Resolution No. 09941 1 RESOLUTION NO. 9941 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 VERNON AMENDING RESOLUTION N0. 9638, WHICH APPROVED A BUDGET FOR THE FISCAL YEAR 200.8-2009, TO REFLECT 4 CHANGES, (AMENDMENT N0. 5) 5 6 WHEREAS, on June 16, 2008, the City Council of the City of 7 Vernon adopted Resolution No. 9638 which approved a budget for the 8 fiscal year 2008-2009 (the "Budget Resolution"); and 9 WHEREAS, on August 4, 2.008, the City Council of the City of 10 Vernon adopted Resolution No. 9677 which approved~a first amendment to 11 the budget for the fiscal year 2008-2009; and 12 WHEREAS, on October 6, 2008, the City Council of the City of 13 Vernon adopted Resolution No. 9727 which approved a second amendment 14 to the budget for the fiscal year -2008-2009.; and 15 WHEREAS, on January. l2, 2009, the City Council of .the .City 16 of Vernon adopted Resolution No. 9810 which approved a third amendment 17 to the budget for the fiscal year 2008-2009; and 18 WHEREAS, on March 16, 2009, the City Council of the City of 19 Vernon adopted Resolution No. 988.5 which approved a fourth amendment 20 to the budget for the fiscal year .2008-2009; and 21 WHEREAS, the City Council of the City of Vernon wishes to 22 amend the budget for fiscal year 2008-2009 to reflect. certain 23 increased requirements and changes for the fiscal year; and 24 WHEREAS, pursuant to Chapter 8.5 of the City of Vernon 25 Charter, the budget may be amended or supplemented by an affirmative 26 vote of the majority of the members of the Council, at any meeting. of 27 the City Council after the. adoption of the budget; and 28 WHEREAS, the budget changes and increases approved by this 1 Resolution will not cause the budget of the City to exceed the general 2 government appropriations limit for fiscal-year 2008-2009 established 3 by Resolution No. 9637; and 4 WHEREAS, notice of a public hearing was published on 5 April 30, 2009, regarding the adoption of an amendment to the budget, 6 and the City Council held the duly noticed public hearing on May 11, 7 2009, at which time all interested persons were given an opportunity 8 to be heard; and. 9 WHEREAS, the City Council has heard and considered all 10 evidence, both written and oral, presented respecting the 2008-2009 11 budget amendment. 12 NOW, THERE-FORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 13 CITY OF VERNON AS FOLLOWS: 14 SECTION 1: The City Council. of the City of Vernon hereby 15 finds and determines that the recitals contained hereinabove are. 16 true and correct. 17 SECTION 2: The City Council of the City of Vernon further 18 finds, that all persons have had the opportunity to be heard or to file 19 written objections to the proposed amended 2008-2009 budget,-and after 20 due consideration of the evidence submitted at the. public hearing 21 determines that there are compelling reasons to justify amending the 22 2008-200.9 budget. 23 SECTION 3: The City Council of the City of Vernon hereby. 24 approves. changes to the .2008-2009 budget pursuant to Exhibit A 25 attached hereto and incorporated by reference to reflect certain 26 increased requirements for the fiscal year 2008-2009 for the budget of 27 the City of Vernon. 28 SECTION 4: The City Council of the City of Vernon hereby - 2 _ 1 .finds and determines that the certain items set forth in Exhibit A are 2 necessary, and the City Council of the City of Vernon further finds 3 and determines that the same is in the best interests of the City of 4 Vernon and constitutes a reasonable expenditure of public funds. 5 SECTION 5: The City Clerk, or her designee, is hereby 6 directed to .file this Resolution with the County Auditor of Los 7 Angeles County, located at the following address, within sixty (60) 8 days after its passage, to fulfill the purposes of 53990 and 5390.1 9 of the Government Code of the State of California with respect to this 10 amendment: 11 County of Los Angeles Office of Auditor/Controller 12 Hall of Administration 13 500-West Temple Street Los .Angeles, CA 90012 14 15 SECTION 6: The provisions of Resolution No. 9638, as 16 amended, not consistent with or in conflict with this resolution are 17 hereby repealed; Ln .that time we have proposed to you and you have adopted various ordinances that reorganized the City's ~ administrative structure. Your Department Heads now have the authority and responsibility to manage their respective departments.- Various positions have been created to better manage the City's needs and facilitate efficient communications with. other governmental agencies, ~ . capital markets, the City's lenders, and. WaII Street. The City's credit rating has been increased two levels to the "A-3" category. We have structured the optimal use of our Light & Power resources, culminating in the City ~ receiving nearly $400 million in proceeds from that asset restructuring. The City has paid -off all of its nearly $300 million in project debt. And finally, the. City has successfully restructured its natural gas supply to low interest long term debt. Ironically, I worked: with the team representing the Gity accomplishing these objectives as an attorney. Today,. I am recommending to you to appoint Donal O' Callaghan, effective May 15th, 2009, as the administrative head of the City's government in the role of City Administrator. He can. devote .his entire time to the duties and interests of the City in this-new role, as well as serving as the City's Director of Light & Power: I make these recommendations to the City at no additional economic cost for Donal's services. My own contract hourly rates for legal services aaso remain the same and as always the amount of hours I work are subject to the City's .request acid approval.
