A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE SALE OF SURPLUS PROPERTY
FROM THE FOLLOWING DEPARTMENTS: COMMUNITY SERVICES
& WATER, FINANCE AND POLICE PURSUANT TO SECTION
2.31 OF THE VERNON CITY CODE
WHEREAS, pursuant to Vernon City Code Section 2.31 and
Government Code Section 37350, the City of Vernon may sell surplus
property for the common benefit; and
WHEREAS, the City Council of the City of Vernon desires to
declare the property from the following departments to be surplus to
the needs of the City of Vernon as said items are no longer used, have
been damaged, have become obsolete, or are in poor and irreparable
condition and are therefore no longer useful to the needs of.the City:
1. Community Services &.Water Department, more particularly
described on Exhibit A which is attached hereto and incorporated by
reference;
2. Finance Department, more particularly described
on Exhibit B which is attached hereto and incorporated by
preference;
3. Police Department, more particularly described on
Exhibit C which is attached hereto and incorporated by reference; and
WHEREAS, it is in the best interests of the City of Vernon
that the property described in the above -referenced Exhibits be sold as
surplus property pursuant to Section 2.31 of the Vernon City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
28 11 SECTION 1: The City Council of the City of Vernon hereby

finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: In accordance with Government Code Section 37350
and Section 2.31 of the Vernon City Code, the City Council of the City
of Vernon hereby finds and determines that the property described in
the attached Exhibits A, B, and C is surplus to the needs of the City
of Vernon.
SECTION 3: The Purchasing Agent is hereby authorized to
contract with an auction company, to obtain bids or to make other
arrangements for the sale of the property described in said Exhibits
as surplus property pursuant to Section 2.31 of the Vernon City Code.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
her certification to be entered in the Book of Resolutions of the
Council of this City.

Attached for your approval are Reports of Surplus Property from various departments listing
miscellaneous items that are damaged, obsolete or in poor condition. The Purchasing Section requests
approval to submit the items for auction or dispose of in the most economical manner.
Also included is report of Surplus from Police Department which lists 52 old Beretta 96G .40 caliber
pistols. The pistols are no longer in service and have been discontinued by the manufacturer. The
department is requesting sale of 43 of these units to ProForce Law Enforcement at a bid price of
$295.80 per handgun (price reduced if condition does not meet standard and/or if laser grip is
missing). Shipping cost is estimated at $466.00. Several vendors were contacted and ProForce was
the only interested bidder. A Bill of Sale will be issued for the transaction.
The department is also requesting the remaining 9 units be sold to some its Police Officers at the same
unit price of $295.80. A Hold Harmless and Waiver Agreement provided by the City Attorney's
Office will be signed by each officer purchasing a pistol.

Type "P" cabinet and controller. The equipment was purchased for the Los Angeles County Truck
Impacted Study project, however, was not used (would not work with our future traffic control
center). The department estimates the selling price at $15,000 to $16,000.00 and will seek quotes
from other interested cities upon surplus declaration. Thereafter, the department will submit buyer
recommendation to Council for approval.

SUBJECT: Surplus and Sale of Beretta Pistols
With the purchase of new Springfield handguns, we are prepared to move forward with the surplus and
sale of the old Beretta 96G .40 caliber pistols. The Beretta pistols are no longer being used by police
personnel and have been discontinued by the handgun manufacturer. The surplus and sale will include
the Crimson Trace Laser Grips and 3-magazines that are included with most of the pistols.
The following is a breakdown of the proposed surplus of Beretta pistols given that we have 58 in stock:
43- Beretta pistols will be sold to a designated gun vendor
9- Beretta pistols will be sold to Officers that have expressed an interest to purchase them
6-Beretta pistols will remain in stock and will be used for Simunition training
(We have barrel conversion kits for these handguns to use with simunition training cartridges)
Detective Docherty inquired with ProForce Law Enforcement for the sale of all available Beretta pistols
including the laser grips and magazines. ProForce Law Enforcement submitted a bid of $295.80, per
handgun, plus applicable California sales tax. ProForce will reduce the price for pistols that are not in the
stated condition and for handguns that do not include the laser grips. There are three pistols that do not
have the Crimson laser grips. Docherty will also need to provide a department letter indicating that the
pistols have been check by our armorer; the pistols are safe, complete and functional; and a listing of all
pistol serial numbers. The Department will be responsible for the shipping cost to ProForce in Arizona.
The shipping cost is estimated at approximately $466.00 (overnight shipping is recommended for
handguns).
The purchase price for Officers to buy the pistols from the department has been set at $295.80, which is
the bid price provided by ProForce Law Enforcement. Gunrunners, located in the City of Duarte will
conduct the required handgun transfer transaction for officers purchasing the pistols. Officers will be
responsible for the cost associated with the handgun transfer. Officers purchasing the pistols will also be
required to complete a hold harmless and waiver agreement provided by the City Attorney's Office. The
following is the list of Officers who have requested to buy the Beretta pistols:

I spoke with Debbie Nickens, from the City purchasing department about the planned surplus and sale of
Beretta pistols and related equipment. Debbie said a surplus property report should be completed to
document the disposition of the handguns and related equipment. Once the surplus report is approved and
forwarded to their office, they will process the necessary paperwork for the sale of handguns.
Given that we do not have a need for the Beretta 40 caliber handgun and related equipment, I recommend
that we move forward with the sale of handguns to ProForce Law Enforcement.

for surplus, and the hold harmless and waiver agreement provided by the City Attorney's Office.
