A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING A LOT LINE ADJUSTMENT FOR THE
PROPERTIES LOCATED AT 4462 PACIFIC BOULEVARD AND
2450 VERNON AVENUE, REQUESTED BY L&D REAL ESTATE
HOLDINGS, LLC AND PABCO BUILDING PRODUCTS, LLC AND
APPROVING AN AMENDMENT TO A COVENANT AND AGREEMENT
TO HOLD THE NEWLY ADJUSTED LOT LOCATED AT 4462
PACIFIC BOULEVARD WITH THE LOT LOCATED AT 4460
PACIFIC BOULEVARD AS ONE
WHEREAS, L&D Real Estate Holdings, LLC ("L&D"), is the owner
lof a parcel of land (Assessor Parcel No. 6308-006-011) located at 2450
Vernon Avenue consisting of three parcels and located in the City's I-
lZone, Industrial.; and
WHEREAS, Pabco Building Products, LLC ("Pabco"), is the.
lowner of a parcel of land (Assessor Parcel No. 6308-006-008) located
lat 4462 Pacific Boulevard, and consisting of one parcel, that is tied
by a.previously recorded covenant to a second parcel located at 4460
Pacific Boulevard, and located in the City's I -Zone, Industrial; and
WHEREAS, both Assessor Parcel No.6308-006-011 located at 2450
Vernon Avenue, and Assessor Parcel No. 6308-006-008 located at 4462
Pacific Boulevard are described and shown on the attached Exhibit A
consisting of four (4) pages which is incorporated herein by this_
preference as though fully set forth at length; and
WHEREAS, L&D and Pabco desire to adjust the common boundary,
between the parcels located at 24.50 Vernon Avenue and 4462 Pacific
Boulevard, whereby said adjustment will decrease the size of the parcel
located at 4462 Pacific Boulevard, and increase the size of the parcel
located at
2450 Vernon Avenue, and
create the properties
as
described
and shown
on the attached Exhibit B
consisting of three

which is incorporated herein by this reference as though fully set
forth at length; and
WHEREAS, in 1985, Pabco, or its predecessor, Pacific Coast
Packaging_Corp., at the request of the City of Vernon, recorded a
Covenant and Agreement to Hold:Two Separate Parcels of Real Property
(currently located at 4460 Pacific Boulevard and 4462 Pacific
Boulevard) as One Parcel for the purposes of satisfying previous City
Code parking requirements; and
WHEREAS, such covenant will need to be amended in order to
tie the newly adjusted parcel located at 4462 Pacific Boulevard to the
existing parcel located at 4460 Pacific Boulevard, for purposes of
satisfying previous'City Code parking requirements; and
WHEREAS, L&D and Pabco have applied for a lot line adjustment
pursuant to Government Code Section 66412(d), which provides that the
Subdivision Map Act does not apply to the following;
"(d) A lot line adjustment between four or fewer existing
adjoining parcels, where the land taken from one parcel is
added to an adjoining parcel, and where a greater number of
parcels than originally existed is not thereby created, if
the lot line adjustment is approved by the local agency, or
advisory agency...."

WHEREAS, Government Code Section 66412(d) permits a local
agency to impose conditions or exactions on its approval of a lot.line
adjustment so long as they relate to a property's conformity with the
local general plan, any applicable coastal plan, and zoning and
building ordinances, or require the prepayment of real property taxes
prior to the approval of the lot line adjustment, or facilitate the

relocation of existing utilities, infrastructure, or easements; and
WHEREAS, Section 28.2 of Chapter 28 of the City's Code
requires all lot line adjustments to conform to the City's General
Plan,and the City's Comprehensive Zoning Ordinance; and
WHEREAS, L&D and Pabco formally submitted their lot line
adjustment on or about May 27, 2009; and
WHEREAS, Samuel Kevin Wilson, Director of Community Services
Water, has has recommended that said lot line adjustment and related
covenant amendment be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
finds that the proposed project is categorically exempt based on a
Class 5 Categorical Exemption (Section 15305 of the California
Environmental Quality Act Guidelines) because the lot line adjustment
would not result in the creation of any new parcel, and there is no
evidence that this adjustment will create any environmental impact.
The City Council hereby directs the City Clerk or her designee, to
file a Notice of Exemption for this project with the County Clerk of
the County of Los Angeles.
SECTION 3: The City Council of the City of Vernon, in
compliance with Section 28.2 of Chapter 28 of the City Code, and
Government Code Section 66412(d), hereby makes the following findings:
a. The parcels that will result from the lot line
adjustment are consistent with the policies and goals of the City's

General Plan because the land use designations will not be changed by
the lot line adjustment. Additionally this lot line adjustment will
continue to encourage industrial uses at both parcels which is
consistent with the policies in the General Plan
b. The parcels that will result from the lot line.
adjustment are consistent with the City's Comprehensive Zoning
Ordinance because no triggering events are occurring as described in
Table 26.5.3-3 of the Comprehensive Zoning Ordinance to require
conformity with any current applicable standards, and the City granted
a'variance to-Pabco for the parcel located at 4462 Pacific Boulevard on
August 17, 2009, Resolution No: 10,039, from the restriction contained
in Section 26.5.3-1(d) of the Comprehensive Zoning Ordinance, requiring
no decrease in parking capacity of an already non -conforming Lot.
SECTION 4: The request for a lot line adjustment dated
May 19, 2009, to adjust the property lines of parcels "A" and "Bn.
described in the attached Exhibit A, whereby said adjustment will.
change the property lines to the described parcels "A" and "B" in the
attached Exhibit B is hereby approved in accordance with the
recommendation of Samuel Kevin Wilson, Director of Community Services &.
Water, subject to the condition contained in Section 6 below.
SECTION 5: The request to amend the Covenant and Agreement
to Hold Two Separate Parcels of Real Property (currently located at
4460 Pacific Boulevard and 4462 Pacific Boulevard) as One Parcel for
the purposes of satisfying previous City Code parking requirements is
hereby approved, subject to the condition contained in Section 6 below.
SECTION 6: The lot line adjustment is approved subject to
the following condition:

a. Concurrently with the recordation of a deed implementing
the proposed lot line adjustment, an amended covenant, satisfactory in
form and content to the Director of Community Services and Water and
the City Attorney, shall be recorded in the Los Angeles County
Recorder's Office which holds the properties located at 4462 Pacific
Boulevard (as adjusted) and 4460 Pacific Boulevard, as one, in order to
continue to provide automobile parking for the use located at 4460
Pacific Boulevard. This amended covenant shall run with the land until
released by the City of Vernon:
SECTION 7: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
her certification to be entered in the Book of Resolutions of the
Council of this City.

Enclosed for your consideration are a Lot Line Adjustment application from L&D Real Estate
Holdings, LLC (L&D Real Estate) and Pabco Building Products, LLC (Pabco) and a Resolution for the
subject Lot Line Adjustment. L & D Real Estate Holdings is the -owner of land (Assessor's Parcel No.
6308-006-011) located at 2450 Vernon Avenue consisting of three parcels, and Pabco Building Products,
LLC., who is the owner of land (Assessor's. Parcel No. 6308-006-008) located at 4462 Pacific Boulevard
consisting of one parcel. The Lot Line Adjustment will adjust the common property lines of the two
parcels in which approximately 14,470 square feet of property will be transferred from Pabco to L&D
Real Estate. The Lot Line Adjustment will square off the L&D Real Estate parcel to allow for better
development of the site. The Pabco parcel will remain a small parking lot and a Covenant will be
recorded tying to the lot the property at 4460 Pacific. Boulevard for parking purposes.
As part of the Lot Line Adjustment, there will be a reduction in parking for the Pabco Building
Products facility which will require a variance. This Lot Line Adjustment shall only be approved if the
variance is granted to Pabco.
The lot line adjustment is categorically exempt from the California Environmental Quality Act,
based on a Class 5 Categorical Exemption (Section 15305 of the CEQA Guidelines), because the lot line
adjustment would not result in the creation of any new parcel, and there is no evidence that this
adjustment will create any environmental impact. A Notice of Exemption for this project will be filed
with the County Clerk of the County of Los Angeles.
The City Attorney's.office has reviewed and approved the Lot Line Adjustment Resolution.
I recommend that the Lot Line Adjustment be approved subject to the following condition:
a. Concurrently with the recordation of a deed implementing the proposed lot line
adjustment, an amended covenant, satisfactory in form and content to the Director of
Community Services and Water and the City Attorney, shall be recorded in the Los
Angeles County Recorder's Office which holds the properties located at 4462 Pacific
Boulevard (as adjusted) and 4460 Pacific Boulevard, as one, in order to continue to
provide automobile parking for the use located at 4460 Pacific Boulevard. This amended
covenant shall run with the land until released by the City of Vernon.

14 Boulevard, for purposes of satisfying previous City Code parking

16 WHEREAS, L&D Real Estate Holdings, LLC and Pabco
17 Building Products, LLC. have applied for a lot line adjustment
18 pursuant to Government Code Section 66412(d), which provides
19 that the Subdivision Map Act does not apply to the following;
20 (d) A lot line adjustment between four or fewer
21 existing adjoining parcels, where the land taken from
22 one parcel is added to an adjoining parcel, and where
23 a greater number of parcels than originally existed is
24 not thereby created, if the lot line adjustment is
25 approved by the local agency, or advisory agency...."

27 WHEREAS, Government Code Section 66412(d) permits a
28 local agency to impose conditions or exactions on its approval

of a lot line adjustment so long as they relate to a property's
conformity with the local general plan, any applicable coastal
plan, and zoning and building ordinances, or require the
prepayment of real property taxes prior to the approval of the
lot line adjustment, or facilitate the relocation of existing
utilities, infrastructure, or easements; and
WHEREAS, Section 28.2 of Chapter 28 of the City's Code
requires all lot line adjustments to conform to the City's
General Plan and the City's Comprehensive zoning Ordinance; and
WHEREAS, L&D Real Estate Holdings, LLC and Pabco
Building Products, LLC. formally submitted their lot line
adjustment on or about May 27, 2009; and
WHEREAS, Samuel Kevin Wilson, Director of Community
Services & Water, has recommended that said lot line adjustment
and related covenant amendment be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained herein
above are true,and correct.
SECTION 2: Pursuant to the California Environmental
Quality Act (CEQA), the lot line adjustment qualifies as a
Class 5 Categorical Exemption (Section 15305 of the CEQA
Guidelines) because the lot line adjustment would not result in
the creation of any new parcel, and there is no evidence that
this adjustment will create any environmental impact.
SECTION 3: The City Council of the City of Vernon, in
compliance with Section 28.2 of Chapter 28 of the City Code, and

Government Code Section 66412(d), hereby makes the following
findings:
a. The parcels that will result from the lot line
adjustment are consistent with the policies and goals of the
City's General Plan because the land use designations will not
be changed by the lot line adjustment.- Additionally this lot
line adjustment will continue to encourage industrial uses at
both parcels which is consistent with the policies in the
General Plan.
b. The parcels that will result from the lot line
adjustment are consistent with the City's Comprehensive Zoning
Ordinance because ,no triggering events are occurring as
described in Table 26.5.3-3 of the Comprehensive Zoning
Ordinance to require conformity with any current applicable
standards, and the City granted a variance to Pabco Building -
Products, LLC for the parcel located at 4462 Pacific Boulevard
on August , 2009, Resolution No. from the restriction
contained in Section 26.5.3-1(d) of the Comprehensive Zoning
Ordinance, requiring no decrease in parking capacity of an
already non -conforming Lot.
SECTION 4: The request for a lot line adjustment
dated XXXXXXXXX XX, 2009, to adjust the property lines of
parcels "A" and "B" described in the attached Exhibit"A",
whereby said adjustment will change the property lines to the
described parcels_ A// " „ " " and B in the attached Exhibit B is
hereby approved in accordance with the recommendation of Samuel
Kevin Wilson, Director of Community Services & Water, subject to
the condition contained in Section 6 below.

SECTION 5: The request to amend the Covenant and
Agreement to Hold Two Separate Parcels of Real Property
(currently located at 4460 Pacific Boulevard and 4462 Pacific
Boulevard) as One Parcel for the purposes of satisfying previous
City Code parking requirements is hereby approved, subject to
the condition contained in Section 6 below.
SECTION 6: The lot line adjustment is approved
subject to the following condition:

L & D Real Estate Holdings is the owner of land (Assessor's Parcel No. 6308-006-011) located at
2450 Vernon Avenue consisting of three parcels, and Pabco Building Products, LLC., who is the
owner of land (Assessor's Parcel No. 6308-006-008) located at 4462 Pacific Boulevard consisting of
one parcel. The Lot Line Adjustment will adjust the common property lines of the two parcels in
which approximately 14,470 square feet of property will be transferred from Pabco to L&D Real
Estate. The Lot Line Adjustment will square off the L&D Real Estate parcel to allow for better
development of the site. The Pabco parcel will remain a small parking lot and a Covenant will be
recorded tying to the lot the property at 4460 Pacific Boulevard for parking purposes.
