RESOLUTION NO. 2010-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING FINAL PARCEL MAP NO. 68243 TO L.A. BEAR, LLC TO SUBDIVIDE 10.7 ACRES LOCATED AT 3200 WASHINGTON BOULEVARD, APPROVING THE GRANT DEED AND ELECTRICAL EASEMENT DEED IN ACCORDANCE WITH THE PARCEL MAP, AND APPROVING AND AUTHORIZING THE EXECUTION OF A CERTIFICATE_ OF ACCEPTANCE IN RELATION THERETO WHEREAS, Dynamic Builders applied for a tentative parcel map, on behalf of the property owner of 3200 Washington Boulevard, L.A. Bear, LLC (collectively the "Applicant"); and WHEREAS, on October 19, 2009, the City Council of the City of Vernon approved Resolution No. 10,082 granting Tentative Parcel Map No. 68243 ("Parcel Map") to Applicant; and WHEREAS, the Parcel Map proposed to subdivide one parcel consisting of 10.7 acres located at 3200 Washington Boulevard in the City,of Vernon (the "Project Site") into three parcels (the "Project"), subject to six (6) conditions which include the Applicant (a) providing an electrical easement for all future electrical lines and facilities that will be dedicated to serve power to any proposed buildings on the Project Site; and (b) dedicating to the City a strip of land adjoining the subject parcels in order to widen Washington Boulevard in accordance with the City's Master Plan of Streets; and WHEREAS, the Applicant has completed all of the required Conditions as part of the Parcel Map approval; and WHEREAS, the Project is consistent with the Vernon General Plan as adopted by the City of Vernon, the State Subdivision Map Act, and is exempt from the State of California Environmental Quality Act; and WHEREAS, as part of the Parcel Map approval process, by Resolution No. 10,082, it was determined that the Project (a) was categorically exempt from the California Environmental Quality Act pursuant to Guideline 15315 as it is a minor land division of property into three parcels located in an urbanized area that is zoned for industrial uses and is in conformance with the zoning code and general plan; (b) was not involved in a division within the previous two (2) years; and (c) does not have an average slope greater than twenty percent (20%); and WHEREAS, all conditions set upon the Parcel Map have been met; and WHEREAS, Applicant has submitted for approval by the City Council of the City of Vernon a Final Parcel Map No. 68243 ("Final Parcel Map"), an Easement Grant Deed ("Easement Deed") for the installation and maintenance of Light & Power's underground electrical system that feeds the various buildings on the Project Site and a Grant Deed dedicating to the City a portion of property, approximately 6,028 square feet in size located on the South side of Washington Boulevard west of Downey Road, Assessor's Parcel Nos. 5169-023-025, 5169,023-026 and 5169-023-027 (the "Grant Deed"),.to be used by the City to increase the width of the right-of-way; and WHEREAS, by letter dated December 10, 2009, the County of Los Angeles, Department of Public Works, has checked and approved the Parcel Map for mathematical accuracy, survey analysis, title information and compliance with the Subdivision Map Act; and - 2 - WHEREAS, the Director of Community Services & Water recommends that the Final Parcel Map be approved, the Easement Deed and the Grant Deed be accepted and the Certificate of Acceptance be approved and executed; and WHEREAS, the City Council has received Staff Reports dated January 6, 2010, upon which it has relied on making the foregoing recitals. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein above are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves the Final Parcel Map.No. 68243 submitted by the Applicant to subdivide 10.7 acres located at 3200 Washington Boulevard. SECTION 3: The City Council of the City of Vernon hereby approves and accepts the Easement Deed and Grant Deed and hereby authorizes the Mayor or Mayor Pro-Tem to execute the Certificate of Acceptance for, and on behalf of,' the City of Vernon and the City Clerk or,Deputy City Clerk are hereby authorized to attest thereto in accordance with the Parcel Map. SECTION 4: The City Council of the City of Vernon hereby authorizes the Director of Community Services & Water, or his designee, to submit the Final Parcel Map to the Land Development Division, Subdivision Mapping Section, of the County of Los Angeles Registrar-Recorder/County Clerk's office for filing. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and - 3 - the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Applicant is required to regrade the Project site to ensure that drainage from all three proposed parcels drains independently into the storm drain on Washington Boulevard. Surface drainage shall not cross property lines or onto the railroad right-of-way. Applicant shall ensure that all drainage is treated in accordance with NPDES Standards before entering the public right-of-way. Prior to grading, Applicant will be required to implement a Storm Water Pollution Prevention Plan. During grading, Applicant shall ensure frequent watering of the soil on the Project site, to the satisfaction of the Building Director, and in accordance with South Coast Air Quality Management District standards. b. Applicant shall independently serve each parcel on the Project site with utilities, unless utility easements are provided. Applicant is required to completely remove any abandoned utilities and utility vaults within the area of Washington Boulevard that adjoins the Project site. d. Applicant is required to re -stripe Washington Boulevard to provide a two-way left turn center median along the Project site frontage as required by the City Engineer. e. Applicant is required to provide an electrical easement for all future electrical lines and facilities that will be dedicated to serve power to any proposed buildings to be located on the Project site. f.
