Resolution No. 2010-077RESOLUTION NO. 2010-77- - -- - - -- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROVIDING FOR THE APPROPRIATION OF THE CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM FUNDS RECEIVED FOR FISCAL YEAR 2009-2010 FOR FRONTLINE MUNICIPAL POLICE SERVICES WHEREAS, the State of California provides Citizens Option for Public Safety Program `("COPS Program") funding; and WHEREAS, -,the County of Los Angeles has established a Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061 of the Government Code to receive COPS Program funds which have been allocated for use in Los Angeles County; and WHEREAS, the City has established its own SLESF in - accordance with Section 30061 of the Government Code; and WHEREAS, the City's SLESF will receive One Hundred Thousand ($100,000.00) Dollars in COPS Program funds for fiscal year 2009-2010, which must be used to supplement existing frontline municipal police services; and WHEREAS, Section 30061(h) of the Government Code provides that funds received in any fiscal year be expended or encumbered no later than June 30 of the following fiscal year; and WHEREAS, by memo dated June 15, 2010, the Chief of Police has recommended that the Police Department be authorized to use the COPS Program funds received for fiscal year 2009-2010 and any interest in the SLESF account accumulated through June 30, 2011 (collectively, the "COPS Program - SLESF Funds"), to pay for two Vernon Service Officers (VSO) in fiscal year 2.010-2011 and any other unbudgeted expenses for frontline municipal police services; and WHEREAS, the City Council has conducted a public hearing to consider the funding request from the Chief of Police to use the COPS Program - SLESF Funds for frontline municipal police services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: .SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby directs that the City continue to maintain its own SLESF in accordance with California state law. SECTION 3: The City Council of the City of Vernon finds that all persons have had the opportunity to be heard or to file written'comments on the funding request from the Chief of Police , and after due consideration of any and all evidence submitted at the public hearing determines that there are compelling reasons to justify the expenditure of COPS Program - SLESF Funds to pay for the two VSO positions and any other unbudgeted expenses for frontline municipal police services and further finds that use of the funds in this manner will supplement, not supplant, existing frontline municipal police services. SECTION 4: The City Council of the City of Vernon hereby approves and authorizes the appropriation of COPS Program - SLESF Funds to pay for two Vernon Service Officers (VSO) in fiscal year 2010-2011 and to the extent there are any funds remaining, to pay for any other unbudgeted expenses for frontline municipal police services._ in fiscal year 20'10-2011. 2 SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or her designee, to deliver a copy of this Resolution to the appropriate person at the County of Los Angeles. SECTION 6: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. The Police Department is requesting authorization to use these funds to pay for two Vernon Service Officers (VSO) in FY 2010-2011. The VSOs are positions that the City would not have as part of its frontline municipal police services without the grant funding. Thus, the services provided by these VSOs supplement, and do not supplant, existing frontline municipal police services. Background: State Assembly Bill 1913 was enacted in fiscal year 2000-2001 to continue funding for the Citizens Option for Public Safety (COPS) Program ("COPS Program"), and has been modified from time to time by the legislature (e.g., State Senate Bill 823 in 2002). Annually, the state legislature has continued to provide COPS Program funds. The COPS Program allows eligible cities to receive a proportionate share of COPS Program funds. The grant funds are administered and distributed through the Chief Executive Office of Los Angeles County. The Police Department will be receiving $100,000.00 through the COPS Program for fiscal year 2009-2010 (FY09/10). The funds must be deposited into the City's Supplemental Law Enforcement Services Fund (SLESF) established pursuant to Section 30061 of the Government Code. The SLESF is a separate interest bearing fund to record the receipt and expenditures of the monies received. These funds must be used to supplement, and not supplant, existing "frontline municipal police services" being provided by the City. State law authorizes the City Council to use the funds provided by the COPS Program - both existing and anticipated moneys in accordance with the writte jr.q.0 �f t �,"e �. The request must be considered separate and apart from the process applicable to proposed allocations of the City's general fund. The Police Department has received COPS funds every year since 1996. Generally, the Police Department has used the funds to purchase equipment and support certain enforcement efforts. One example of this was the purchase of our motorcycles and related equipment and training. The Police Department was allotted $100,000 for FY 2009-2010. We anticipate the entire $100,000 to be received by July 2010. We anticipate using these funds to cover the salary costs for two Vernon Service Officers (VSO) in FY 2010-2011. Without these funds, we would not be able to retain the personnel to fill these two positions. The PD is requesting authorization to use these funds to cover outstanding personnel costs and/or unanticipated front-line police equipment/services. BACKGROUND This program allows eligible cities to receive a proportionate share of COPS funds appropriated by the State. The program began in fiscal year 1996-97 and continues to be funded. The Police Department has received $67,678.74 of the allocated COPS funds for fiscal year 2009-2010 (FY10). The remaining allocated funds of $32,321.26 will be distributed by July 2010. The use of these funds is limited to front-line law enforcement services. To date, none of the funds received have been spent. COPS funds received during fiscal year 2009-2010 must be expended or encumbered no later than June 30, 2010. Liquidation of the encumbered funds must be completed no later that June 30, 2012. All related purchases under this grant must be liquidated before the end of the liquidation date. The PD has participated in''the COPS grant process for several years. It can go as a consent item and then, if no one pulls it off the agenda, we have complied with the legislative intent.
