Resolution No. 2011-143RESOLUTION NO. 2011-143 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A CONDITION OF USE PERMIT TO AT&T MOBILITY FOR THE OPERATION OF A TELECOMMUNICATION FACILITY LOCATED AT 5503 BOYLE AVENUE WHEREAS, AT&T Mobility ("AT&T") has applied for a conditional use permit to construct, operate and maintain an unmanned telecommunications facility at 5503 Boyle Avenue; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a condition use permit on August 16, 2011; and WHEREAS, the proposed project will consist of the installation of 12 panel antennas, 24 amplifiers mounted on a proposed 18-foot high monopole extension, 2 GPS antennas that will be installed and mounted within a proposed ll'-5" x 16'-0" equipment shelter, RBS 2206 (radio base station) cabinets and associated equipment that will be located within the proposed equipment shelter; and WHEREAS, AT&T is interested in leasing and sharing the existing cell -site area, the proposed cell site will be a stand alone business/operation with no need of occupancy, only with the exception of occasional maintenance work on the cell tower itself; and WHEREAS, the proposed cell site extension will not change and/or alter any part of the existing daily operations, employees, management, or traffic flow; and WHEREAS, the Project site is located in the I -Zone, Industrial, and is designated "industrial" by the City of Vernon General Plan; and WHEREAS, the proposed Project would be consistent with the applicable development standards and in accordance with section 26.4.1-3 (g) of the Comprehensive Zoning Ordinance, the Applicant is categorized as a "Telecommunications antenna and cell tower"; and WHEREAS, a telecommunications facility is allowed use in the I -Zone with the approval of a conditional use permit; and WHEREAS, the proposed use as to location, operation, and design is consistent with the General Plan and the Zoning Ordinance of the City of Vernon; and WHEREAS, the project is categorical exempt under Section 1533-2, Class 32, In -fill Development,: of the California Environmental Quality Act Guidelines ("CEQA"), therefore, a Notice of Exemption will be filed with the County Clerks office; and WHEREAS, the City Council has received a Staff Report, dated August 3, 2011 upon which it has relied in making the foregoing recitals; and WHEREAS, the proposed site is adequate in size, shape and topography, and has adequate parking, loading facilities, and drainage for the proposed operation; and WHEREAS, the proposed site will be supported by a 48 stall surface parking lot, most of the vehicular traffic at the existing facility will continue as before which includes employee and customer ingress/egress, trucks that deliver/pick-up product and supplies; and WHEREAS, the proposed unmanned cell site addition will not add to the existing vehicular traffic, therefore, the proposed project will not cause a significant traffic impact to the surrounding areas; and WHEREAS, the proposed site is surrounded by industrial, and warehousing uses compatible with the proposed use and no adverse effect from traffic, parking, noise, odors, smoke, light or glare are -2_ anticipated from the proposed operation; and WHEREAS, the conditions imposed on the conditional use permit will adequately protect the public health, safety and general welfare and the operation is consistent with all applicable rules and laws of the City of Vernon. NOW -THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION l: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby finds and determines that the proposed project is exempt from CEQA and hereby directs the City Clerk, or the City Clerk's designee, to file a Notice of Exemption with the County Clerk of the County of Los Angeles. SECTION 3: The custodian of records for the Project and all other material that constitute the record of proceedings upon which the City Council's decision is based is the City Clerk of the City of Vernon. Those documents are available for public review in the Office of the City Clerk located at 4305 Santa Fe Avenue, Vernon, California 90058. SECTION 4: Subject to the conditions set forth below, the conditional- use permit is hereby granted to AT&T for the operation of a telecommunications facility located at 5503 Boyle Avenue in the City of Vernon. SECTION 5: In order to adequately protect the public health and general welfare the following conditions are required: a. The applicant's facility shall be operated in accordance with, and made to conform with all the current codes, rules, and _3_ regulations including any required fees as adopted by the City of Vernon not otherwise addressed by this grant of a conditional use permit. b. The Applicant shall ensure that all parking and loading areas -are striped in a manner acceptable to the Director of Community Services & Water and are paved with a hard durable surface material and adequately drain, and are kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be installed and maintained to meet City standards. Adequate on -site parking shall be maintained so that no on street parking or staging will occur. C. All required federal, state, local and regulatory agency permits shall be obtained prior to operation. d. All subject work shall be in accordance with City Standards. No changes shall be made in the site development except with the prior approval of the Director of Community Services & Water. e. The proposed cell site shall be constructed and maintained substantially in compliance with the site plan submitted as part of this conditional use permit application. f. All graffiti on the site shall be removed or painted over to match the color of the surface to which it is applied within 24 hours of its occurrence. g. The applicant's facility shall not interfere with TV, radio or cordless phone reception or exceed limits established by the - 4 - FCC. Claims of interference with the operations of any business or residential use due to the operations of the facility shall be subjection to correction by the permittee. Any claim shall be reviewed by a qualified, mutually agreeable third party, who will test actual site conditions and propose mitigation of any interference determined to be due to the operation of the facility. h. All construction and/or installations associated with the -cell site shall be in compliance with the most current Building Codes (Building, Fire, Mechanical, Plumbing and Electrical) and Safety Codes and Regulations. AT&T shall obtain all necessary building, fire, mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department prior to commencement of construction. i. The facility's building shall be structurally maintained" to exclude rodents and the property shall be maintained rodent free. The site shall maintain adequate drainage to eliminate potential mosquito harborage. j. The Applicant shall ensure that no servicing or repairing of vehicles is permitted on the premises. No inoperative vehicles shall be stored on -site. All vehicles operated at the facility shall be tuned and maintained in accordance with applicable emission standards. k. The facility shall be operated in such a manner that noise and vibration shall not be a nuisance to neighborhood properties. At no time shall noise exceed or vibrations exceed the standards set _5_ forth in the City Zoning Ordinance. The facility shall comply with all CalOSHA noise requirements at all times. If the City in its sole discretion determines that a noise nuisance is caused by the operation, a noise study shall be prepared to the satisfaction of the City at AT&T cost to determine if the facility is in compliance with the City's Zoning Regulations. 1. The Applicant shall post a sign near the telecommunications tower in a visible, conspicuous location which has an emergency 24 hour contact phone number on it. M. The Applicant shall provide the Department of Customer Services Division with its revised electric load information which may necessitate upgrade to the electric service delivery. n. Should the Applicant request any additional electric meters, the electric switchgear shall be replaced with a multi -meter panel. o. Noncompliance with any of the conditions herein shall constitute sufficient grounds for the City Council of the City of Vernon to void this conditional use permit pursuant to Section 26.6.3-9 of the Comprehensive Zoning Ordinance. SECTION 6: The Applicant and any successors in interest shall indemnify, hold harmless and defend the City of Vernon, its officers, agents and employees from and against any and all claims, complaints or petitions for: (1) damages, losses, expenses resulting from bodily injury, sickness, disease, disability or death arising from the operation of the facility excluding therefrom any such claim resulting from the sole negligence or intentional wrongdoing of the - 6 - City of Vernon, its officers, agents or employees; (2) a peremptory writ or other relief by way of injunction, mandamus, or administrative mandamus; and/or (3) legal expenses and attorney's fees incurred by the City of Vernon on behalf of any party in such actions or proceedings. The City of Vernon does not waive its right to participate in the defense of any such action. SECTION 7: Not later than sixty (60) days from the date of this Resolution, the applicant shall indicate, in writing, its acceptance of and agreement with the conditions contained in Section 5 of this Resolution and the indemnification provision contained in Section 6 of the Resolution. SECTION 8: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City.. Currently there is an existing cell site/mono-pole which is located at the rear portion of the property. AT&T is interested in leasing and sharing the existing cell -site. THE PROJECT As previously mentioned, AT&T is seeking a conditional use permit for the installation and operation of an additional wireless telecommunication facility ("WTF") at 5503 Boyle Avenue. The proposed addition to the existing WTF will consists of (12) antennas and accessory equipment cabinets. Theantennas will be mounted onto an 18-foot high monopole extension, on an existing mono -pole. The proposed equipment cabinets will be on the ground adjacent to the existing mono -pole contained within an. enclosed (183 sq. ft.). equipment shelter (prefabricated shelter 11'xl6'). Three (3) sectors antennas are proposed and each sector will consist of anarray of four (4) antennas for a total of twelve (12) antennas; in addition; to the antennas will be one (1) GPS antenna that will be mounted, onto the proposed, equipment shelter, which will be. constructed adjacent to the existing cell site: The intent of these antennas and the placement of this facility on the subject propertys to provide coverage to the expanding community needs for cell phone and wireless coverage in and around this area of Vernon. This new cell facility will provide improved cellular service for those individuals who live, work, and visit the surrounding community. PROJECT SITE The project site is comprised of one existing building located on the same parcel. The building is approximately 22,000 square feet, and is currently used for an industrial use. The total property area of the proposed project is approximately 1.2 acres in size. AT&T proposes to construct, operate and maintain an unmanned telecommunications facility (expanding the existing footprint of the cell site by 600 sq. ft.). The new facility will be situated on the same portion of the property (located on the northwest corner of the property) next to the existing cell site and will share the same mono -pole that will be extended 18 feet higher. AT&T has proposed to pave the site with an impermeable surface that meets City of Vernon standards. Since the cell site addition is being placed at an existing location where it is not likely to be used for parking or loading, therefore, no impacts to existing operations or neighboring properties will occur. The proposed cell site addition will not change and/or alter any part of the existing operation, employees, management, or traffic flow. City staff has determined that the proposed site and development of the property is consistent with the applicable development standards. In addition, the proposed site will be supported by a 48 stall surface parking lot. Most of the vehicular traffic at the existing facility will continue as before which includes employee and customer ingress/egress, trucks that deliver/pick-up product and supplies. The proposed unmanned cell site addition will not add to the existing vehicular traffic. Therefore, the proposed project will not cause a significant traffic impact to the surrounding areas. There is one driveway that currently access the existing site, the driveway is located along Boyle Avenue. Trucks and automobiles accessing the site will continue to share the existing driveway along Boyle Avenue. Boyle Avenue is 80 feet wide and is of adequate size and pavement type to handle the traffic generated from the proposed operation. Motorists using the surrounding street system will not experience major changes in traffic due to the construction and operation of the unmanned telecommunications facility. Therefore, the proposed site is of adequate size, shape and topography for the proposed operation. Lastly, the property owner (R.A. Reed Electric Company) has given approval to AT&T to perform the work and pursue the necessary permitting and conditional use permit procedures (see attached site plan). ZONING AND GENERAL PLAN CONSISTENCY The Project site is located in the (I) Zone, Industrial, and is designated "industrial" by the City of Vernon General Plan. The proposed Project would be consistent with the applicable development standards. In accordance with section 26.4.1-3 (g) of the Comprehensive Zoning Ordinance, the Applicant is categorized as a "Telecommunications antenna and cell tower". A telecommunications facility is an allowed use in the (I) -Zone with the approval of a conditional use permit. CEQA DETERMINATION AND ENVIRONMENTAL CONSIDERATIONS The proposed site is surrounded by industrial and warehousing uses that are compatible with the proposed use. AT&T Mobility is bringing next -generation wireless data products - from corporate e-mail to downloadable ringtones - to customers nationwide through its advanced networks. AT&T is seeking approval which would allow for the construction, operation, and maintenance of an unmanned AT&T telecommunications facility. The facility will consist of an 18' extension to the existing mono -pole telecommunications facility and an 11'-5" x 16'-0" equipment shelter in a leased area adjacent to the mono -pole at the rear portion of the property. The proposed facility will include twelve antennas total configured in three sectors located on the upper portion of the mono -pole extension and the necessary equipment; 2 GPS antennas and an electrical meter mounted to the shelter and within the shelter - power plant, equipment cabinets, equipment racks, emergency equipment, and necessary cabling. EXISTING USE The property is an existing industrial property that is being used as a manufacturing facility. There is a portion of the property that is currently leased by Crown Castle for the placement of an existing mono -pole cell tower and equipment, The Crown Castle lease area is at the westerly "pie -shaped" corner of the property located at 5503 South Boyle Avenue. There is a total height of 60' feet to the top of the existing antennas. The Assessor Parcel Number is 6310-011-001. The zoning designation on the property is I — Industrial. Boyle Avenue BLACK & VEATCH PROJECT OVERVIEW Black & Veatch, on behalf of AT&T, proposes a collocation telecommunications facility in conjunction with an existing carriers' mono -pole facility in an industrial area of Vernon. The lease area for the equipment shelter is rectangular in shape and proposed to be approximately 185 square feet in size located at the westerly end of the property in an existing gravel area adjacent to the paved parking lot. Power to the facilities will be gained through a new underground conduit that connects to the site power just south of the existing building. The three sectors containing four antennas each will be located at the upper portion of the proposed mono -pole extension. Access to the lease areas is proposed from the driveway entrance off South Boyle Avenue towards the westerly portion of the property.. Equipment Cabinets: The proposed cabinets are to be located within the new equipment shelter at the westerly corner of the property. The cabinet shelter has been situated in a location to minimize visual impact. The general dimensions of the cabinet shelter are approximately 1 V-F x 16-0". Equipment Cabinets and Noise The power to run these equipment cabinets is from a new electrical meter which will be mounted to the equipment shelter. The cables that bring power to the meter are from the existing onsite power located at the south of the building along the property line. The cabinet shelter will be designed to emit the minimum amount of noise air -conditioners can generate. No exterior or outdoor generators, diesel or propane, are proposed for this location. Antennas: The proposed antennas are configured in three sectors at the upper portion of the mono -pole extension. • Sector 1 - "alpha" sector will contain four panel antennas. The RAID center will be +/- 73'-011 . • Sector 2 — "beta" sector will contain four panel antennas. Construction: According to the Construction Manager, construction timing for the antennas and cabling is generally 5 to 8 weeks duration. This time line is not 5 to 8 weeks of constant work. The maximum time for construction for the City's purposes is 8 weeks or less. Construction will commence once building permits are received and carrier interest has been contracted. The number of vehicles that will be required during the course of construction will be up to 6 to 8 vehicles on any given day. The required parking for the overall property is 22 spaces and the existing number is 48 which is more than enough to cover the extra parking required during construction. OPERATIONAL OVERVIEW Once constructed and operational, the communications facility will provide 24-hour service to its users seven days a week. Apart from initial construction activity, the facility will be serviced by a carrier technician on a periodic monthly or as needed basis. SITE SELECTION AND JUSTIFICATION AT&T has been working to accommodate carrier build -out and expansions in Southern California. Location Selection The primary objective of this wireless facility was to accommodate customers in the local area. As such, the 18' mono -pole extension provided enough elevation to keep the necessary distance between the existing antennas and fulfill coverage needs. ADDITIONAL PROJECT JUSTIFICATION Planning/Zoning Consistency and Findings This infrastructure will significantly improve communication service in the area in terms of allowing greater capacity opportunities for carriers and their customers, and further enhance the general welfare of the public by requiring a collocation facility that will minimize the proliferation of single poles in the area. The proposed facility is generally compatible with the existing uses within the I — Industrial zone, both in terms of use and aesthetics, primarily due to the industrial design of the existing mono -pole. Because this is a highly industrialized area, the design of the mono -pole should remain as it is and no attempts to camouflage the mono -pole should be made. COMPATIBILITY WITH OTHER SITE DEVELOPMENT STANDARDS The location, size, design, and operating characteristics of the proposed communications facility will not create unusual noise, traffic or other conditions or situations that may be objectionable, detrimental or incompatible with other permitted uses in the vicinity. The proposed use is consistent with this finding in that: • The equipment associated with the communication structures operates quietly or virtually noise free. • The equipment does not emit fumes, smoke, or odors that could be considered objectionable. • The communications facility is unmanned and only requires periodic maintenance, which equates to approximately one trip per month. • There will be no hazardous materials used or stored on site in association with the proposed antennas and equipment. The proposed communications facility will not result in conditions or circumstances contrary to the public health, safety and general welfare. The proposed use is consistent with the finding that: Like all electrical devices, wireless antennas produce electromagnetic fields (EMFs), the invisible lines of force that surround any electric current. We are constantly exposed to a variety of such fields from natural and man-made sources. The wireless telephone industry is designed to function EL0324 5503 S. Even many local government, police and fire department towers produce levels of wattage 4 to 5 times that emitted by a wireless communications tower. The effect of wireless radio frequencies compared to other AM and FM signals, and TV transmissions is considered negligible by the industry's regulatory agencies. There are too many frequencies separating the various wireless service providers to cause any adverse effects. Cellular only uses 3% of the radio frequency spectrum, and the cellular transmissions are at very low power levels. Moreover, all FCC licensed wireless service providers are prohibited from maintaining any interference with existing licensed communication uses, and must comply with all FCC emissions guidelines. FCC Determination In a declaratory ruling recently adopted, the Federal Communications Commission ("FCC') established timeframes of 90 Days for collocations and 150 Days for all other tower siting applications reviewed by state and local government agencies.
