RESOLUTION NO. 10,004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE SALE OF SURPLUS PROPERTY
FROM THE POLICE,DEPARTMENT PURSUANT TO SECTION 2.31
OF THE VERNON CITY CODE
WHEREAS, pursuant to Vernon City Code Section 2.31 and
Government Code Section 37350, the City of Vernon may sell surplus
property for the common benefit; and
WHEREAS, on June 4, 2009, the Director of Business Services
recommended that property from the Police Department more particularly
described on Exhibit A which is attached hereto.and incorporated by
reference be declared as surplus to the needs of the City of Vernon as
said items are incompatible with the City's future needs and are
therefore no longer useful to the needs of the City; and
WHEREAS, it is in the best interests of the City of Vernon
that the property described in the above -referenced Exhibit be sold
as surplus property.pursuant to Section 2.31 of the Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: In accordance with Government Code Section 37350
and Section 2.31 of the Vernon City Code, the City Council of the City
of'Vernon hereby finds and determines that the property described in
the attached Exhibit A is surplus to the needs of the City of Vernon.

SECTION 3: The Purchasing Agent is hereby authorized to
contract with an auction company, to obtain bids or to make other
arrangements for the sale of the property described in said Exhibit as
surplus property pursuant to Section 2.31 of the Vernon City Code.
.SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage of this resolution, and thereupon and
thereafter the same shall be in full force and effect.
APPROVED AND ADOPTED this 6th day of July, 2009.

RE: Police Department Surplus and Sale of Safariland Magazine Pouches
Attached for your review is a Police Department memorandum from Captain
Daniel Calleros to Chief Steve Towles dated May 12, 2009. Also attached is a
Police Department Report of Surplus Property indicating (57) Safariland
Basketweave magazine pouches and (55) Safariland Nylon magazine pouches, all
in good condition.
In the memo to the Chief, Captain Calleros advised that the department
purchased (120) these items, for their Springfield XD45 .45 caliber handguns, at a
total cost of $2,581.20. After numerous malfunctions in operating the .45 caliber
handguns, the department exchanged these for .40 caliber handguns. The
officers were able to use their existing Baretta magazine pouches with the .40
caliber Springfield weapons.
The department attempted to return the Safariland magazine pouches, but were
told this was not possible because these items were special ordered. Detective
Michael Docherty was able to find a local gun dealer who wanted to purchase the
used magazine pouches, at a cost of $5.00 per item. The department wants to
sell (112) of these pouches, and will keep (8) of the original pouches for training
purposes. The vendor interested in purchasing these items is USAMike Leather
Sales, and their quotation for this purchase is attached.
The department needs to declare these items as surplus, and upon approval of
the surplus request, the items can be sold to USAMike Leather Sales, at a cost of
$560.00.
Purchasing is recommending the approval of the surplus request, and the
approval to sell these items to USAMIke Leather Sales, at a cost of $560.00.

SUBJECT: Surplus and Sale of Safariland Magazine Pouches
I am requesting to surplus and sell the double magazine pouches that were purchased for the new
Springfield XD45 .45 caliber handgun. We do not have a use for these items since we exchanged the .45
caliber handgun for the .40 caliber model.
Late last year we made the decision to exchange the Springfield XD45 handgun for the XD40 (.40
caliber) model due to the malfunctions we experienced with the .45 caliber model. Since we exchanged
the handgun for the .40 caliber model, most officers were able to use their existing magazine pouches that
were issued with the Beretta handgun.
We purchased a total of 120 -.45 caliber Safariland basket -weave and nylon magazine pouches (60-each)
from ProForce Law Enforcement, for a total cost of $2581.20 (P.O. # 011.0001338). We contacted this
vendor to seek credit and/or exchange the magazine pouches. We were advised that no exchange or credit
could be provided since the magazine pouches were a special order item from the manufacturer.
Because we were unable to exchange or obtain credit for the magazine pouches from the vendor, Det.
Docherty checked with several local vendors to find out if there was an interest in the purchase of the .45
caliber magazine pouches. Docherty obtained a quotation from USAMike Leather Sales, for the purchase
of all .45 caliber magazine pouches at a cost of $5.00 each. Other vendor quotes came in much lower at
approximately $2.25, per pouch.
I spoke with Dolores Jaunzemis, from the City_ purchasing department about the planned sale of pouches.
Dolores stated that a surplus property report should be completed to document the disposition of the
pouches.
Given that we do not have a need for the .45 caliber magazine pouches, I recommend that we move
forward with the sale of pouches to USAMike Leather Sales. Attach is a copy of the quotation.
