A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND AUTHORIZING THE EXECUTION OF
AN APPLICATION FOR THE 2011/2012 USED OIL PAYMENT
PROGRAM
WHEREAS, the people of the State of California have enacted
the California Oil Recycling Enhancement Act to discourage the
improper; illegal, and environmentally hazardous disposal of used oil;
and
WHEREAS, the Department of Resources Recycling and Recovery
("CalRecycle") administers the Used Oil Recycling Program and has
established procedures by which cities and counties may apply for
funding under the Used Oil Payment Program (formerly known as the
"Used Oil Block Grant Program"); and
WHEREAS, the City of Vernon received grant funds of
approximately Five Thousand Dollars ($5,000) per year from 1997
through 2010; and
WHEREAS, the City of Vernon has used the funds to improve
public awareness of opportunities to recycle used oil and the
environmental damage caused by the improper disposal of used oil; and
WHEREAS, CalRecycle is now accepting applications for the
Used Oil Payment Program for the fiscal year 2011/2012 ("OPP
Cycle 2"); and
WHEREAS, Vernon is expected to receive approximately Five
Thousand Dollars ($5,000) for the 2011/2012 cycle; and
WHEREAS, by memo dated June 6, 2011, the Director of Health
& Environmental Control has recommended that the 2011/2012 Used Oil
Payment Program Application be approved and executed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
approves and authorizes the submittal of an application for
CalRecycle's 2011/2012 Used Oil Payment Program for all available
grants under the California Oil Recycling Enhancement Act
("Application"), a copy of which is attached hereto as Exhibit A.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the execution of the Application by the Director of Health
& Environmental Control on behalf of the City of Vernon and hereby
authorizes the Director of Health & Environmental Control to execute
any and all documents, including but not limited to, applications,
agreements, amendments and requests for payment, necessary for the
purposes of securing grant funds for, and on behalf of, the
City of Vernon and to take whatever actions are deemed necessary or
desirable for the purpose of implementing and carrying out the
purposes of this Resolution and the actions herein approved or
authorized.
SECTION 4: The City Council of the City of Vernon hereby
directs the Director of Health & Environmental Control, or his
designee, to submit electronically prior to June 30, 2011, the
executed Application together with a copy of this Resolution to
CalRecycle.

SECTION 5: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.

Since 1997 the City Council has authorized the preparation of applications to the former California
Integrated Waste Management Board (Waste Board) for Used Oil Grant Funds. The Waste Board has
approved the applications and the City has received approximately $5,000 on a yearly basis (1997 through
2010). The grant funds have been used to improve the public's awareness of used oil recycling opportunities
and the damage to the environment caused from releases of used oil. Funded activities have included:
• The printing of the Used Oil Recycling Calendar
• The purchase of educational materials (pamphlets, etc.)
• The distribution of free used oil -recycling containers to Vernon business employees and the
public
• Stormwater mitigation activities
• The services of a consultant to conduct education outreach efforts
The former Waste Board, now known as the Department of Resources Recycling and Recovery
"CalRecycle," recently announced the opportunity for cities to apply for funds under the used oil payment
program, Fiscal -Year 2011/2012. Grant fund levels for Vernon are expected to be the same (approximately
$5,000).
I am requesting that the City Council provide authorization for me to submit the application for funds under
the Used Oil Payment Program on behalf of the City. I am attaching the application, which will need to be
submitted electronically, and a copy of a draft resolution for reference.
Please note that the application must be submitted by Thursday, June 30, 2011. Following City
Council approval, our department will submit the additional required documents to CalRecycle
(attached documents i.e.: the Resolution are due no later than August 1, 2011).

FISCAL IMPACT:
There is a minor fiscal impact that is expected for administrative oversight of the grant activities. However,
considering the benefits the City will receive by the grant funds contributing to outreach and educational
programs, the Used Oil Payment Program is worthwhile.
RECOMMENDATION•
We recommend that a resolution be drafted by the City Attorney authorizing the Director of Health &
Environmental Control Dept. to submit the application for funds under the Used Oil Payment Program on
behalf of the City, and be attached to the staff report for consideration by the Mayor and City Council members.
I am attaching the application, which our department will need to submit electronically, and a copy of a draft
resolution for reference.
Please note that the application must be submitted electronically by Thursday, June 30, 2011. Following
City Council approval, our department will submit the additional required documents to CalRecycle
(attached documents i.e.: the Resolution is due no later than August 1, 2011).
