A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN APPLICATION FOR AN ENFORCEMENT ASSISTANCE GRANT
FROM THE CALIFORNIA DEPARTMENT OF RESOURCES
RECYCLING AND RECOVERY (CALRECYCLE)
WHEREAS, pursuant to Public Resources Code Section 43230,
the California Department of Resources Recycling and Recovery
("CalRecycle") makes grants to local enforcement agencies to support
solid waste facilities permit and inspection programs ("Enforcement
Assistance Grants"); and
WHEREAS, CalRecycle has notified the City of Vernon Health &
Environmental Control Department that grant funds will be available
for the Fiscal Year 2011/2012 Grant Cycle, extending from July 1, 2011
to June 30, 2012; and
WHEREAS, in order to receive the Enforcement Assistance
Grant, the City must submit a Grant Application before May 13, 2011;•
and
WHEREAS, the Director of Health & Environmental Control has
recommended the execution of the Application to CalRecycle for funds
in the amount of approximately Fifteen Thousand Five Hundred Dollars
and No Cents ($15,500.00), to cover the cost of safety equipment,
monitoring tools, communications air time, salaries, accessories for
Verizon telephones, computer hardware, computer software, office
supplies, vehicle maintenance, and training and conference expenses.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves the Local Enforcement Agency Grant Application in the amount
of approximately Fifteen Thousand Five Hundred Dollars and No Cents
($15,500.00).
SECTION 3: The City Council of the City of Vernon hereby
authorizes and empowers the Director of Health and Environmental
Control, or his designee, to execute the Application on behalf of the
City of Vernon.
SECTION 4: The City Council of the City of Vernon hereby
authorizes -the Director of —Health and —Environmental C-oritro=lam orh=is
designee, to execute any and all documents necessary for the purpose
of securing grant funds and to implement and carry out the purposes
specified in the Grant Application for, and on behalf of, the City of
Vernon, including without limitation, a grant agreement with terms and
conditions substantially in conformity with the Local Enforcement
Agency Grant Program Terms and Conditions.
SECTION 5: The City Council of the City of Vernon hereby
directs the Director of Health and Environmental Control, or his
designee, to submit to CalRecycle the Local Enforcement Agency Grant
Application and a certified copy of this resolution to:

SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of,
Resolutions of the Council of this City.

responsibilities as a Solid Waste Local Enforcement Agency (LEA), and use remaining funds to

CalRecycle annually issues enforcement assistance grants to LEAS. Funds are available to improve
the capability of local agencies to inspect closed and active solid waste facilities. Our department
has successfully applied for and received grant monies from the CalRecycle for the last several
years.
With one permitted solid waste facility and ten closed sites within our jurisdiction, our department as
the LEA, is eligible for approximately $15,500.00 in Enforcement Agency Grant funds from
CalRecycle to procure necessary equipment, supplies, and training.

In order to receive the Enforcement Agency Grant, we must submit the following documents to
CalRecycle by May 13, 2011:
• Grant Application to CalRecycle
We are forwarding a draft resolution to the City Attorney for revision and submission. In the past,
we have also submitted a grant application. However, this year, because of State budgetary issues,
an application with an exact grant amount will not be available until the beginning of May when the
application deadline is also set.
In order to submit the grant application in a timely manner, we are requesting the City Council's
authorization in advance.
Following City Council approval, I will sign the Grant Application for submission to CalRecycle.
FISCAL IMPACT:
No negative fiscal impact is expected by approving this request. The grant funds will benefit the
City by reducing the amount of City funds needed to conduct mandated solid waste programs.
RECOMMENDATION:
We recommend that a resolution be drafted by the City Attorney and attached to the staff report
addressed to the Mayor and City Council Members for final approval. In order to meet the
submittal deadlines, we request that the resolution be submitted to the City Clerk for scheduling
consideration of this request at the Monday, April 19, 2011 City Council meeting.
