RESOLUTION NO. 2010-109 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON DIRECTING THAT CONTRACTING PROCEDURES SET FORTH IN SECTION 2.29-4 OF THE VERNON CITY CODE BE FOLLOWED FOR CONTRACT NO. CS-0020 FOR 26TH STREET IMPROVEMENTS AND AUTHORIZING THE CITY CLERK TO GIVE NOTICE INVITING SEALED BIDS WHEREAS, there has been presented to the City Council of the City of Vernon the proposed bid package for Contract No. CS-0020 for 26th Street Improvements ("Contract No. CS-0020"); and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interest of the City of Vernon that the contracting procedures set forth in Section 2.29-4 of the Vernon City Code be followed for Contract No. CS-0020. NOW, THEREFORE,.BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION_2: The City Council of the City of Vernon hereby directs staff to follow the contracting procedures set forth in Section 2.29-4 of the Vernon City Code for Contract No. CS-0020. SECTION 3: The City Council of the City of Vernon hereby authorizes the City Clerk to issue written notice inviting sealed bids for Contract No. CS-0020, in accordance with Section 2.29-4 of the Vernon City Code and in substantially the form attached as Exhibit A, and authorizes the Director of Community Services & Water, or his designee, after obtaining the approval of the City Attorney, to make modifications to the notice as he deems necessary that are consistent with the intent of this Resolution. SECTION 4: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. License A bid submitted by a Contractor who is not licensed in accordance with the provisions of Division III, Chapter 9, of the Business and Professions Code of the State of California will not be considered for award. 4. Proposals (a) Bids must be made in accordance with the following instructions: (1) Bids shall be made on the Bid Form Proposal furnished by the City as a part of Contract No. CS-0020 (Federal Aid Project ID No. ESPL-5139 (011)) 26th Street Improvements. All bids shall be properly executed with the signatures of all signatorieswritten in longhand. All blank items shall be filled in. Numbers shall be spelled out and written in Arabic figures. If the words and Arabic figures are different, the words shall be used and the Arabic figures disregarded: Erasures, interlineations or other corrections shall be authenticated by affixing next to the mark or correction, or in the margin immediately adjacent thereto, the initials of the signatory(ies) to the bid. If the unit price and the total amount set forth by a bidder, for any item, are not in the Bid Form Proposal, the unit price alone shall be considered as representing the bidder's intention, and the totals shall be corrected to conform thereto. (2) Bidders must submit bids on all of the schedules set forth in the Bid Form Proposal. (3) Bids shall not contain any recapitulation of the work to be done. Alternative proposals will not be considered except as specified. Oral, telegraphic and/or telephonic proposals or modifications will not be considered. The check or the bid bond may be forfeited to the City if the successful bidder: (1) refuses or fails to execute the Contract within fifteen (15) calendar days after receipt of written notice from the City that the Contract is ready for signature, or (2) refuses or fails to furnish the required Contract bond and/or proof of insurance coverage within thirty (30) calendar days after the City has provided written notice of award. If no bid is accepted by the City Council, or if the successful bidder executes and delivers the necessary Contract - Documents to the City, then the City will return all checks and bonds received by it within ten (10) days after the execution of said Contractor within ten (10) days after being requested to do so by the unsuccessful bidder. (b) Before submitting a bid, bidders shall: read Contract No. CS-0020 (Federal Aid Project ID No. ESPL-5139 (011)) 26th Street Improvements, especially the Special Provisions, and all other Contract Documents with care; visit the site of the work, and; be fully informed about all the existing conditions and limitations. The bidder should also be fully aware of the bond and insurance requirements as to the successful bidder. The bid shall specify the amounts to cover the cost of all items included in Contract No. CS-0020 (Federal Aid Project ID No. ESPL-5139 (011)) 26th Street Improvements. No allowance will be made because a bidder failed to examine the Contract Documents or obtain the requisite knowledge about the project prior to submitting its bid. (c) Bids shall be sealed in an envelope marked: Contract No. CS-0020 (Federal Aid Proiect ID 'No. ESPL-5139 (611)) 26lb Street Improvements Bids shall be addressed to the City Clerk of the City and shall bear the name of the bidder. Bids shall be delivered to the City Clerk on or before the day and hour for the opening of bids as set in the Notice Inviting Sealed Proposals (Bids). It is the SOLE responsibility of the bidder to see that the bid is delivered and received before the scheduled closing time for receipt of bids. Anybid received after the scheduled closing time shall be returned to the bidder unopened. (d) The City shall have a period of sixty (60) days after the opening of the bids within :which to accept or reject any or all of the bids. 5. Contract and Bonds (a) The form of Contract that the successful bidder, as the Contractor, will be required to execute is included in the Contract Documents, and should be examined -by the bidder with care. The Contract, bonds and other documents to be executed by the Contractor shall be executed in original triplicate stamped according to law. One original shall be filed with the City and the others with the appropriate City departments. (b) At the time the Contract is executed, the successful bidder will be required to furnish and maintain the following: (1) a Labor and Material Bond in an amount equal to 100% of the Contract.price and (2) a faithful Performance Bond in an amount equal to 100% of the Contract price. The bonds shall be secured from a surety company that the City finds acceptable. The surety's name must be on file with the County Clerk of Los Angeles County and/or the California Department of Insurance as an approved and financially sound surety company, authorized to transact business in this state. The bonds shall meet all of the requirements and contain all of the conditions specified in Sections 3247 and 3248 inclusive, of the Civil Code, and other applicable provisions of the law and/or regulations of the State of California. (c) If the successful bidder fails to execute the Contract, file the required bonds, and/or file proof of insurance coverage as required by the Contract Documents, the award of the Contract may be annulled by the City and the bid bond forfeited. Addenda Any addenda issued before the time in which to submit bids expires, and included as a part of the Contract Documents furnished to the bidder for preparation of its bid, shall be covered in the bid and shall be a part of the Contract. 7. Withdrawal of Bid Any bidder may withdraw its bid either personally or by a signed written request any time prior to the scheduled time for opening of the bids (but not after). 8. Award or Rejection of Bids - The Contract will be awarded to the lowest responsible bidder complying_with.these instructions and with the NoticeInvitingSealed Proposals (Bids). The City, however, reserves the right to reject any and all bids or to waive any irregularities in bids received. If, in the judgment of the City, a bid.contains prices for the various items within the bid that appear to be unrealistically low, or if the bidder is not considered responsible, the bid may be rejected. , 9. Bidders3nterested in More Than One Bid No person, firm or corporation shall be allowed to make or file, or be interested in more than one bid for the same work, unless alternative bids are permitted. A person, firm or corporation that has submitted a subproposal to a bidder or quoted prices on material to a bidder, may submit a subproposal or quote prices to other bidders. 10. 'Insurance and Financial Requirements (a) Before entering into the Contract, the successful.bidder shall furnish evidence that workers' compensation insurance, public liability, property damage insurance, and all other insurance specified in the insurance schedule set forth at pages E-7 and E-8 have been procured. The insurer must be an insurance company admitted in and authorized to do business in California and maintain a rating that is acceptable to the City. The insurance procured must be maintained in full force and effect for the entire duration of the Contract. (b) Before the Contract is awarded, any bidder upon request shall furnish a recent statement of said bidder's financial condition and previous construction experience or such other evidence of the bidder's qualifications, as maybe required by the City. If not previously provided to the City, the successful bidder shall furnish a recent statement of its financial condition and previous construction experience or such other evidence of its qualifications before entering into the Contract. 11. Preliminary Estimate The preliminary estimate of quantities of work to be done and material to be furnished, as shown in the Contract Documents, are approximations and are given as a basis for the comparison of bids. The City does not expressly, or by implication, agree that the actual amount of work will correspond with the preliminary estimates. The City reserves the right to increase or decrease the quantity of any item or portion of the work or to omit portions of the work, as it deems necessary or expedient. The successful bidder shall not at any time after the submission of the bid have any claim for damages as a result of lowering of anticipated profits or the loss of profits because of any difference between the quantities of work actually done and those stated in its bidding sheets. Each bid item should be priced to carry its pro-rata share of the costs, overhead and profit. Bidders are cautioned against unbalancing their bid by including more than a pro-rata share of overhead and profit in any bid item. 12. Deductive Items Attention should be paid to Deductive Bid Items. These items have been listed in the Bid Price section of the Bid Form Proposal. All items will be totaled and included in the comparison of bids made by the City. The City has the option of deducting the Deductive Bid Items from the total bid price prior to awarding the Contract. 13. A Mandatory Pre -Bid Meeting and Tour of the Site A mandatory pre -bid meeting and tour of the project site for the prime contractors has been set at the office of the Community Services & Water Department, City Hall; 4305 Santa Fe Avenue, Vernon, California for Wednesday, September 08, 2010, 9:00 a.m. A tour of the project site will start right after the mandatory pre -bid meeting. Sub -contractors are invited and encouraged to attend the pre -bid meeting for the purpose of familiar with the project and networking with the prime contractors but not mandatory. 14. Project Description Contract No. CS-0020 (Federal Aid Project ID No. ESPL-5139 (011)) 26th Street Improvements project involves the following bids: (1) Base Bid (2) Additive Alternate Bid "A" (3) Additive Alternate Bid `B" (4) Additive Alternate Bid "C" (1) Base Bid (A) Various Streets Pavement Improvements. (a) 26th Street from Santa Fe Avenue to 1,400' east of Soto Street. (b) Harriett Street from north City boundary to 261h Street. (c) Soto Street from north City boundary to 700' south of 26th Street. A 6 feet wide header will be cut along all the existing edge of concrete gutters. Deteriorated existing pavement on 26`h Street and Harriett Street will be treated for 4 inches deep existing asphalt pavement Cold In -place Recycling (CIR) and/or Cold Central Plant Recycling (CCPR). The process of CCPR consist of uniform cold planning the existing deteriorated pavement to specified depth, transport them to a nearby Cold Central Plant lot and then crush and size the cold planed asphalt concrete material to conform with an approved mix design gradation. Then, the crushed and sized material shall be processed in a mixing unit with new emulsified recycling agent, water and additives, and blended to become a homogeneous mixture to produce recycled asphalt concrete which will be transported and placed back on the previously uniform cold planed street pavement surface within the same day. After curing of recycled asphalt concrete pavement, an overlay of 2-inch thick latex modified asphalt concrete will be installed on the streets per plans. All the utility valve covers will be adjusted to grade as part of the paving operations. All the manhole frames and covers within the project limits will be adjusted to grade after the final overlay paving. Existing locking type manhole frames and covers will be replaced with new non -locking type manhole frames and covers. The contractor will place temporary striping of traffic lane lines immediately after recycled asphalt concrete base paving and again after the final 2" overlay asphalt concrete paving of the streets. Final re -striping of traffic lane lines and replacement of damaged traffic loops are part of the contract. 14 feet widening along east side of the Soto Street in front of the JC Sale property (about 700 feet) shall be part of the improvements at the 26`h Street and Soto Street intersection. Existing triangle concrete median located at the southeast corner of Soto and 26`h Street shall be removed and reconstructed at a slightly different location. 26`h Street west bound lane at Soto Street intersection approach shall be reconstructed with B-4 - new concrete pavement to prevent from future rutting. Deteriorated existing pavement in the intersection and four approaches shall be cold planed from 4 to 6 inches deep and repaved with 4 to 5 inches thick new asphalt concrete per plans to lower the street cross section slopes for smoother vehicle ride. Proposed concrete curbs, gutters, driveways and sidewalks will be constructed along the east side of Soto Street as shown on the plans. (B) Soto Street at 261h Street southeast corner traffic signal relocation and modification. The existing traffic signal facilities located on the existing triangle concrete median at the southeast corner of Soto Street and 26th Street shall be relocated to a new triangle concrete median located at a slightly (7' southerly) different location and modify the traffic signal per plan and specifications. Remove and relocate or salvage or dispose the existing traffic signal poles, equipment, controller cabinet with soft ware as directed by the City and replace with necessary new pole, equipment, material, cabinet with soft ware per plan and specifications. (2) Additive Alternate Bid "A" (A) Westerly Soto Street south of 26th Street Pavement Improvements. Deteriorated existing pavement along west side of the Soto Street shall be uniformly cold plane 2 inches deep and overlay with 2 inches thick new asphalt concrete per plan. Existing manholes and valves shall be adjusted to finished grade. The contractor will place temporary striping of traffic lane lines immediately after the 2 inches overlay asphalt concrete paving of the streets. Final re -striping of traffic lane lines is part of the contract. (3) Additive Alternate Bid `B" (A) Along 26th Street east of Soto Street (Station 35+25 to 40+50) Pavement Improvements. Deteriorated existing pavement along 26th Street east of Soto Street shall be uniformly cold recycled to 4 inches deep and repaved with 4 inches thick cold recycled reclaimed asphalt concrete per plan. Existing manholes and valves shall be adjusted to finished grade. PROPOSAL REQUIREMENTS AND CONDITIONS 2-1.01 GENERAL The bidder's attention is directed to the provisions in Section 2, "Proposal Requirements and Conditions," of the Standard Specifications and these special provisions for the requirements and conditions which the bidder must observe in the preparation of the proposal form and the submission of the bid. In addition to the subcontractors required to be listed in conformance with Section 2-1.054, "Required Listing of Proposed Subcontractors," of the Standard Specifications, each proposal shall have listed therein the portion of work that will be done by each subcontractor listed. A sheet for listing the subcontractors is included in the Proposal. The DBE may also lease trucks from a non -DBE firm including from an owner -operator. The DBE who leases trucks from a non -DBE is entitled to credit only for the fee or commission it receives as a result of the lease arrangement. The DBE does not receive credit for the total value of the transportation services provided by the lessee, since these services are not provided by a DBE; 6. For the purposes of this paragraph, a lease must indicate that the DBE has exclusive use of and control over the truck. C-37 EXHIBIT 12-F 5-1.1_ SUBCONTRACTOR AND DBE RECORDS The Contractor shall maintain records showing the name and business address of each first -tier subcontractor. The records shall also show the name and business address of every DBE subcontractor, DBE vendor of materials and DBE trucking company, regardless of tier. The records shall show the date of payment and the total dollar: figure paid to all of these firms. DBE prime contractors shall also show the date of work performed by their own forces along with the corresponding dollar value of the work. Upon completion of the contract, a summary of these records shall be prepared on "Final Report — Utilization of Disadvantaged Business Enterprises (DBE), First -Tier Subcontractors" (Exhibit 17-F/Form CEM-2402) and certified correct by the Contractor or his authorized representative, and shall be furnished to the Engineer. The form_ shall be furnished to the Engineer within 90 days from the date of contract acceptance. The amount of $10,000 will be withheld from payment until a satisfactory form is submitted. Prior to the fifteenth of each month, the Contractor shall submit documentation to the Engineer showing the amount paid to DBE trucking companies. The Contractor shall also obtain and submit documentation to the Engineer showing the amount paid by DBE trucking companies to all firms, including owner -operators, for the leasing of trucks. If the DBE leases trucks from a non -DBE, the Contactor may count only the fee or commission the DBE receives, as a result of the lease'arrangement. The Contractor shall also obtain and submit documentation to the Engineer showing the truck number, owner's name, California Highway Patrol CA number, and if applicable, the DBE certification number of the owner of the truck for all trucks used during that month. This documentation shall be submitted on "Monthly DBE Trucking Verification" Form CEM-2404(F). CERTIFICATION STATUS 5-1.2. DBE If a DBE subcontractor is decertified during the life of the project, the decertified subcontractor shall notify the Contractor in writing with the date of decertification. If a subcontractor becomes a certified DBE during the life of the project, the subcontractor shall notify the Contractor in writing with the date of certification. The Contractor shall furnish the written documentation to the Engineer. Upon completion of the contract, "Disadvantaged Business Enterprises (DBE) Certification Status Change" Form CEM-2403(F) indicating the DBE's existing certification status shall be signed and certified correct by the Contractor. The certified form shall be furnished to the Engineer within 90 days from the date of contract acceptance. 5-1.3 PERFORMANCE OF UDBES The UDBEs listed by the Contractor in response to the provisions in Section 2-1.02B, "UDBE and DBE Commitment Submittals," and Section 3, "Award and Execution of Contract," of these special provisions; which are determined by the Agency to be certified DBEs, shall perform the work and supply the materials for which they are listed, unless the Contractor has received prior written authorization to perform the work with other forces or to obtain the materials from other sources. Authorization to use other forces or sources of materials may be requested for the following reasons: A. The listed UDBE, after having had a reasonable opportunity to do so, fails or refuses to execute a written contract, when such written contract, based upon. the general terms, conditions, plans and specifications for the project, or on the terms of such subcontractor's or supplier's written bid, is presented by the Contractor. The decision of which column to be used for entering the DBE dollar value is based on what program(s) status the firm is certified. Form CP-CEM 2403(F) (New 10/99) DISADVANTAGED BUSINESS ENTERPRISES (DBE) CHANGE IN CERTIFICATION STATUS REPORT The top of the form requires specific information regarding the construction project: Contract Number, County, Route, Post Miles, the Administering Agency, the Contract Completion Date, and the Estimated Contract Amount. It requires the Prime Contractor's name and Business Address. The focus of the form is to substantiate and verify the actual DBE dollar amount paid to contractors on federally funded projects that had a changed in Certification status during the course of the completion of the contract. The two situations that are being addressed by CP-CEM 2403(F) are, if a firm certified as a DBE and doing work on the contract during the course of the project becomes Decertified, and if a non -DBE firm doing work on the contract during the. course of the project becomes Certified as a DBE. The form has a column to enter the Contract Item No (or Item Nos.) as well as a column for the Subcontractor's Name, Business Address, Business Phone, and contractor's Certification Number. The column entitled Amount Paid While Certified will be used to enter the actual dollar value of the work performed by those contractors who meet the conditions as outlined above during the time period they are Certified as a DBE.
