A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON RECITING THE FACT OF THE SPECIAL MUNICIPAL
ELECTION HELD ON AUGUST 31, 2010, DECLARING THE
RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a Special Municipal Election was held and conducted
.in the City,of Vernon, California, on Tuesday, August 31, 2010, as
required by law; and
WHEREAS, pursuant to Resolution No. 2010-60, the election
was conducted entirely by vote -by -mail ballot pursuant to Section
4000, et seq., of the Elections Code of the State'of California
("Elections Code"); and
WHEREAS, notice of the election was given in time, form and
manner as provided by law; and
WHEREAS, election officers were appointed, vote -by -mail
ballots were properly sent to all registered voters, and in all
respects the election was held and conducted, the votes were cast,
received and canvassed, and the returns were made and declared in the
time, form, and manner required by the City Charter and the Elections
Code; and
WHEREAS, pursuant to Section 10262 of the Elections Code,
the City Council is to meet no later than the fourth Friday after the
election for the purpose of performing the functions and duties
specified.in Sections 10262 and 10263 of the Elections Code; and
WHEREAS, the City Clerk canvassed the returns of the
election and has certified the results to the City Council, which
certification and results are received, attached and made part hereof
as Exhibit A, attached hereto and incorporated by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: One (1) voting precinct was established for the
purpose of holding said Special Municipal Election, consisting of the
regular election precinct in the City as established for the holding
of State and County elections.
SECTION 3: The total number of vote -by -mail ballots cast in
the City was 38.
SECTION 4: The Measures voted upon at the election were as
follows:
Measure A
Yes
Shall the Vernon City Charter be amended to
require that candidates for the City Council
must live in, and be registered to vote in,
the City of Vernon for at least 30 days prior

to running for office?
Measure B
Yes
Shall an ordinance be adopted to allow the
proceeds of the existing special parcel tax

on warehouses and similar uses to be spent on
police and fire protection services?
Measure C
Yes
Shall the Vernon City Charter be amended to
restrict the use of certain Light and Power
revenues to supporting the Light and Power

enterprise?

SECTION 5: The number of votes given in the one voting
precinct in the City for and against each Measure is listed in Exhibit
A, attached hereto and incorporated by reference.
SECTION 6: The City Council does declare and determine that
as a result of the Special Municipal Election, voters unanimously
voted in favor of Measure A, and the measure was carried, and shall be
deemed approved and adopted.
Section 7: The City Council does declare and determine that
as a result of the Special Municipal Election, a two-thirds (2/3rds)
majority (33) of the voters voted in favor of Measure B, and the
measure was carried, and shall be deemed approved and adopted.
Section 8: The City Council does declare and determine that
as a result of the Special Municipal Election, a majority (32) of the
voters voted in favor of Measure C, and the measure was carried, and
shall be deemed approved and adopted. -
SECTION 9: The City Clerk shall enter on the records of the
City Council of the City, a statement of the result of the election,
showing:
(1) The whole number of votes cast in the City;
(2)
The
Measures voted
upon;
(3)
The
total number of
votes given in the City for
and against each Measure.
SECTION 10: The City Council of the City of Vernon hereby
directs the City Clerk to file the revised Vernon City Charter with
the California Secretary of State.

SECTION 11: The City Clerk of the City of Vernon shall
Certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.

On August 31, 2009 an all mail Special Municipal Election was held. The following Measures
were submitted to the voters:
Measure A
Yes
Shall the Vernon City Charter be amended to require that candidates for the
City Council must live in, and be registered to vote in, the City of Vernon
for at least 30 days prior to running for office?
No
Measure B
Yes
Shall an ordinance be adopted to allow the proceeds of the existing special
parcel tax on warehouses and similar uses to be spent on police and fire
protection services?
No
Measure C
Yes
Shall the Vernon City Charter be amended to restrict the use of certain Light
and Power revenues to supporting the Light and Power enterprise? .
No
There were 81 ballots mailed out. No provisional ballots were issued. Forty-two ballots were
received and sent to the County Registrar for signature verification. Four ballots were challenged
and not counted. A total of thirty-eight (38) ballots were processed.
The result of the Special Election for "MEASURE A" is as follows: 38 votes in favor and 0 against.
The result of the Special Election for "MEASURE B is as follows: 33 votes in favor and 5 against.
The result of the Special Election for "MEASURE C" is as follows: 32 votes in favor and 6 against.

AMENDMENTS TO VERNON CITY CHARTER
Chapter 3.3 of Article III of the Charter of the City of Vernon is amended in its entirety
to read as follows:
"CH:3.3 Eligibility.
No person shall be eligible to hold the office of councilmember
unless he or she has resided in the City of Vernon and been
registered to vote for at least thirty (30) consecutive calendar days
immediately preceding the date nomination papers are issued to
such person by the City Clerk, and remains a resident and
registered voter continuously in the City until the election and
throughout his or her term as councilmember."
Chapter 8.12 is hereby added to Article VIII of the Charter of the City of Vernon to read
as follows:
"CH: 8.12 Light and Power Revenues.
After revenues from the City's Light and Power enterprise are
deposited into the Light and Power Fund, such revenues shall be
used solely for the purpose :of supporting the Light and Power
enterprise.
