3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND ADOPTING A SCHEDULE OF PARKING
4 PENALTIES

~ WHEREAS, Section 40200 of the Vehicle Code of the State of
7 California provides that parking penalties for violation of ordinances
8 and state laws governing standing or parking of a vehicle are to be
9 collected as civil penalties; and
10 WHEREAS, on August 17, 1993, the City Council of the City of
11 Vernon adopted Resolution No. 6302 approving a schedule of parking
12 Penalties; and -
13 WHEREAS, Section 16.28 of the Vernon City Code provides that
14 the City1Council shall by resolution adopt a schedule of parking
15 Penalties for parking violations, late payment penalties,
16 administrative fees, and other related charges for parking violations
17 in accordance with the recommendation of the Chief of Police; and
18 WHEREAS, by memo dated May 20, 2009, the Chief of Police has
19 recommended a-proposed new .schedule of parking penalties for parking
20 and standing violations which updates, increases and standardizes
21 Parking penalties with other issuing agencies in-the County of Zos
22 Angeles.
23 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
24 CITY OF VERNON AS FOLLOWS:
25 SECTION 1: The City Council of the City of Vernon hereby
26 finds and determines. that the recitals contained hereinabove are true
27 and correct.
28 SECTION 2: The City Council of the City of Vernon hereby
1 approves and adopts .the Schedule of Parking Penalties which is
2 attached hereto as Exhibit A and incorporated by reference.
3 SECTION 3: The. City Clerk of the City of Vernon shall
4 certify to the passage of this .resolution, .and thereupon and
5 thereafter the same shall be in full force and effect.
6 APPROVED AND. ADOPTED this 8th day of June, 2009.

DELINQUENCY PARKING PENALTY
The original parking penalty ("Civil Penalty") contains a base penalty. plus thirteen
dollars ($13.00) for the following: fees:
(a) Processing fee: $8.00
(b) State-mandated fees:
Court-fund fee: $2.50
Jail fund fee: $2.50
The delinquency parking penalty ("Delinquency Penalty") will be imposed in lieu of the
original parking penalty if the original parking penalty is not paid within the time shown on the
notice of delinquent parking violation which would be sent to the registered owner of the vehicle
pursuant to Section 40206 of the California Vehicle Code.
The Delinquency Penalty is calculated by doubling the-base penalty and adding thirteen
dollars ($13.00) for the fees set forth in (a) and (b) above.
ADDITIONAL FEES
An administrative fee of twenty-three dollars ($23.00) will be added if a payment check
is returned for insufficient funds in the account on which it is drawn.
A vehicle registration "hold" penalty will be imposed by the California bepartment of
Motor. Vehicles if the City files an itemization of unpaid parking penalties, administrative, and
service fees for collection with the vehicle registration pursuant to Section 40220 of the
California Vehicle Code.

RE: Recommendation to Change Parking Penalties-
REQUEST:
I am recommending that the City Council consider amending Resolution No. 6302, adopted
August 17, .1993, to update the parking penalties and increase the existing penalties by $3.00.
EXECUTIVE SUMMARY:
California Vehicle Code Section 40302.5 states that parking penalties and late payment penalties
shall be established by the governing body of the jurisdiction where the notice of violation is issued. The
City of Vernon adopted Ordinance No. 1014 on August 17, 1993 and subsequently passed Resolution #
6302 on August 17, 1993, establishing the parking penalties.
On January 1, 2009, Senate Bill 1407 was enacted as law. This law authorizes the issuance of up
to $5 billion in lease revenue bonds for the purposes of financing, planning, design, construction,
rehabilitation, renovation, replacement, leasing or acquisition of state trial court facilities. The law also
authorizes a variety of increases to penalties and fees as revenue sources for the bonds.
Specifically, it amends subdivision (b~ of Section 70372 of the Government Code to authorize the
removal of an additional. $3.00 in court construction penalties from each violation. The additional $3.00
increases the total penalty amount removed by-the state to $4.50. Of this total amount, $1.50 will go to the
State Court Facilities Construction Fund (SCFCF) and the additional $3.00 will go to the SCFCF
Immediate and Critical Needs Account, which was created by SB 1407.
On April 13, 2009, we were notified by Judicial Data Services (the firm that processes our
parking citations), that they are now removing this additional amount from our citations, meaning that for
each parking citation we write, we are receiving $3,00 less than we have been receiving.
Since FY OS-06, we have issued 6191 citations (through March '09), for an average of 138 per
month. Using these figures, a reduction. of $3 per citation would have amounted to $18,573 fewer dollars
being returned to the City (an average of $4,953 per year). As we continue to fill the Police Officer and
Vernon Service Officer ranks, it is reasonable to expect that the number of citations issued will increase.

FISCAL IMPACT:
Changing Resolution No. 6302 and increasing the existing penalties by $3.00 per violation will offset the
loss of an equal amount to the State. Not making this change will result in an annual reduction of parking
citation revenue in the amount of approximately $4,953 per year.
RECOMMENDATION:
In order to minimize the negative fiscal impact of SB 1407, I am recommending that the City
Council consider amending Resolution No. 6302 and increase the existing parking violation penalties by
$3.00.

Attached is a Staff Report which recommends that the City Council amend Resolution No, 6202 and add
an additional $3.00 to each parking violation penalty.
SB 1407, which became law on January 1, 2009, diverts .$3.00 from the revenue generated by each
parking citation we issue and redirects it frgm the City to a fund intended to help build new court
facilities.
Making the proposed changes will offset this loss, which is projected to be approximately $4,953 per '
year.
