Resolution No. 2010-025RESOLUTION NO. 2010-25 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITIONAL USE PERMIT FOR IT JEANS, INC. AND BLUE BANNER, LLC TO REMODEL, REFURBISH AND OPERATE A RETAIL, WHOLESALE AND COMMERCIAL FACILITY LOCATED AT 5201 SANTA FE AVENUE WHEREAS, It Jeans, Inc. on behalf of the property owner of 5201 Santa Fe Avenue, Blue Banner, LLC (collectively, the "Applicant") has applied for a conditional use permit ("CUP") to remodel and refurbish approximately 9,751 square feet of an existing two-story building and operate a retail, wholesale and commercial facility, including a sit-down restaurant with patio, a take-out restaurant, and other retail and wholesale uses located at 5201 Santa Fe Avenue in the City of Vernon (the "Project"); and WHEREAS, the City Council of the City of Vernon held a hearing on the application for a CUP on February 22, 2010; and WHEREAS, the Project is located in the (C) Overlay District of the I -Zone, Industrial; and WHEREAS, retail and commercial uses are generally permitted in the (C) Overlay District of the I -Zone with a CUP; and WHEREAS, City staff has determined that the Project is categorically exempt from the California Environmental Quality Act ("CEQA") pursuant to CEQA Guideline 15302, Class 2, replacement or reconstruction; and WHEREAS, the City Council has received a Staff Report, dated February 2, 2010, upon which it has relied in making the foregoing recitals. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon further finds that all persons have had the opportunity to be heard or to file written comments to the proposed Project and after due consideration of all the evidence submitted at the public hearing determines that there are compelling reasons to justify granting a CUP. SECTION 3: The City Council of the City of Vernon hereby finds that the Project is categorically exempt from the California Environmental Quality Act pursuant to CEQA Guideline 15302, Class 2, as it involves the reconstruction of an existing structure that will have substantially the same purpose of restaurant/retail as the previous retail use of the existing building, and will also have the same capacity as the previous retail use. SECTION 4: The custodian of records for the Project and all other material that constitute the record of proceedings upon which the City Council's decision is based is the City Clerk of .the City of Vernon. Those documents are available for public review in the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon, California 90058. SECTION 5: Subject to the conditions set forth below, the City Council hereby approves the CUP and the CUP is hereby granted to the Applicant for the Project based on the following findings as required by Section 26.6.3-4 of the Vernon City Code: a. The lot for the proposed use is adequate in size, shape, and topography as (i) the Project involves the remodel and refurbishment of an existing two-story building to provide a retail, M wholesale and commercial development; (ii) the conditions imposed will ensure that the site is developed appropriately for its size, shape and topography; and (iii) the site has adequate drainage, and landscaping that will be installed pursuant to the Vernon City Code. b. The proposed use will not adversely affect the interest of the public or the interests of other residents and property owners in the vicinity of the Project because the site is preexisting and has not been vacant for a continuous period of more than two years and will continue to be used for the same purposes. The Project is surrounded by industrial, retail and commercial uses compatible with the proposed use and no significant environmental effects from this use are anticipated. C. The retail, wholesale and commercial development will be compatible with other permitted uses of surrounding and adjacent properties in the (C) Overlay District of the I -Zone of the City as the Applicant's proposed use is allowed in this zone with a conditional use permit. d. The lot has adequate off-street parking and loading facilities for this proposed use, as the Project site will be supported by.a 100-stall surface parking lot, which will include an estimated forty-four (44) automobile parking spaces for the proposed retail, wholesale and commercial development and fifty-six (56) parking spaces for the existing three-story industrial building, which is consistent with applicable development standards. With the conditions imposed, all parking activities will be maintained within the Applicant's premises and loading facilities will be adequate and will not interfere with customer parking, and the proposed use will not create an impact on neighboring properties. The site will be paved with an impermeable surface that meets City of Vernon applicable development standards. e. The use as to location, operation and design, is consistent with Vernon Zoning Code and General Plan with the conditions imposed, and is an allowed use as the Project will be supportive of industry. f. The proposed use is consistent with all applicable local, county, state and federal laws, rules and regulations as conditioned below. g. The proposed use will not adversely affect the general welfare, as conditioned below, as a result of noise, increased traffic, interference with flow of traffic, dust, or other undesirable characteristics. The Project has access to Santa Fe Avenue and 52nd Street and traffic will generally travel on both Santa Fe Avenue and 52nd Street to the retail and commercial uses, and Santa Fe Avenue and 52nd Street is of adequate size and pavement type to handle the traffic generated from the proposed operation. The traffic operations in the area will not be adversely effected by the moderate increase in traffic volumes generated by the Project, as such increase will take place outside of peak traffic hours. Motorists using the surrounding street system will not experience major changes in traffic operations. Additionally, various conditions are imposed to ensure the project does not cause excess noise or impede traffic flow. h. All of the conditions imposed on the Project are necessary to protect the public health, safety and general welfare and will adequately protect the public health, safety and general welfare. SECTION 6: In order to adequately protect the public health and general welfare the following conditions are required: 0 a. The Applicant shall operate the Project in accordance with all current codes, rules and regulations including any required fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. b. The Applicant shall ensure that all parking and loading areas are striped in a manner acceptable to the Director of Community Services & Water and are paved with a hard durable surface material and adequately drain, and are kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be installed and maintained to meet City standards. c. The Applicant shall obtain a sales tax permit from the State Board of Equalization bearing the City of Vernon Tax number and a City of Vernon business license prior to the occupancy of any business conducting sales on the Project site. d. The Applicant shall obtain all required federal, state, local and regulatory agency permits prior to operation. Prior to occupancy, a business license, occupancy permit and health permit shall be obtained by the Applicant. The Project shall meet the minimum construction requirements for food facilities prior to opening. e. The Applicant shall operate the Project in a manner that will not impede traffic on Santa Fe Avenue or 52nd Street. The Applicant shall ensure that all vehicles enter and exit the site in a front forward manner. No maneuvering or vehicle parking associated with the Project shall take place offsite or on the public street without prior approval from the Community Services Department. If at anytime, it is determined by the 5 Director of Community Services & Water that the parking provided on -site does not meet the Project's parking demands, upon 60 days written notice, and at the end of the 60 days, the Applicant shall be required to either provide a valet service, or provide additional off -site parking to meet the Project's demands. The Director of Community Services & Water retains authority to determine whether the valet service, or additional off -site parking adequately meets the Project's parking demands, and the Applicant shall cooperatively work with the Director of Community Services & Water to ensure adequate parking options for the Project's parking demands. f. Prior to construction, the Applicant shall dedicate to the City by grant deed, property for the enlargement of the curb return at the southwest corner of 52ndStreet and Santa Fe Avenue to provide for 52 feet of property line radius. The Grant Deed, legal description and maps shall be in a form satisfactory to the Director of Community Services & Water and the City Attorney. Once approved by Director of Community Services & Water and the City Attorney, the aforementioned documents shall be accepted by the City and recorded. g. Prior to occupancy, the Applicant shall ensure the curb return at the southwest corner of Santa Fe Avenue and 52ndStreet is enlarged to 60 feet radius and 52 feet property line radius. Applicant shall, prior to occupancy, complete the 'following: (i) The curb, gutter, sidewalk and necessary roadway at the intersection of Santa Fe Avenue and 52nd Street shall be removed and replaced in accordance with the Master Plan of City Streets; (ii) A curb ramp shall be constructed as part of the 0 curb ramp improvement; (iii) Any objects including but not limited to trees, power poles, traffic signals, signs and fire hydrants, that conflict with proposed improvements shall be removed or relocated by the Applicant at their expense; and (iv) Street striping shall be removed and replaced in accordance with the street improvements. Applicant shall complete all subject work in accordance with City Standards and to the satisfaction of the Director of Community Services and Water. h. The Applicant shall widen the main driveway on 52nd Street to 40 feet in the flat. i. Prior to occupancy, the Applicant shall upgrade the electrical panel and service to 5201 Santa Fe Avenue to meet current state and city regulations. In addition, if relocation of the existing power pole located in the parking area is needed, Applicant shall relocate the power pole and perform all related work in accordance with City Standards, to the satisfaction of the Director of Community Services and Water and shall be at the Applicant's sole cost. j. The Applicant shall construct and maintain the site substantially in compliance with the site plan submitted as part of this CUP application. k. The Applicant shall provide adequate trash receptacles for the public on -site to keep litter to a minimum. The Applicant shall maintain the trash area in an effort to divert rainfall around the enclosure. The Applicant shall ensure that all litter blown or dropped'on the site is retrieved and containerized on a daily basis. All trash containers shall 7 have tight fitting lids. The Applicant shall remove the trash in the containers as frequently as necessary to prevent overflow, but no less frequent than once per week. The Applicant shall implement a litter control program to maintain the Project in a safe, sanitary and attractive condition for the life of the Project. 1. The Applicant shall provide an appropriate storage area for waste cooking oil/grease. If the storage area is located outside of the building, the Applicant shall protect the area from rain by installing an approved overhead cover. m. The Applicant shall not allow illicit discharges to enter the storm drain system including but not limited to the oils or grease or wash water from floor mats, floors, porches, parking lots, alleys, sidewalk or liter from garbage/trash containers. n. All food preparation and storage equipment shall be installed within the restaurant or dining facilities and shall be certified by an American National Safety Institute (ANSI) accredited program to applicable ANSI/National Sanitation Foundation International (NSFI) standards or approved by the Health Department prior to installation and use. The Applicant shall comply at all times with the following: (i) All washing/steam cleaning of equipment and accessories areas shall be self-contained and equipped with a grease trap and properly connected to a sanitary sewer; (ii) All wash areas located outdoors, must be covered, paved, have secondary containment and be connected to the sanitary sewer; and (iii) Grease interceptor shall be installed and maintained. o. The Applicant shall ensure that the restaurant complies with all the applicable California Health and Safety codes, laws and regulations. Adequate areas for proper food storage, equipment, employee restrooms, changing rooms (locker room) and storage must be provided by the Applicant. p. The Applicant shall ensure that all the Project buildings are structurally maintained to exclude rodents and are maintained rodent free. The Applicant shall ensure that adequate drainage is maintained to eliminate potential mosquito harborage. q. The Applicant shall ensure that no servicing or repairing of vehicles is permitted on the premises. No inoperative vehicles shall be stored on -site. All vehicles operated at the facility shall be tuned and maintained in accordance with applicable emission standards. r. No equipment or freight shall be stored on the site other than in buildings (outside storage is prohibited). Outdoor display of merchandise shall be prohibited. s. The site at 5201 Santa Fe Avenue shall be limited to 2,279 square feet of sit-down restaurant space including an outdoor dining area, 325 square feet of take-out restaurant space, 3,419 square feet of retail/wholesale store, 671 square feet of utilities space. The second floor shall be limited to 3,057 square feet of storage area. The Director of Community Services & water may allow the restaurant area within the Project to be expanded beyond the above limits if it is found that sufficient onsite parking is available to support such a use. t. The Applicant's hours and days of operation of retail and restaurant shall be limited to 7:00 a.m. to 7:OO p.m. Monday 0 thru Saturday. u. The Applicant's employees serving or selling alcohol shall complete Licensee Education of Alcohol and Drugs ("LEAD") training offered by the State of California Office of Alcohol and Beverage Control. Evidence of completion shall be provided to City Staff upon request. Alcohol sales shall be limited to beer and wine. v. No entertainment uses are approved as part of this conditional use permit and the Applicant is prohibited from allowing entertainment uses on site, including but not limited to, dance floors, disc jockeys and live performances. w. All on -site construction or improvements shall be in compliance with the most current Building Codes (Building, Fire, Mechanical, Plumbing and Electrical) and current Health and Safety Codes and Regulations. The Applicant shall obtain all necessary building, fire, mechanical, plumbing and electrical permits from the City of Vernon Community Services Department in addition to any required Vernon Environmental Health Department clearance prior to commencement of construction. X. The Applicant shall ensure that all trucks entering the site to deliver and unload products to the proposed retail.and restaurant facility are limited to the hours of 5:00 a.m. and 7:00 a.m. (before opening hours). SECTION 7: The Applicant and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from 10 the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 8: Noncompliance with any condition set forth in the CUP shall be grounds for voiding the permit pursuant to Section 26.6.3-9 of the Comprehensive Zoning Ordinance. SECTION 9: Not later than sixty (60) days from the date of this Resolution, the Applicant shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 6 of this Resolution and the indemnification provision contained in Section 7 of the Resolution. The CUP shall be void and of no force or effect unless such written acceptance and agreement is submitted to the City within the sixty-day period, unless an extension of that sixty-day period is granted by the Director of Community Services & Water. 11 SECTION 10: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. The proposed project site is located in the City's Commercial (C) Overlay District of the Industrial (1) zone. The proposed project will entail the remodeling and refurbishing of approximately 9,751 square feet of an existing two-story building, that is approximately 13,096 square feet in total size to provide a retail/wholesale and commercial development (the "Project"). THE PROJECT The proposed Project will entail the remodeling and refurbishing of approximately 9,751 square feet of an existing two-story building that is 13,096 square feet in total size, to provide a retail/wholesale and commercial development. The proposed project will consist of 2,279 square feet of sit-down restaurant, which includes an outdoor patio area (approx. 1,012 square feet), 325 square feet of take-out restaurant, 3,419 square feet of retail/wholesale uses, 352 square feet of utility space and 671 square feet restrooms, and 3,057 square feet of storage area (located on the 2nd floor). The Applicant has indicated that 2,625 square feet of the 2„d floor will remain vacant, along with a 720 square foot basement area. The site was last occupied by AWAD Home Fashions, Inc which used the facility for wholesale and retail of towels, blankets, comforters, quilts, and curtains. The Project will operate from 7:00 a.m. to 7:00 p.m. six days a week, Monday through Saturday. The Applicant has requested the center be allowed to serve and sell alcohol (beer and wine). -i-1Z, A� FEB 1 g 2010 BY: Ur %'A131 The Applicant plans to serve wine and beer as part of the sit-down restaurant and sell bottled wine as part their retail business. As previously mentioned, the proposed site is comprised of two existing buildings located on the same parcel, the adjoining building to the south is identified by the address 5251 Santa Fe Avenue, and is approximately 55,203 square feet, and is currently used for manufacturing and warehousing. The Applicant is a denim/jeans manufacturer and distributor, who sell to companies throughout the United States (Nordstrom, Macy's, Von Maur, and The Buckle). There are two driveways that currently access the site, one located along Santa Fe Avenue and the other one along 52" d Street. As part of the development of the property site, the driveway located on Santa Fe Avenue will be closed -off in order to provide outside dining (patio area), while the other driveway located on 52nd Street will be widened. Trucks and automobiles accessing the site will share the driveway along 52nd Street. 52" d Street is of adequate size and pavement type to handle the traffic generated from the proposed operation. ZONING AND GENERAL PLAN The proposed Project will be consistent with the City of Vernon's Zoning Ordinance upon the approval of a Conditional Use Permit. Section 26.4.2-3(a) & (b) of the Comprehensive Zoning Ordinance states that retail and commercial uses may be permitted in the (C) Overlay District of the I -Zone with a conditional use permit. The subject site is located in the (C) Overlay District of the I - Zone, Industrial, and the Applicant has applied for a conditional use permit. In addition to meeting the conditional use permit requirements in the Code, the Applicant will also meet the development standards of the Zoning Code, including the parking, maneuvering, and loading requirements. Specifically, the Community Services Department has set forth parking requirements based, in part, on the type of use to which the building is being put. Sit Down Restaurant 10.1 stalls per 1000 square feet Take -Out Restaurant 8.2 stalls per 1,000 square feet Retail (Strip Mall) 4.1 stalls per 1,000 square feet Utility Space (restrooms, storage, etc.) 1 space per 1,000 square feet Industrial and manufacturing uses, warehouses, wholesale uses, and similar uses 1 space per 1,000 square feet The subject site will be supported by a 100 stall surface parking lot. Forty-four of those parking stalls will be assigned for the retail/wholesale and commercial development The remaining 56 parking spaces will be assigned to the existing warehouse and manufacturing building. Based on the proposed Project, the amount of parking spaces required is 44, and the Applicant will be providing 44 parking spaces. The parking layout meets the minimum parking requirements for a sit-down and take- -2- out restaurant and retail center. It is anticipated that no overflow parking onto adjacent side streets - will occur. However, if at anytime the Applicant needs additional parking spaces beyond the number provided, a condition will be placed on the conditional use permit requiring the Applicant to provide adequate parking via valet service approved by the Director of Community Services. Consequently, the proposed Project will not adversely affect the interest of the public in the vicinity of the premises, and will comply with the Zoning Code. Finally, the adjoining building to the south (5251 Santa Fe Avenue) was built with one non- conforming truck -loading space and one conforming truck -loading space. The owner has stated that it plans to use smaller trucks at the non -conforming loading dock and will use the conforming dock for its larger trucks. Trucks accessing the new development to deliver product and supplies will occur during the early morning hours (before opening hours). Deliveries will be by hand truck directly from the parking lot. Although no triggering event is occurring as detailed in Table 26.5.3-3 of the Zoning Code to require that this loading dock conform to the current code standards, based on the City's concern with the potential adverse effects from trucks unloading product during open hours, city staff is recommending that the hours of truck unloading be limited to 5:00 a.m. to 7:00 a.m. Monday through Saturday, and this will be made a condition of approval. The proposed Project will also be consistent with the City's General Plan upon the approval of the Conditional Use Permit. In accordance with the City of Vernon General Plan commercial uses are intended to serve industry uses and its employees and are considered a secondary land use within the City. Specifically, Policy LU-1.2 of the General Plan states, "Permit only those non- industrial uses, such as commercial and retail uses, which are necessary to support industry, and its employees..." Additionally, Policy LU-1.2 states to limit such uses to the commercial overlay district, and permit only with a Conditional Use Permit". Thus, with the approval of a conditional use permit, the proposed Project will be consistent with Policy LU-1.2 and the City's General Plan. PROJECT SITE The proposed site is comprised of two existing buildings located on the same parcel. The building to the south is approximately 55,203 square feet, and is currently used for manufacturing and warehousing. The building to the north is the location of the proposed project. The proposed site will be supported by a 100 stall surface parking lot. 44 of those parking stalls will be assigned for the retail/wholesale and commercial development. The proposed site shall be paved with an impermeable surface that meets City of Vernon standards. City staff has determined that the proposed site and development of the property is consistent with the applicable development standards. The commercial/retail facilities are expected to generate more than 100 vehicle trips on a typical weekday. Most of the vehicular traffic at the retail/restaurant facility will occur around the noon hour. Trucks that will deliver/pick-up product and supplies to the proposed site will occur during the early morning hour (before opening hours). Peak traffic hours for the streets in the vicinity occur in the early morning and late afternoon. The restaurant's heavy traffic periods will not coincide with the peak hours of street traffic. The traffic operations in the area will not be adversely effected by the -3- moderate increase in traffic volumes generated by the proposed project. Motorists using the surrounding street system will not experience major changes in traffic operations due the traffic generated by the proposed development. CEQA DETERMINATION AND ENVIRONMENTAL CONSIDERATIONS The proposed Project is in the (C) Overlay District of the I -Zone. The uses in the surrounding and adjacent properties include retail, office, commercial, warehouse, wholesale, and general industrial uses and are compatible with the proposed operation. No adverse impacts from traffic, parking, noise, odor, dust, smoke, light or glare, or risk of fire, infection or explosion are expected to occur to the adjacent or abutting properties. Therefore, pursuant to Section 15302, Class 2, of the California Environmental Quality Act, this Project is exempt from CEQA, because the Project consists of the reconstruction of an existing structure that will have substantially the same purpose of restaurant/retail as the previous retail use of the existing building, and will also have the same capacity of the previous retail at the proposed Project site. STATE OR FEDERAL CONDITIONS All Federal, State, and local regulatory permits shall be obtained as required for the operation. STAFF FINDINGS AND CONDITIONS The conditional use permit shall be granted based on the following findings and conditions as required by Section 26.6.3-4 of the Vernon Zoning Code: a. The lot for the proposed use is adequate in size, shape, and topography as (i) the Project involves the remodel and refurbishment of an existing two-story building to provide a retail, wholesale and commercial development; (ii) the conditions imposed will ensure that the site is developed appropriately for its size, shape and topography; and (iii) the site has adequate drainage, and landscaping that will be installed pursuant to the Vernon City Code. b. The proposed use will not adversely affect the interest of the public or the interests of other residents and property owners in the vicinity of the Project because the site is preexisting and has not been vacant for a continuous period of more than two years and will continue to be used for the same purposes. The Project is surrounded by industrial, retail and commercial uses compatible with the proposed use and no significant environmental effects from this use are anticipated. C. The retail, wholesale and commercial development will be compatible with other permitted uses of surrounding and adjacent properties in the (C) Overlay District of the I -Zone of the City as the Applicant's proposed use is allowed in this zone with a conditional use permit. d. The lot has adequate off-street parking and loading facilities for this proposed use, as the Project site will be supported by a 100-stall surface parking lot, which will include an estimated forty-four (44) automobile parking spaces for the proposed retail, wholesale and -4- commercial development and fifty-six (56) parking spaces for the existing three-story industrial building, which is consistent with applicable development standards. With the conditions imposed, all parking activities will be maintained within the Applicant's premises and loading facilities will be adequate and will not interfere with customer parking, and the proposed use will not create an impact on neighboring properties. The site will be paved with an impermeable surface that meets City of Vernon applicable development standards. e. The use as to location, operation and design, is consistent with Vernon Zoning Code and General Plan with the conditions imposed, and is an allowed use as the Project will be supportive of industry. f. The proposed use is consistent with all applicable local, county, state and federal laws, rules and regulations as conditioned below. g. The proposed use will not adversely affect the general welfare, as conditioned below, as a result of noise, increased traffic, interference with flow of traffic, dust, or other undesirable characteristics. The Project has access to Santa Fe Avenue and 52nd Street and traffic will generally travel on both Santa Fe Avenue and 52nd Street to the retail and commercial uses, and Santa Fe Avenue and 52nd Street is of adequate size and pavement type to handle the traffic generated from the proposed operation. The traffic operations in the area will not be adversely effected by the moderate increase in traffic volumes generated by the Project, as such increase will take place outside of peak traffic hours. Motorists using the surrounding street system will not experience major changes in traffic operations. Additionally, various conditions are imposed to ensure the project does not cause excess noise or impede traffic flow. h. All of the conditions imposed on the Project are necessary to protect the public health, safety and general welfare and will adequately protect the public health, safety and general welfare. It is recommended that the following conditions be imposed to adequately protect the public health, safety and general welfare: CONDITIONS It is recommended that the following conditions be set on the permit. These conditions are deemed necessary to protect the public health, safety and general welfare: a. The Applicant shall operate the Project in accordance with all current codes, rules, and regulations including any required fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. b. The Applicant shall ensure that all parking and loading areas are striped in a manner acceptable to the Director of Community Services & Water and are paved with a hard durable surface material and adequately drain, and are kept free of dust, mud, trash and weeds. -5- Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be installed and maintained to meet City standards. C. The Applicant shall obtain a sales tax permit from the State Board of Equalization bearing the City of Vernon Tax number and a City of Vernon business license prior to the occupancy of any business conducting sales on the Project site. d. The Applicant shall obtain all required federal, state, local and regulatory agency permits prior to operation. Prior to occupancy, a business license, occupancy permit, and health permit shall be obtained by the Applicant. The Project shall meet the minimum construction requirements for food facilities prior to opening. e. The Applicant shall operate the Project in a manner that will not impede traffic on Santa Fe Avenue or 52"d Street. The Applicant shall ensure that all vehicles enter and exit the site in a front forward manner. No maneuvering or vehicle parking associated with the Project shall take place offsite or on the public street without prior approval from the Community Services Department. If at anytime, it is determined by the Director of Community Services & Water that the parking provided on -site does not meet the Project's parking demands, upon 60 days written notice, and at the end of the 60 days, the Applicant shall be required to either provide a valet service, or provide additional off -site parking to meet the Project's demands. The Director of Community Services & Water retains authority to determine whether the valet service, or additional off -site parking adequately meets the Project's parking demands, and the Applicant shall cooperatively work with the Director of Community Services & Water to ensure adequate parking options for the Project's parking demands. f. Prior to construction, the Applicant shall dedicate to the City bey grant deed, property for the enlargement of the curb return at the southwest corner of 52" Street and Santa Fe Avenue to provide for a 52-foot property line radius. The Grant Deed, legal description and maps shall be in a form satisfactory to the Director of Community Services & Water and the City Attorney. Once approved by Director of Community Services & Water and the City Attorney, the aforementioned documents shall be accepted by the City and recorded. g. Prior to occupancy, the Applicant shall ensure the curb return at the southwest corner of Santa Fe Avenue and 52" d Street is enlarged to a 60' foot radius and a 52' foot property line radius. Applicant shall, prior to occupancy, complete the following: (i) The curb, gutter, sidewalk and necessary roadway at the intersection of Santa Fe Avenue and 52"d Street shall be removed and replaced in accordance with the Master Plan of City Streets; (ii) A curb ramp shall be constructed as part of the curb ramp improvement; (iii) Any objects including but not limited to trees, power poles, traffic signals, signs and fire hydrants, that conflict with proposed improvements shall be removed or relocated by the Applicant at their expense; and (iv) Street striping shall be removed and replaced in accordance with the street improvements. The Applicant shall construct and maintain the site substantially in compliance with the site plan submitted as part of this CUP application. k. The Applicant shall provide adequate trash receptacles for the public on -site to keep litter to a minimum. The Applicant shall maintain the trash area in an effort to divert rainfall around the enclosure. The Applicant shall ensure that all litter blown or dropped on the site is retrieved and containerized on a daily basis. All trash containers shall have tight fitting lids.
