3 ~ VERNON APPROVING AND AUTHORIZING THE EXECUTION OF A
GRANT APPLICATION UNDER THE CALIFORNIA BEVERAGE
4 CONTAINER RECYCLING AND LLTTER REDUCTION ACT TO THE
DEPARTMENT -0F CONSERVATION'S DIVISION OF RECYCLING

6 WHEREAS, the. State of California has enacted the California
7 Beverage Container Recycling and Litter Reduction Act that provides
g funds to the cities and counties for beverage container recycling and
g litter cleanup activities; and
10 WHEREAS, the California Department of Conservation's
11 Division of Recycling has been delegated. the responsibility for the
12 administration of the program within the State and setting up
13 necessary procedures for cities and counties or their designee under
14 the program; and
15 WHEREAS, the City of Vernon has applied for grant funds under
16 the program since May of 2000; and
17 WHEREAS, the California'Department.of.Conservation has
18 announced that the City of .Vernon is. eligible. for Five Thousand Dollars
19 and No Cents ($5,000.00) in grant funds .over fiscal year 2009-2'010; and
20 WHEREAS, pursuant to Section 14581 (a)'(4)(E) of the
21 California Beverage Container. Recycling. and Litter Reduction Act, the
22 eligible participant must submit a Funding Request Form by a certain
23 due date in order to request funds from the Department of
24 Conservation's Division of Recycling; and
25 WHEREAS, by memo dated April 21, 2009, the Director of Health
26 & Environmental.-Control recommended that the application for the
27 Beverage Container Recycling and Litter Reduction grant funds be
28 approved and executed.
1 NOW, THEREFORE,. BE IT RESOLVED BY THE CITY COUNCIL OF THE
2 CITY OF VERNON AS FOLLOWS:
3 SECTION. 1: The City Council of the City of Vernon
4 hereby finds and determines that the recitals contained hereinabove
5 are true and correct.
6 SECTION 2: The City Council of the City of Vernon hereby-
. 7 approves and authorizes the electronic submittal of the "City/County
8 Funding Request Form (FRF) FY 2009/2010" ("Form"), in substantially
9 the same form as the copy which is attached hereto as Exhibit A and
10 incorporated by~reference, to the Department of Conservation's
11 Division of Recycling for all available grant funds under the
12 California-Beverage Container Recycling .and Litter Reduction Act for
13 the period governing the grant program.
14 'SECTION 3: The City Council of-the City of Vernon hereby
15 authorizes the Director of Health & Environmental Control to
16 electronically execute said Form for, and on behalf of, the City of
17 Vernon.
18 SECTION 4: The Director of Health & Environmental Control
19 is hereby authorized and empowered to execute all forms necessary to
20 secure, implement and. carry out-the purposes specified in Section
21 14581 (a)(4)(A) of-the California Beverage Container Recycling and
22 Litter Reduction Act and to provide information regarding this program
23 to the Department of Conservation's Division of Recycling, upon
24 request.
25 SECTION 5: The City Council of the City of Vernon hereby
26 directs-the City Clerk,~or her .designee, to submit a fully executed
27 Form prior. to June 30, 2009, to the California Department of
28 Conservation, Division of Recycling.

1 SECTION 6: The City Clerk of the City of Vernon shall
2 certify to the passage of this resolution, and thereupon and
3 thereafter the same shall be in full force and effect.

RE: Request for Approval to Apply for a Beverage Container Recycling
and Litter /Cleanup Grant Funds FY 2009/2010
In May 2000, the- City Council adopted Resolution 7533, which authorized the City for the first time
to apply for a Beverage Container Grant. As a result of that application and subsequent
applications, the California Department of Conservation has annually approved individual _$5,000
grants to the City of Vernon. We have used the grants to promote and distribute recycling and litter
reduction information to businesses in the City and at the Vernon Elementary School.
The California Department of Conservation has announced that, pursuant to Section 14581(a)(4)(A)
of the California Beverage Container Recycling and Litter Reduction Act, the City of Vernon is
eligible for $5,000 in grant funds for fiscal year 2009-2010. Because litter is an ongoing problem in
our city as well as in neighboring communities, we are proposing to apply for the grant funds- and
utilize them to develop and distribute public information items as-well as to purchase products to
promote recycling. The public information efforts would be similar to those ,used in the Used Oil
Recycling Program that has been very successful for the past several years.
I am recommending that the City Council authorize the application for the Beverage Container
Recycling and Litter Reduction Grant Funds. For consideration, I am attaching the completed
application, which we will submit .electronically, and a partially edited copy of the previous resolution
for reference (a copy of the resolution is no longer required for submittal).
Please note that the completed application must be received by the Department of
Conservation by Tuesday June 30, 2009. Please advise our department of the City Councils
approval of the application for submission to the Department of Conservation.
If the Departmenf`~ of Conservation approves our grant, I propose to continue to utilize the services
of KJ Services for the Beverage Container Program.

20 SECTION 4: The Director of Health & Environmental Control
21 is hereby authorized and empowered to execute all forms necessary to
22 secure, implement and carry out the purposes specified in Section
23 14581(a){4)(A) of the California Beverage Container Recycling and
24 Litter Reduction Act and to provide information regarding this program
25 to the Department of Conservation's Division of Recycling, upon
26 request.
27 SECTION 5: The City Council of the City of Vernon hereby
28 directs the City Clerk, or her designee, to submit a fully executed

1 Form prior to June 30, to the California Department of
2 Conservation,. Division of Recycling.
3 SECTION 6: The City Clerk of the City of Vernon shall
4 certify to the passage of this resolution, and thereupon and
5 thereafter the same shall be in full force and effect.
