 11 as noted below. 5. Obtain the name of the transport company from the Material Safety Data Sheet (MSDS) reference binder. If the transport company is listed, proceed to item 6. If the company is not listed, continue to item 7. 6. Within the reference binder below the company's name, products having MSDS's on file are listed. Compare the product indicated on the Bill of Lading with those in the product column. If an identical product description is found, refer to the corresponding left column to determine if the tanker is acceptable to wash. A "Yes" indicates the tanker is acceptable to wash, and you can go to item 12 to finish this procedure. A "No" means the tanker is not acceptable for wash. If no match is found, proceed to item 7. 7. Ask the transporter for a copy of the MSDS for the material indicated on the Bill of Lading. If they have a MSDS, compare the product description on the Bill of Lading with that appearing on the MSDS to make sure they are the same. If the products do not match or the transporter does not have one at hand, contact the chemical manufacturer and request a copy of the product indicated on the Bill of Lading. R. If a MSDS cannot be obtained, reject the tanker for wash; 9. Once a MSDS has been received, it is checked for the Flash Point (FP) under the section entitled "Fire and Explosion Information". If the product's FP is less than 140 degrees Fahrenheit, the tanker is not acceptable for washing. Proceed to item 11. If the FP is greater than 140 F, then proceed to item 10. 10. Check for chemicals listed in the section of the MSDS usually entitled Hazardous Ingredients. If the product contains chemicals referenced in the attached "List of Toxic Organics Comprising Total Toxic Organics (TTO)", then the truck is not acceptable for wash. If the chemicals on the MSDS do not match those on the attached list, the tanker is acceptable for wash out. 11. Note the transport company's name at the top of the MSDS and place the MSDS behind the transporter's summary sheet in the reference binder described in item 5. 12. Complete the L.A. Wash Rack, Inc. invoice and record the exact product description on the invoice as shown on the Bill of Lading. Record the date, time, transport company, tractor number, trailer number, and again the exact description of the product in the log book. Begin the process to approximately wash the inside of the tanker. See attachment for wash cycle information. L.A. WASH RACK, INC., FOR THE OPERATION OF A TRUCK WASH FACILITY LOCATED AT 4317 DOWNEY ROAD WHEREAS, L.A. Wash Rack, Inc. ("L.A. Wash Rack") is requesting a modification to a condition of approval to its existing conditional use permit ("CUP") that was approved on January 26, 2009, for the operation of a truck wash facility located at 4317 Downey Road ("Project"),pursuant to Resolution No. 9824; and WHEREAS, the City Council of the City of Vernon held a hearing on this requested modification to a condition of approval to the CUP on April 5, 2011; and WHEREAS, the proposed site is located in the Slaughtering Overlay of the I -Zone, Industrial, and given the nature of L.A. Wash Rack's business operation, it would be classified as a Truck Wash Facility and allowed with approval of a conditional use permit; and WHEREAS, City staff has determined that the proposed modification will not result in any significant environmental changes to L.A. Wash Rack's operation, therefore, the original notice of exemption is in accordance with the California Environmental Quality Act ("CEQA") as provided inSection15332, Class 32, In -fill Development, and is adequate for this modification; and WHEREAS, the City Council has received a Staff Report, dated March 23, 2,011 upon which it has relied in making the foregoing recitals; and WHEREAS, L.A. Wash Rack proposes to expand its use by constructing a new tanker maintenance building and a new 3-bay tanker wash facility; and WHEREAS, the size, shape and topography of the parcel is adequate for the proposed operation; and WHEREAS, the proposed site is surrounded by industrial and warehousing uses compatible with the proposed use and adverse effects from traffic, parking, noise, odors, dust, smoke, light or glare, or risk of fire, infection or explosion is not anticipated from the proposed operation; and WHEREAS, the conditions imposed on the CUP will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon further finds that all persons have had the opportunity to be heard on to file written comments to the proposed Project and after due consideration of all the evidence submitted at the public hearing determines that there are compelling reasons to justify granting a modification to the CUP. SECTION 3: The City Council of the City of Vernon hereby finds that the Project is categorically exempt from the California Environmental Quality Act ("CEQA") as provided in Section 15332, Class 32, In -fill Development, as the proposed modification will not result in any significant environmental changes to L.A. Wash Rack's current 2 operation. The City Council of the City of Vernon directs the City Clerk, or the City Clerk's designee, to file a Notice of Exemption in compliance with the CEQA. SECTION 4: The custodian of records for the Project and all other material that constitute the record of proceedings upon which the City Council's decision is based is the City Clerk of the City of Vernon. Those documents are available for public review in the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon, California 90058. SECTION 5: In order to adequately protect the public health and general welfare, the conditions contained in Resolution No. 9824 shall be required except that condition "o" shall be modified to read as follows: o. No tankers or trucks shall be permanently staged at the site. Only those tankers that are scheduled for washing or repairing within a 7 day period shall be permitted to be stored at the site. A maximum of 60 trucks shall be permitted to enter this site per day. SECTION 6: The Applicant and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or 3 proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 7: Noncompliance with any condition set forth in the CUP shall be grounds for voiding the permit pursuant to Section 26.6.3-9 of the Comprehensive Zoning Ordinance. SECTION 8: Not later than sixty (60) days from the date of this Resolution, the applicant shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 5 of this Resolution and the indemnification provision contained in Section 6 of the Resolution. SECTION 9: The provisions of Resolution No. 9824 not consistent with or in conflict with this resolution are repealed; in all other respects, Resolution No. 9824 shall remain in full force and effect. L.A. Wash Rack has indicated that it takes a minimum of two days for tanker inspections, washes and re -inspections and for tanker repairs they need up to seven days because if a vehicle needs a replacement part, it may take anywhere from two to three days for the part to be shipped to the facility and then another day or two to install. The repair shop may not be open on Sundays or holidays, which lengthens the total time that a repair might take to seven days. The grant of the modification would not be materially detrimental to the public health; safety; or welfare, or to the interests of other residents and property owners within the vicinity of the Lot in question. The grant of the modification would provide L.A. Wash Rack with sufficient time to perform scheduled washes and repairs under a worst case scenario where parts are not immediately available. Thus, the applicant is seeking this modification with the understanding that all tanker trucks entering the site to be washed and/or repaired shall be limited to a maximum of 7 days to be stored at the site.
