Resolution No. 098701 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 9870 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON, CALIFORNIA, CALLING FOR THE HOLDING OF A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, JUNE 2, 2009, FOR THE SUBMISSION TO THE VOTERS OF A QUESTION RELATING TO WHETHER AN AMENDMENT TO THE CITY CHARTER OF THE CITY OF VERNON SHOULD BE ADOPTED WHEREAS, under the provisions of Article V, Section 2 of the City Charter of the City -of Vernon, and California Government Code section 34458, a Special Municipal Election shall be held on June 2, 2009, for the submission to voters a question relating to whether an amendment to the City Charter entitled "City Council, Elections and Terms of Office" shall be adopted. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: That pursuant to the requirements of Article V, Section 2 of the City Charter of the City of Vernon, there is called and ordered to be held in the City of Vernon, California, on Tuesday, June 2, 2009, a Special Municipal Election for the purpose of submitting to the voters an amendment to the City Charter of the City of Vernon. SECTION 2: That the City Council, pursuant to its right and authority, does order submitted to the voters at the Special Municipal Election the following question: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Proposition A Shall the City Charter be amended to provide Yes for regular municipal Elections each April and for staggered terms of office for members of the City Council, one of whom shall be elected each year to five year terms; with No the extension of terms for one council office currently to be elected in 2010 and one council office currently to be elected in 2012 to fully effect the staggered elections? SECTION 3: That the proposed measure to be submitted to the voters is attached hereto and made a part hereof as Exhibit "A." SECTION 4: That the ballots to be used at the election shall be in the form and content as required by law. SECTION 5: That the City Clerk is authorized, instructed and directed to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment and paraphernalia that may be necessary in order to properly and lawfully conduct the election. SECTION 6: That pursuant to Section 4000 of the Elections Code of the State of California, the election will be conducted entirely by vote -by -mail ballots. The City Hall is hereby designated as the polling place pursuant to Section 4102 of the Elections Code of the State of California. Composition There shall be a City Council composed of five members, with staggered terms as provided in section 4, elected at large by the qualified voters of the City. Section 4. Election and Terms The regular election of council members shall be held on the second Tuesday of April in each even nufabe,-ed year , commencing in 2010. teEffi ef eaeh efflee shall be feur yeaics. The terms of council members shall be staggered so that each council member shall serve a five year term and one council member shall be elected each year; provided, however, that in order to effect the election of council members according to staggered terms as set forth above, upon adoption of this section by the voters, the City Council shall assign each Council position a number, with the Council seats which expire in 2010 assigned numbers 1, 2 and 3 by lot, and Council seats which expire in 2012 assigned numbers 4 and 5 by lot. Council seat number 3 will be subject to election for five year terms commencing in 2010. Council seat number 1 will have its term extended one year to 2011, and will be subject to election for five year terms commencing in 2011. Council seat number 2 will have its term extended two years to 2012, and will be subject to election for five year terms commencing in 2012. Council seat number 4 will have its term extended one year to 2013, and will be subject to election for five year terms commencing in 2013. Council seat number 5 will have its term extended for two years to 2014, and will be subject to election for five year terms commencing in 2014. The City Council shall be the final judge of the election results and the qualifications of its members. The City Council shall canvass the returns of an election on the first Tuesday following a City Council election or such other date within fifteen (15) days of the election as may be provided by ordinance. The terms of each elected councilmember shall'begin at the hour of the completion of the canvass of the election returns. In the absence of death, removal from office or disqualification, each councilmember shall serve until expiration of his or her term and until a successor qualifies. ARTICLE V Elections Section 1. General Municipal Elections. General municipal elections shall be held in the City on the second Tuesday of April in each even nafabereel year.
