Resolution No. 100347 8 9 10 11 12 13 14 15 16 17 18 19, 20 21 22 23 24 25 26 27 RESOLUTION NO. 10,034 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON .AUTHORIZING THE CITY ADMINISTRATOR TO ENTER INTO NEGOTIATIONS WITH GLADSTEIN, NEANDROSS & ASSOCIATES FOR PREPARATION OF A CLIMATE ACTION PLAN AND A GREEN INDUSTRIAL DEVELOPMENT PLAN AND DIRECTING THE CITY ADMINISTRATOR TO REPORT BACK TO THE CITY COUNCIL WITH A RECOMMENDATION FOR ACTION WHEREAS, in recent years, the State of California has been enacting a series of statutory,and regulatory measures designed to address a number of environmental issues, including Global Warming,' Global Climate Change, Green House Gas emissions, storm water run. -off, and other emission reductions; and WHEREAS., the California Regional Water Quality Control Boards (the "Boards") are in the process of renewing a set of 5,-year permits known as the MS4 Permits, and City and County governments.that are the subject of these Permits must impose requirements on any new development and significant redevelopment that proposes to connect to the public storm drains and WHEREAS, the specific requirements being considered to be adopted for local governments in the Los Angeles region by the Boards will mandate that new projects be required to retain on -site all.storm water, and that retained water has to then be infiltrated into the ground (after it has been cleaned up before infiltration), as well.as the imposition of specific numeric requirements on the quality of the water; and WHEREAS, the City of Vernon has an opportunity to evaluate these and other issues related to Green House Gas reductions and storm water permitting through the consideration of a Climate Action, 1 2 3 4 5 6. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 PA 23 24 25 26 27 28 Plan and a Green Industrial Development Plan which will help the City address the opportunities to reduce Green House Gases, and to address storm water and other environmental issues in ways that help achieve these goals while preserving the economic vitality of Vernon's business community and protecting the health of the City residents and residents in the surrounding areas; and WHEREAS, Gladstein, Neandross & Asso,ciates ("Gladstein") is widely recognized as a leader in its expertise in addressing environmental issues .and is qualified to assist the City in the preparation of a Climate Action Plan and a Green Industrial Development Plan; and WHEREAS, Gladstein has developed a number of innovative approaches to public private partnerships and market based solutions for environmental issues and has a great track record in working with governments, businesses and community groups; and WHEREAS, the City is,committed to developing and implementing responsible and effective plans that can help the City, the region and the State to achieve its goals regarding environmental issues while at the same time demonstrating that environmental sustainability and economic vitality can be achieved; and WHEREAS, by memo dated July 29, 2009, the City Administrator has recommended that he, or his designee, be authorized to negotiate an agreement with Gladstein for the preparation of a Climate Action Plan and a Green Industrial Development Plan, subject to reporting back to the City Council with a recommendation for action, such as a proposed agreement, scope of work, budget and further recommendations; and - 2 - 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21, 22 23 24 25 26 27 28 WHEREAS, Section 2.29-3 of the Vernon City Code authorizes the City Council, by Resolution, to direct a City officer to enter into negotiations with a specified contractor for a contract for services if certain findings are made; and WHEREAS, the City Council finds that, based upon the above, Gladstein has the unique qualifications and experience to provide the Climate Action Plan and Green Industrial. Development Plan; and WHEREAS, the City Council finds that, based upon the above, it is preferable to authorize the City Administrator, or his designee, to enter into negotiations with Gladstein for the preparation of a Climate Action Plan and a Green Industrial Development Plan, subject to the City Administrator reporting back to the Council with a recommendation for action, such as a proposed agreement, scope of work, budget and further recommendations. NOW,. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby directs the City Administrator, or his designee, to enter into negotiations with Gladstein for the preparation of a Climate Action Plan and a Green.Industrial Development Plan and to report back to the City Council with the results of the negotiations with a recommendation for action (such as a proposed agreement, scope of work and budget) pursuant to Vernon City Code Section 2.29-3. - 3 - SECTION 3: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and her certification to be entered in the Book of Resolutions of the Council of this City. With respect to Global Climate Change and Green House Gas emissions the following State measures have been adopted: California Asse01Z 6�l/ 32 32): The California Global Warming Solutions Act !! 11 h5�, f K 1 Iw.1 of 2006, also known as Assembly Bill (AB) 32, signed by Governor Schwarzenegger in September 2006, requires the California Air Resources Board (CARB) to adopt regulations to require the reporting and verification of statewide Green House Gas (GHG) emissions and to monitor and enforce compliance with the program. 1n general, the bill requires CARB to reduce statewide GHG emissions to the equivalent of those in 1990 by 2020 (reduction of approximately 25 percent from forecast emission levels). Senate,8/ll 3U (September.2Q08): In September 2008, Senate Bill 375 (SB 375) was signed. SB 375 is a comprehensive global warming bill that helps to achieve the goals of AB 32. It requires the Metropolitan Planning Organization (such as SLAG) to include and adopt, in their regional transportation plan, a sustainable community strategy that will meet the region's target for reducing GHG emissions. Executive Qrder .S-3-05: On June 1, 2005, Governor Schwarzenegger signed Executive Order S-3-05, which set ambitious GHG emission reduction targets for California to meet by 2010, 2020, and 2050, and ordered the California Environmental Protection Agency to report biannually on progress toward meeting the GHG emission targets and "on the impacts to California of global warming, including impacts to water supply, public health, agriculture, the coastline, and forestry." Honorable Mayor and City Council July 29, 2009 Page 2 In addition, the California Attorney General has been active in the area of GHG: The California Attorney General's Office has published a document titled "The California Environmental Quality Act: Addressing Global Warming Impacts at the Local Agency Level." The document acknowledges the important role local agencies play in addressing global climate change. The document states that "local agencies can encourage well -designed, sustainable private projects by analyzing and disclosing to the public the environmental benefits of such projects in any required environmental documents." In general terms, California's goals and overall strategies for the systematic statewide reduction of GHG emissions are embodied in the combination of state legislation, executive orders and regulations, which call for the following reduction of GHG emissions: • 2000 levels. by 2010 (11 percent below business -as -usual); • 1990 levels by 2020 (25 percent below business -as -usual); and •. 80 percent below 1990 levels by 2050. Further, the California Regional Water Quality Control boards are in the process of renewing a set of 5-year permits known as the MS4 permits (called MS4 for Municipal Separate Storm Sewer System --yes 4 S's). These updates will be sweeping and the City and County governments that are subject to these permits must impose these requirements on any new development and significant redevelopment that proposes to connect to the public storm drains. The specific requirements being considered to be adopted for local governments in the Los Angeles region are similar to what the Los Angeles Regional Board adopted for Ventura County. Essentially the new requirements will mandate that new projects be required to retain on -site all storm water, and that retained water has to then be infiltrated into the ground (after it has been cleaned up before infiltration). In addition to retention and infiltration requirements, there is an effort to impose specific numeric requirements on the quality of the water. For example, imposing a requirement that storm water cannot exceed certain threshold of petroleum products which are washed out of parking lots after a rain. The City of Vernon has an opportunity to evaluate these and other issues related to GHG reductions and stormwater permitting through the consideration of a Climate Action Plan and a Green Industrial Development Plan. These plans will help the City address the opportunities to achieve the reductions in GHG, to address storm water issues and other environmental issues in ways that help achieve these goals while Honorable Mayor and City Council July 29, 2009 Page 3 preserving the economic vitality of our business community and protecting the health of our residents and residents in the area. The City has identified a firm, Gladstein, Neandross & Associates, that is qualified to help the City prepare a Climate Action Plan and a Green Industrial Development Plan. Gladstein Neandros & Associates is widely recognized as a leader in its expertise in addressing environmental issues. Gladstein, Neandros & Associates has developed a number of innovative approaches to public private partnerships and market based solutions for environmental issues. They have a great track record in working with governments, businesses and community groups. We believe that we can develop and implement responsible and effective plans that can help the City, the region and the State to achieve it goals. We believe that in doing so we can demonstrate that environmental sustainability and economic vitality can be achieved. RECOMMENDATION: It is recommended that the City Council directs staff to negotiate an agreement with Gladstein, Neandross & Associates inclusive of a scope of work and budget for the preparation of a Climate Action Plan and a Green Industrial Development Plan. Staff shall report back to the City Council with a proposed agreement, scope of work, budget and further recommendations. DO:rmt
