Resolution No. 09995 1 RESOLUTION NO . 9 9 9 5,. _ ~\\v~o~ 2 b\ 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING. THE .WORK OF FS CONSTRUCTLON IN 4 ACCORDANCE WITH CONTRACT N0. CS-0014 OF THE CITY OF VERNON 5 6 WHEREAS, FS Construction was awarded Contract No. CS-0014 for 7 the City Apartment Complex Parking Lot pursuant to Resolution No. 9779 8 of the City of Vernon; and 9 WHEREAS, the Director of Community Services and Water .has X10 reported to the City Council of the City of Vernon that said work has 11 been completed and recommends that the work be accepted and payment be 12 made to the Contractor in accordance with the agreement. 13 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE 14 CITY OF VERNON AS FOLLOWS: 15 SECTION 1: The City Council of the City of Vernon hereby 16 finds and determines that the recitals contained hereinabove are true 17 and correct. 18 SECTION 2: The work of FS Construction pursuant to Contract 19 No. CS-0014 is hereby approved and accepted by the City Council of the 20 City.. of Vernon. 21 SECTION 3: The original contract .amount was Two Hundred 22 Twenty-Seven Thousand Five Hundred.-Fifty-Nine Dollars and No Cents 23 ($227,559.00). Two change orders were issued for a total. final 2.4 contract amount of Two Hundred..Twenty-.Five .Thousand Four Hundred Seven 25 Dollars and Fifty Cents .($225,407.50). A final progress payment of 26 Twenty-Eight Thousand Four Hundred Thirteen Dollars and No Cents 27 ($28,413.00) is now due. The remaining ten percent (lOo) or the sum 28 of Twenty-Two Thousand Five Hundred.-Forty Dollars and Seventy-Five 1 Cents ($22,540.75) is payable thirty-five (35) days after the 2 recordation of the Notice of Completion, except such amounts as are 3 required by law to be withheld by properly executed and filed not-ices 4 to stop payment, or as may be authorized by the contract to be further 5 retained. 6 SECTION 4: The City Council of-the.
