A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN APPLICATION FOR THE 2010/2011 USED OIL PAYMENT
PROGRAM AND SUPERSEDING RESOLUTION NO. 2010-82
WHEREAS, the people of the State of California have enacted
the California Oil Recycling Enhancement Act to discourage the
improper, illegal, and environmentally hazardous disposal of used oil;
and
WHEREAS, the Department of Resources Recycling and Recovery
("CalRecycle") administers the Used Oil Recycling Program and has
established procedures by which -cities and counties may apply for
funding under the Used Oil Payment Program (formerly known as the
"Used Oil Block Grant Program"); and
WHEREAS, the City of Vernon received funds of approximately
Five Thousand Dollars ($5,000) per year from 1997 through 2009; and
WHEREAS, the City of Vernon has used the funds to.improve
public awareness of opportunities to recycle used oil and the
environmental damage caused by the improper disposal of used oil; and
WHEREAS, CalRecycle is now accepting applications for the
Used Oil Payment Program for the fiscal year 2010/2011 ("OPP Cycle
1°); and
WHEREAS, Vernon is expected to receive Five Thousand Dollars
($5,000) for the 2010/2011 cycle; and
WHEREAS, on June 21, 2010, the City Council of the City of
Vernon adopted Resolution No. 2010-82 approving the execution of an
application for the 2010/2011 Used Oil Payment Program; and
WHEREAS, by memo dated July 27, 2010, the Director of
Health & Environmental Control has recommended that, in accordance
with the request of CalRecycle, a revised resolution be adopted,
superseding Resolution No. 2010-82.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves and authorizes the submittal of an application for
CalRecycle's 2010/2011 Used Oil Payment Program ("Application"), a copy
of which is attached hereto as Exhibit A.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the execution of the Application by the Director of Health
& Environmental Control on behalf of the City of Vernon and hereby
authorizes the Director of Health & Environmental Control to execute
any and all documents, including but not limited to, applications,
agreements, amendments and requests for payment, necessary for the
purposes of securing funds for, and on behalf of, the City of Vernon
and to take whatever actions are deemed necessary or desirable for the
purpose of implementing and carrying out the purposes of this
Resolution and the actions herein approved or authorized.
SECTION 4 The City Council of the City of Vernon hereby
directs the Director of Health & Environmental Control, or his
designee, to submit electronically the executed Application together
with a copy of this Resolution to CalRecycle.
SECTION 5: Resolution No. 2010-82 is hereby superseded by
this Resolution.

SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the. City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.

RE: Request for Approval of Revised Resolution Approving and Authorizing the
Application for the 2010/2011 USED OIL PAYMENT PROGRAM Grant
On June 21, 2010 the City Council approved Resolution 2010-82 approving and authorizing the application
for the subject grant. The application and resolution were submitted to "CalRecycle" before the deadline of
June 30, 2010. Subsequently, CalRecycle has informed us that the resolution required some minor wording
changes.
We are requesting approval of the revised resolution with the amended changes (requested by CalRecycle),
authorization to submit the revised resolution, and rescission of Resolution 2010-82.
