A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON ESTABLISHING FEES FOR GREEN BUILDING
STANDARDS ADMINISTRATION SPECIAL REVOLVING FUND,
GREEN BUILDING STANDARDS REVIEW AND INSPECTION,
GRADING PERMITS, INDUSTRIAL WASTEWATER DISCHARGE
PERMIT APPLICATION REVIEW, CERTIFIED ACCESS
SPECIALIST REVIEW SANITARY SEWER FLOW STUDIES,
PENALTY FEES, AND AMENDING FEES FOR SUPPLEMENTAL
INSPECTIONS AND PLAN REVIEWS RELATING TO BUILDING
CODESWITHIN THE CITY, AND REPEALING ALL PARTS OF
RESOLUTIONS IN CONFLICT THEREWITH
WHEREAS on February 21, 1984, the City Council of the City
of Vernon adopted Resolution No. 5086 establishing fees for building,
electrical, plumbing, heating, ventilating, cooling, refrigeration and
fire prevention permits issued by the City and for special inspections,
certificates of occupancy, temporary use of commercial coaches,
conditional use permits and for review and approval of tentative parcel
maps; and
WHEREAS, on January 5, 2009, the City Council of the City of
Vernon adopted Resolution No. 9803 establishing fees for building_,
electrical, plumbing, heating, ventilating, cooling, refrigeration and
fire prevention permits issued by the City, inspections outside of
normal business hours, reinspections, plan reviews required by changes,
additions or revisions to plans, certificatesofoccupancy, temporary
use of commercial coaches, conditional use permits, zoning variances,
zoning amendments, zoning verifications, building code variances,
covenant reviews, lot line adjustments and lot merger reviews,
certificates of compliance and for reviews and approvals of final
parceland tentative parcel maps for division of property; and
WHEREAS, certain fees established by the foregoing
resolutions are inadequate to cover the current cost to perform
supplemental inspections and plan reviews; and
WHEREAS, the State of California signed into law SB 1473
which requires each City to collect a fee from an applicant for a
building permit to fund the creation of the Building Standards
Administration Special Revolving Fund; and
WHEREAS, the City Council now desires to amend the Fee
Schedule of ,the City .of Vernon to (i) provide for fees for the Green
Building Standards Administration Special Revolving Fund, Green
Building Standards Review and Inspection, Grading Permits, Industrial
Wastewater Discharge Permit Application Review, Certified Access
Specialist (CASp) Review, Sanitary Sewer Flow Study, and Penalty Fees
for work without a permit or occupancy without a Certificate of
Occupancy, and (ii) amend fees to perform inspection outside of normal
City business hours, inspections not requiring a permit, reinspection
fees, additional structural and non-structural review required by
changes additions, or revisions to plans submitted or in determining if
an existing structure can accept additional loads.
WHEREAS, the amount of the proposed fees does not exceed the
reasonable cost of providing the services necessary for the activity
for which the fees are charged; and
WHEREAS, the proposed fees are not levied for unrelated
revenue purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.

SECTION 2: The City Council of the City of Vernon hereby
establishes a fee for the Green Building Standards Administration
Special Revolving Fund, Green Building Standards Review and
Inspection, Grading Permits, Industrial Wastewater Discharge Permit
Application Review, Certified Access Specialist (CASp) Review,
Sanitary Sewer Flow Study, and Penalty Fees for work without a permit
or occupancy without an Certificate of Occupancy as set forth in Table
1 attached hereto;as Exhibit A and incorporated by reference. The
fees shall be collected by the Director of Finance and deposited into
the general fund of the City of Vernon.
SECTION 3: The City Council hereby amends the following
fees contained in Table 3-A of Resolution 9803, i) Inspection outside
of normal business hours, ii) Reinspection fee, and iii) Additional
Plan Review required by changes, additions or revisions to the plans.
The amended fees are as set forth in Table 2 attached hereto as
Exhibit B and incorporated herein by reference. The fees shall be
collected by the Director of Finance and deposited into the general
fund of the City of Vernon.
SECTION 4: In addition to the foregoing, the applicant or
permittee shall pay all other necessary fees or deposits which may be
required by --other ordinances or resolutions of the City of Vernon or
applicable State law.
SECTION 5: The fees provided for herein shall be effective
March 1, 2011, and all parts of resolutions, not consistent with or in
conflict with this Resolution are hereby repealed.
SECTION 6: Notwithstanding Section 2 and 3, the City
Council is taking action only on those fees that have been established
and amended as set forth in.Exhibits A and B. All fees not modified

herein shall continue and remain in effect unless and until modified by
resolution or other action of this Council.
SECTION 8: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of Resolutions
of the Council of this City.

PLEASE TAKE NOTICE that on Tuesday, February 15, 2011, at 9:00 a.m. or as soon
thereafter as the matter may be heard, in the Council Chamber of Vernon City Hall, located at

and fire departments for permit plan review and inspection. The Community Services Department is in the
process of modifying some of its fees to reflect the true cost of service. The Fire Department currently utilizes
an outside consultant to perform various tasks including performing plan checks for automatic fire systems,
hazardous material storage and other related items. From time to time permits are submitted for plan check and
then are subsequently revised or modified after the initial plan check has been completed. The City would like
to recover the additional cost to perform the additional plan review caused by these modifications. Since the
Building Department is in the process of amending its fees, the Fire Department has requested that the cost for
the Fire Departments consultant to perform this additional work be included. The fee will be the consultant
charge plus 10% for city administrative costs.
Therefore it is recommended that a fee for "Additional fire permit plan review required by changes,
additions or revisions to the plans submitted" at a cost of $110.00 per hour be approved.

RE: NEW AND MODIFIED FEES FOR SERVICES PROVIDED BY THE
COMMUNITY SERVICES AND WATER DEPARTMENT
The Community Services and Water Department consists of several divisions that directly assist the
public. These include the Planning; Building, Public Works and Water sections. Services provided include the
plan check and inspection of both construction on private and public property ensuring that the quality of
construction meets standards set forth in the building code or City standards, other work performed by City staff
include the processing of planning applications, processing of subdivision maps and lot line adjustments. As
such, the public is charged a fee for the, services provided. These include: Planning fees such as fees to process
a Conditional Use Permit, Variance, or Zoning Code Amendment; Building Department fees for plan review
and inspection of construction projects, and; the Public Works Division fees for oversight of work performed
within the public right of way.
Several new laws and regulations have been established requiring City oversight. These include the
enforcement of the California Green Building Standards Code, Certified Access Specialist reviews and Water
Efficient Landscape Design Plan reviews. Additionally, City staff currently processes Industrial Wastewater
Discharge Permit Applications prior to submission to the Sanitation Districts of Los Angeles County. The costs
for providing these services are not currently established in the City's fee schedule.
Staff is recommending that a fee be charged for the review of grading plans. The fee includes the cost
of reviewing hydraulic and hydrology calculations for Storm Water Runoff and NPDES compliance including
the review of the Storm Water Pollution Prevention Plans (SWPPP), Wet Weather Erosion Control Plans and
the Standard Urban Stormwater Management Plans.
It is recommended that the hourly costs for special inspections, reinspections, and plan review be
adjusted to reflect the City's costs to provide this service including any City overhead costs.
In accordance with Government Code Section 66014(a) a local agency may charge fees for services
provided however, the fees may not exceed the estimated reasonable cost for the service provided for which the
fee is charged. A fee study, enclosed herewith as Exhibit "A" has been prepared for a grading permit fee, water
efficient landscape plan review and inspection fee, industrial wastewater discharge permit application review
fee, sewer flow study fee, CASp review fee, structural plan review fee, and Green Building Standards plan
review and inspection fees.
Ordinance No. 1176 recently adopted the most recent editions of the California Building, Residential,
Mechanical and Plumbing Codes and the Administrative Provisions for the Electrical Code. Section 109.4 of
the Building Code, Section 108.6 of the Residential Code, Section 103.4.4.2 of the Plumbing Code, Section
115.5.2 of the Mechanical Code and Section 404.3 of the Administrative Provisions of the Electrical Code allow
for the establishment of a fee for work commencing without a permit. The Mechanical and Plumbing Codes are
specific that this investigation fee shall be equal to the permit fee. Staff is recommending that the fee for
commencing work without a permit for all types of construction should be equal to the permit fee.
Section 18931.6 of the Health and Safety Code requires that a fee in the amount of $1.00 for every
$25,000 or thereof in valuation be collected on its behalf. It is recommended that a separate fee be collected for
and deposited in the Building Standards Administration Special Revolving Fund. The City may retain up to
10% of the fee for its administrative costs. Staff is recommending that a separate fee be collected for this State
Revolving Fund fee.
Exhibit "B" enclosed herewith outlines the proposed adjusted, new and penalty fees for services.

COST STUDY
City of Vernon Community Services Department staff is required to perform various plan reviews and
inspections for the public. Based on Staff s experience in processing plan reviews and inspections they have
gained actual knowledge on the amount of time required to process the review. The City is seeking to recover
funds for the services provided. Section 66014(a) of the Government Code permits a local agency to charge
fees for services provided however, the fees may not exceed the estimated cost for the service provided.
The Community Services and Water Department is seeking to recover costs for the following services
provided:
• Grading Permit — Consists of the review of the topographical conditions and site elevations of
a new development or the redevelopment of existing sites. The review consists of reviewing grading
plans, hydrology calculations, hydraulic calculations, onsite drainage patterns, NPDES Stormwater
Pollution Prevention Plans, Standard Urban Stormwater Mitigation Plan, inspection of site grading and
NPDES Best Management Practices.
• California Green Building Standards Code — Plan Review and Construction Inspections — The
State of California has adopted the 2010 California Green Building Standards Code, Part 11 of Title 24
of the California Code of Regulations. Certain elements of the Code are mandatory, while other
voluntary provisions, if met, will qualify the building as either as a CalGreen Tier 1 or Tier 2 project.
State law requires each local agency to adopt and enforce the mandatory regulations established by the
Code. This will require City staff to review plans to confirm compliance with the regulations and
inspect the facility to determine if the project was constructed in conformance with the plans.
Additionally, an applicant may elect to construct voluntary measures in order to achieve a Tier 1 or Tier
2 classification. The applicant may request that the City verify compliance with the Tier 1 or Tier 2
regulations, which will require additional plan check and inspection services.
• State Building Standards Administration Special Revolving Fund Fee —. SB 1473 was signed
into law in 2008. This law, established Section 18931.6 of the Government Code and requires each
City to collect a fee from any applicant for a building permit, assessed at a rate of one dollar for each
$25,000 or portion thereof, of valuation of work. The City may retain up to 10% of the fee to cover
administrative costs. Therefore, based on State law City staff is recommending that a fee be established
for the Building Standards Revolving Fund.
• Industrial Wastewater Discharge Permits — Prior to an Industrial Wastewater Discharge Permit
application being submitted to the Sanitation Districts of Los Angeles County (LACSD) the City of
Vernon must review and approve the application. While the City may review the treatment systems
proposed, the City is primarily responsible for determining if the City's local sanitary sewer has
sufficient, capacity for the proposed discharge. The LACSD ensures that the constituents of the flow,
when discharged into the sewer system, meets the regulatory requirements of the LACSD and if any
pretreatment is necessary to meet these requirements. In order to confirm capacity, the City may be
able to rely on written records or observations. From time to time, it is necessary to perform a sewer
capacity study requiring both an exhaustive review of records and the installation of instrumentation
into the sewer to record the actual flows of the sewer.
• Certified Access Specialist (CASp) Review — Civil Code Section 55.53(d) (1) requires a local
agency to employ or retain at least one building inspector who is a CASp. The CASp shall provide
consultation to the local agency, permit applicants and members of the public on compliance with State
construction related accessibility standards with respect to inspections of a place of public
accommodation that relates to permitting plan checks, or new construction, including but not limited to,
inspections related to tenant improvements that may impact access. The City is recommending that a
fee be charged to those individuals requesting the CASp service be provided.
