Resolution No. 2011-062RESOLUTION NO. 2011-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A MODIFICATION TO A CONDITION OF APPROVAL TO THE CONDITIONAL USE PERMIT FOR U.S. HEALTHWORKS FOR THE OPERATION OF A MEDICAL FACILITY LOCATED AT 3360 & 3364 SLAUSON AVENUE WHEREAS, U.S. Healthworks ("USHW") is requesting a modification to a condition of approval to its existing conditional use permit ("CUP") that was approved on March 5, 1991, for the operation of a medical facility located at 3360 and 3364 Slauson Avenue ("Project") pursuant to Resolution No. 5892; and WHEREAS, the CUP was issued to D&I Investment Company (known as "Technimed"), in May 2010, the business was purchased by USHW; and WHEREAS, the City Council of the City of Vernon held a hearing on this requested modification to a condition of approval to the CUP on April 19, 2011; and WHEREAS, USHW is proposing to eliminate the off -site parking requirement of 40 parking stalls located on the Los Angeles Department of Water and Power (LADWP) right-of-way adjoining the site based on USHW's ability to demonstrate that the existing on -site parking is adequate for its needs; and WHEREAS, the project site is located in the I -Zone, Industrial; and WHEREAS, pursuant to Section 26.4.1-3(i) of the Comprehensive Zoning Ordinance, an Urgent Care Facility is not specifically permitted nor prohibited within the City, but allowed with approval of a conditional use permit; and WHEREAS, despite a change in ownership, it will continue to be used for the same purpose; and WHEREAS, the Community Services Department conducted an Initial Study for the project when D&I Investment Company was first granted a conditional use permit in 1991, to determine if the project would provide any significant impacts to the environment and determined that the proposed project will not have significant effect on the environment and therefore a notice of exemption from the California Environmental Quality Act ("CEQA") was filed; and WHEREAS, the City Council has received a Staff Report dated April 6, 2011 upon which it has relied in making the foregoing recitals; and WHEREAS, --USHW--has indicated that -it- has --not and -does -not propose to perform any structural alterations to its facility which would require it to come into compliance with the requirements of the current Comprehensive zoning Ordinance; and WHEREAS, the size, shape and topography of the parcel is adequate for the proposed operation; and WHEREAS, the proposed site is surrounded by industrial, utility right-of-ways and warehousing uses compatible with the proposed use and no adverse effect from traffic, parking, noise, odors, smoke, light or glare are anticipated from the proposed operation; and WHEREAS, the conditions imposed on the CUP will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: 2 SECTION 1: The City Council of the City of Vernon does hereby find and determine that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon further finds that all persons have had the opportunity to be heard or to file written comments to the proposed Project and after due consideration of all the evidence submitted at the public hearing determines that there are compelling reasons to justify granting a modification to the CUP. SECTION 3: The City Council of the City of Vernon hereby -finds-that--the-Project---is---categorically--exempt-from the California Environmental Quality Act ("CEQA") as provided in Section 15301, Class 1, as the proposed modification will not result in any significant environmental changes to USHW's current operation. The City Council of the City of Vernon directs the City Clerk, or the City Clerk's designee, to file a Notice of Exemption in compliance with the CEQA. SECTION 4: The custodian of records for the Project and all other material that constitute the record of proceedings upon which the City Council's decision is based is the City Clerk of the City of Vernon. Those documents are available for public review in the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon, California 90058. SECTION 5: In order to adequately protect the public health and general welfare, the conditions contained in Resolution No. 5892 shall be required except that condition "g" shall be modified to read as follows: g. Adequate on -site parking shall be maintained so that no on -street or off -site parking or staging will occur. The facility 3 shall be operated in a manner that will not impede traffic on any public street as determined by the Director of Community Services and Water in the Director's sole discretion. All vehicles shall enter and exit the site in a front forward manner. No vehicle parking or staging associated with the facility shall take place off -site or on the public street without prior approval from the Community Services Department. SECTION 6: The Applicant and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting --from bodily injiir-y, sickness, disease, disabil-ity or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 7: Noncompliance with any condition set forth in the CUP shall be grounds for voiding the permit pursuant to Section 26.6.3-9 of the Comprehensive Zoning Ordinance. SECTION 8: Not later than sixty (60) days from the date of this Resolution, the applicant shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 5 of this Resolution and the indemnification provision contained in Section 6 of this Resolution. 4 SECTION 9: The provisions of Resolution No. 5892 not consistent with or in conflict with this resolution are repealed; in all other respects, Resolution No. 5892 shall remain in full force and effect. SECTION 10: The City Clerk of the City of Vernon shall certify to the passage, approval and.adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Conditional Use Permit Modification - U.S. Healthworks ("USHW'.') located at 3360 & 3364 Slauson Avenue U.S Healthworks (USHW) is requesting a modification to condition. "g" of its conditional use permit (CUP) that was issued on March 5, 1991 pursuant to Resolution No. 5892. This conditional use permit allowed the construction and operation of a general office use (medical clinic) greater than 10,000 gross square feet of floor area. A total floor area of 11,515 SF was permitted for the premises. Originally occupied and operated by. D&I Investment Company (known as "Technimed"), in May 2010, the business was acquired by USHW. As part of the acquisition the lease was assigned to USHW and, with it, the requirement to operate under the same terms and conditions of the existing CUP, which includes a requirement to maintain off -site parking at an adjacent Los Angeles Department of Water and Power (LADWP) owned property. USHW has requested a modification to condition "g" of its use permit, which states; g. The facility shall maintain the existing license agreement with the Los Angeles Department of Water & Power for parking on the adjacent site. Section 26.6.3-9 of the City Code permits a conditional use permit to be modified if one the following findings can be made: 1. The circumstances under which the Conditional Use Permit was granted have been changed by the applicant to the extent that one or more of the findings contained in the original Conditional Use Permit can no longer be made in a positive manner, and the public health, safety, and general welfare require the revocation or modification; 2. The Conditional Use Permit was issued, in whole or in part, on the basis of a misrepresentation or omission of a material statement(s) in the application or in the. applicant's testimony presented during the public hearing for the Conditional Use Permit; 3. One or more of the conditions of the Conditional Use Permit have not been substantially fulfilled or have been violated; or, 4. The use authorized by the Conditional Use Permit is in violation of any code, law; ordinance, regulation, or statute. In this case; since.USHW has not substantially fulfilled the terms in condition "g" of its conditional use permit. Thus, finding No..3 justifies the request for modification: Given, that USHW would be able to secured additional on -site parking, which can satisfy the City's parking requirement. USHW is requesting that the CUP parking provisions be modified, specially, to replace. the LADWP off -site parking requirement and corresponding CUP condition based on actual demand. The original lease specified the availability of 12 parking .spaces on site, and the LADWP-D&I license agreement specified a.parking count of an additional 40 spaces, totaling 52 parking spaces (1.13 spaces per 250 square feet of building area). USHW recently executed a lease amendment with the Landlord providing the business with an additional 13. (non-exclusive) parking spaces for its use. Combined with. the existing: 12 spaces, this increases USHW on -site parking to 25 spaces. USHW stated that since acquiring and entering into the lease assignment for the premises, it has not relied on the LADWP supplemental-off-site-4-0 parking -spaces -and also -stated that its been -several -years-since -the LADWP parking area was used. USHW is one out of several tenants within a larger business park property. Based on the most current parking plan for the site, the Vernon Business Park provides 24 parking spaces in excess of the required parking for the site (e.g. the L 1000. parking ratio for most industrial uses). The neighboring on -site tenants include several uses, e.g..a data center and warehouse uses, which generate parking demand well below the baseline ratio for an industrial -zoned use. As previously mentioned, USHW recently executed a lease amendment with the Landlord providing the business, with. an additional 13 (non-exclusive) parking spaces for its. use. Combined with the existing 12 spaces; this increases USHW on -site parking to 25 spaces. USHW stated that since acquiring and entering into the lease assignment for the premises, it has not relied on. the LADWP supplemental off -site 40 parking spaces and also stated. that its been several years since the LADWP parking area was used. USHW has stated that by providing the business with an additional 13 parking spaces it will be able to rely entirety on its existing on -site parking availability. Per USHW records, the Slauson site has 12 USHW employees and serves up to 10-15 patients at any one time during mid -day, its busiest time of day. Typically, 60-70 patients are served daily, or as many as 75-80 patients on its.busiest days. USHW's actual parking needs, based on combined employee and patient demand, totals 27. spaces (12 employees and 15 patients), not the 46 spaces that would be required for a traditional medical office use. As a condition of the site's CUP approval, the business was required to maintain additional off -site parking (40 spaces) at the LADWP site to accommodate projected use. USHW has never utilized the required 40 off site parking spaces at the DWP site. At the time.the CUP was approved, 12 on -site parking spaces were provided for the subject tenant -space: Subsequently, 13 additional spaces:were leased to USHW for its non-exclusive use..As previously mentioned, USHW's location, is part of a larger business park which shares parking among tenants, which offers a potential array of additional, non -reserved flex parking options for USHW. Businesses located on the property include uses which generate parking demand well below the baseline ratio for an industrial -zoned uses, thus, as long as the low parking demand use continues may present an opportunity to utilize its underutilized parking. The Property's total parking needs, both actual and as required by code, are less.than the total parking available. Currently, the 25 spaces are assigned to USHW by written agreement with the landlord. The additional 3 spaces needed during peak periods can be accommodated on site based on the low parking demand/ requirements (as described above). U,SHW has also indicated that they have no plans for expansion or alteration of the existing building configuration at this time and therefore no increase in vehicle trips. City staff has visited the subject site on numerous occasions and have found that USHW is providing sufficient automobile parking for its need. The grant of the modification would not be materially detrimental to the public health, safety, or welfare, or to the interests of other residents and property owners within the vicinity of the Lot in question. The grant of the modification would allow USHW to eliminate.the off=site parking 40 spaces) at the LADWP site. Thus the applicant is seeking this modification to p g ( p ) � Pp � g eliminate the LADWP additional off -site parking requirement based on USHW's ability to demonstrate that the existing on -site parking is adequate for its needs and, should the need for additional parking subsequently arise, parking alternatives exist within the Vernon Business Park. Based on their request, the Community Services staffs is of the opinion that condition"g" of the conditional use permit can be modified and still protect the health and safety of the community.
