Resolution No. 2010-093RESOLUTION NO. 2010-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING THE EXECUTION OF TWO SEIZED PROPERTY CUSTODIAL AGREEMENTS WITH THE UNITED STATES MARSHALS SERVICE FOR A 2007 TOYOTA CAMRY AND A 2008 TOYOTA SEQUOIA WHEREAS, the Vernon Police Department ("Police Department") has a detective assigned to the Southwest Border Initiative ("SWBI") narcotics investigation taskforce which is operated by members of the Federal Bureau of Investigations ("FBI") and the Drug Enforcement Administration ("DEA"); and WHEREAS, as part of the investigation process, members of SWBI conduct asset forfeitures of property as a result of narcotic investigations; and WHEREAS, law enforcement agencies that assist in the federal forfeiture of property may receive equitable shares of federally forfeited assets; and WHEREAS, the United States Marshals Service ("USMS") has informed the City that the Police Department's request for the transfer of a 2007 Toyota Camry and a 2008 Toyota Sequoia (the "federally forfeited property") has been granted; and WHEREAS, by memo dated June 16, 2010, the Police Department has recommended that the City enter into seized property custodial agreements to allow the City to take possession of the federally forfeited property and complete the final forfeiture process. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby approves the Agreements, copies of which are attached hereto as Exhibit A. SECTION 3: The City Council of the City of Vernon hereby authorizes the Mayor or Mayor Pro-Tem to execute said Agreements for, and on behalf of, the City of Vernon and the City Clerk, or Deputy City Clerk, is hereby authorized to attest thereto. SECTION 4: The City Council of the City of Vernon hereby authorizes the City Administrator, or his designee, to take whatever actions are deemed necessary or desirable for the purpose of implementing and carrying out the purposes of this Resolution and the transactions herein approved or authorized. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or her.designee, to send fully executed Agreements to the United States Marshal Service. 2 SECTION 6: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Facts The Police Department (PD) has a Detective assigned to the Southwest Border Initiative (SWBI) narcotics investigation taskforce which is operated by members of the Federal Bureau of Investigation (FBI) and the Drug Enforcement Administration (DEA). As part of the investigation process, members of SWBI conduct asset forfeitures of property and/or monies seized as a result of narcotic investigations. Law enforcement agencies that assist in the federal forfeiture of property receive equitable shares of federally forfeited assets whether property and/or monies. In 2009, SWBI investigators seized two vehicles, a 2008 Toyota Sequoia and a 2007 Toyota Camry as part of the asset forfeiture process. The Vernon Detective assigned to these particular cases submitted the required paperwork to the Department of Justice (DOJ) seeking transfer of the federally forfeited vehicles. Both of these vehicles are currently being stored at a designated storage facility pending final forfeiture process. The two vehicles are in good condition and can be utilized for investigative purposes by sworn law enforcement personnel. In May 2010, the PD received notification from the United States Marshal's Service (USMS) advising that the request for the transfer of the federally forfeited property (vehicles) had been granted to the Vernon Police Department. In addition, the requested waiver of 20% federal share and investigative agency expenses has also been granted, thus eliminating the vehicle storage fees. l JUN 2 2 2010 Fl In order for the PD to take possession of both vehicles from the storage facility pending the final asset forfeiture process, a seized property custodial agreement provided by USMS must be reviewed and approved by City Council. Once the custodial agreements have been completed, the USMS office will complete the final forfeiture process which involves the completion of "certificate of title." The certification of title will allow for the transfer of title to the appropriate police agency. In order to reduce daily storage costs for both vehicles, USMS allows for the transfer of property (vehicles) pending the final forfeiture process. The USMS seized property custodial agreement form has been reviewed by the City Attorney's Office. Recommendation I request that the seized property custodial agreement forms be presented to City Council for approval. Once the forfeiture is complete, the PD will use one of the forfeiture vehicles to replace the vehicle currently in use by the Detective assigned to SWBI taskforce. The detective's vehicle has high mileage and is overdue for replacement. The second forfeiture vehicle will be assigned to the patrol division for investigative purposes. The PD will store both vehicles at the police facility pending the final forfeiture process. Fiscal Impact There are no costs associated with the transfer of the forfeiture vehicles. Any costs related to title transfers or vehicle maintenance will be covered with the PD federal asset forfeiture fund. The Vernon Police Department has a detectiveassigned to the SWBI. The vehicles include a 2008 Toyota Sequoia and a 2007 Toyota Camry. The Sequoia will be used by the SWBI detective and the Camry will be available to in-house detectives and patrol as a surveillance vehicle. The combined approximate value of the vehicles is between $45,00.0 and $59,000. The Vernon Police Department has worked closely with the USMS on the transfer of these vehicles resulting in the waiver of the 20% Federal share fees and storage fees. The only potential cost beyond maintenance is the certificate of title transfer fee. If necessary, this cost will be covered by the use of asset forfeiture funds. If approved, the Vernon Police Department would take immediate possession of the two vehicles and place them in storage here at the station until such time as the certificate of title can be transferred. The Police Department will be required to keep the vehicle for a period of two years. This agreement has been reviewed and approved by the City Attorney's Office.
