Resolution No. 2010-001RESOLUTION NO. 2010-01 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A LOT LINE ADJUSTMENT FOR THE PROPERTIES LOCATED AT 2200 55TH STREET AND 2001 57TH STREET IN THE CITY OF VERNON WHEREAS, the City of Vernon, a municipal corporation ("City") is the owner of one parcel of land (Assessor Parcel No. 6308- 017-906) located at 2200 55th Street and six parcels of land located at 2001 57th Street (Assessor Parcel No. 6308-017-907), both located in the City's I -zone, Industrial; and WHEREAS, the City proposes to adjust the lot lines of four of the seven parcels; and WHEREAS, the existing parcels that are proposed to be adjusted are described and shown on the attached Exhibit A consisting of three (3) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, the City desires to adjust the common boundary, between the parcel located at 2200 55th Street and three of the parcels at 2001 57th Street, whereby said adjustment will increase existing parcel 1 and slightly decrease the size of and merge existing parcels 2, 3, and 4, and create the properties as described and shown on the attached Exhibit B consisting of three (3) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, a lot line adjustment pursuant to Government Code Section 66412(d), which provides that the Subdivision Map Act does not apply to the following; "(d) A lot line adjustment between four or fewer existing adjoining parcels, where the land taken from one parcel is added to an adjoining parcel, and where a greater number of and parcels than originally existed is not thereby created, if the lot line adjustment is approved by the local agency, or advisory agency...." WHEREAS, Government Code Section 66412(d) permits a local agency to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the local general plan, any applicable coastal plan, and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and WHEREAS, Section 28.2 of Chapter 28 of the City's Code requires all lot line adjustments to conform to the City's General Plan and the City's Comprehensive Zoning Ordinance; and WHEREAS, the City intends to create Parcel A, as described in Exhibit B, that will be utilized for a municipal water well site that will be retained by the City that does not conform to the site planning standards imposed by Section 26.4.1-7(g) of the City's Zoning Code; and WHEREAS, under California State law and Bailey v. County of Los Angeles (1956) 46 Cal.2d 132, 140, a city may exempt itself from its own zoning regulations; and WHEREAS, Samuel Kevin Wilson, Director of Community Services & Water, has recommended that said lot line adjustment be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein -above are true and correct. -2- SECTION 2: The City Council of the City of Vernon hereby finds that the proposed project is categorically exempt based on a Class 5 Categorical Exemption (Section 15305 of the California Environmental Quality Act Guidelines) because the lot line adjustment is a minor alteration in a land use limitation in an area with an average slope of less than 20o that does not result in any changes in land use or density. The City Council hereby directs the City Clerk, or her designee, to file a Notice of Exemption for this project with the County Clerk of the County of Los Angeles. SECTION 3: The City Council of the City of Vernon, in compliance with Section 28.2 of Chapter 28 of the City Code, and Government Code Section 66412(d), hereby makes the following finding: a. The parcels that will result from the lot line adjustment are consistent with the policies and goals of the City's General Plan because the land use designations will not be changed by the lot line adjustment. Additionally this lot line adjustment will continue to encourage industrial and municipal uses at both parcels which is consistent with the policies in the General Plan. b. The parcels that will result from the lot line adjustment and that are owned by the City, are exempt from the City's own zoning regulations pursuant to California State law. SECTION 4: The lot line adjustment adjusting the property lines of parcels 1, 2, 3, and 4 described in the attached Exhibit A, whereby said adjustment will change the property lines to the described parcels A and B in the attached Exhibit B is hereby approved in accordance with the recommendation of Samuel Kevin Wilson, Director of Community Services & Water. -3- SECTION 5: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. The City is proposing to sell the property to C.R. Laurence Company, Inc. but would like to retain a small portion of the property for a well site. Smurfit Stone operated two water wells on the site to provide water for its industrial use. Staff is proposing to convert one of these wells into a potable water well for the City's distribution system. The other well will be sold with the property for C.R. Laurence's use and/or for destruction as part of their development. In order for the City to have proper access to the water well the site boundaries of the existing parcels of land must be adjusted. The City will retain approximately 0.32 acres for the well site. The remaining 10.93 acres will be sold to C.R. Laurence Company, Inc. In addition to creating a well site, the City intends to merge two land locked parcels (see enclosed drawings of existing and proposed parcels prior to and after adjustment). The lot line adjustment is categorically exempt from the California Environmental Quality Act based on a Class 5 Categorical Exemption (Section 15305 of the CEQA Guidelines) because the lot line adjustment would not result in the creation of any new parcel and there is no evidence that this adjustment will create any environmental impact. Laurence Co., Inc. ("CR Laurence"), a prospective buyer of the majority of the Properties, has requested that the lot line adjustment as approved by Resolution No. 2010-01 be modified to allow for better truck maneuvering; and WHEREAS, the lot line adjustment approved by the City of Vernon pursuant to Resolution No. 2010-01 has not been recorded by the County Recorder, and by memo dated February 4, 2010, the Director of Community Services & Water has requested that the lot line adjustment approved by Resolution No. 2010-01 be modified; and WHEREAS, in order to effectuate this modification, Resolution No. 2010-01 will need to be rescinded and a new lot line adjustment resolution adopted; and WHEREAS, the City proposes to adjust the lot lines of four of the seven parcels; and WHEREAS, the existing parcels that are proposed to be adjusted are described and shown on the attached Exhibit A consisting of three (3) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, the City desires to adjust the common boundary, between the parcel located at 2200 55th Street and three of the parcels at 2001 57th Street, whereby said adjustment will increase existing parcel 1 and slightly decrease the size of and merge existing parcels 2, 3, and 4, and create the properties as described and shown on the attached Exhibit B consisting of three (3) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, a lot line adjustment pursuant to Government Code Section 66412(d), which provides that the Subdivision Map Act does not apply to the following; "(d) A lot line adjustment between four or fewer existing adjoining parcels, where the land taken from one parcel is added to an adjoining parcel, and where a greater number of parcels than originally existed is not thereby created, if the lot line adjustment is approved by the local agency, or advisory agency...." and WHEREAS, Government Code Section 66412(d) permits a local agency to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the local general plan, any applicable coastal plan, and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and -2- WHEREAS, Section 28.2 of Chapter 28 of the City's Code requires all lot line adjustments to conform to the City's General Plan and the City's Comprehensive Zoning Ordinance; and WHEREAS, the City intends to create Parcel A, as described in Exhibit B, that will be utilized for a municipal water well site that will be retained by the City that does not conform to the site planning standards imposed by Section 26.4.1-7(g) of the City's Zoning Code; and WHEREAS, under California State law and Bailey v. County of Los Angeles (1956) 46 Cal.2d 132, 140, a city may exempt itself from its own zoning regulations; and WHEREAS, Samuel Kevin Wilson, Director of Community Services & Water, has recommended that Resolution No. 2010-01 be rescinded and a new lot line adjustment be approved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein -above are true and correct. SECTION 2: The City Council of the City of Vernon hereby rescinds Resolution No. 2010-01 in its entirety and to be superseded by this Resolution. SECTION 3: The City Council of the City of Vernon hereby finds that the proposed project is categorically exempt based on a Class 5 Categorical Exemption (Section 15305 of the California Environmental Quality Act Guidelines) because the lot line adjustment is a minor alteration in a land use limitation in an area with an average slope of less than 20% that does not result in any changes in land use or density. The City Council hereby directs the City Clerk, -3- or her designee, to file a Notice of Exemption for this project with the County Clerk of the County of Los Angeles. SECTION 4: The City Council of the City of Vernon, in compliance with Section 28.2 of Chapter 28 of the City Code, and Government Code Section 66412(d), hereby makes the following finding: a. The parcels that will result from the lot line adjustment are consistent with the policies and goals of the City's General Plan because the land use designations will not be changed by the lot line adjustment. Additionally this lot line adjustment will continue to encourage industrial and municipal uses at both parcels, which is consistent with the policies in the General Plan. b. The parcels that will result from the lot line adjustment and that are owned by the City, are exempt from the City's own zoning regulations pursuant to California State law.
