A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AMENDING RESOLUTION NO. 9786 REGARDING THE
DETERMINATION FOR EMPLOYER PAID MEMBER
CONTRIBUTIONS TO THE PUBLIC EMPLOYEES' RETIREMENT
SYSTEM ("EPMC RESOLUTION"), BY AMENDING THE
ELECTION CONDITIONS OF THE EPMC RESOLUTION
(AMENDMENT NO. 2)
WHEREAS, on December 15, 2008, the City Council of the City
of Vernon adopted Resolution No. 9786 to be effective on July 1, 1984,
providing for employer paid member contributions (EPMC) to the
California Public Employees' Retirement System ("PERS"); and
WHEREAS, on March 1, 2010, the City Council of the City of
Vernon adopted Resolution No. 2010-35 providing for new conditions for
the purpose of its election to pay EPMC for those employees in the
Vernon Police Officers Benefit Association bargaining unit; and
WHEREAS, on July 5, 2011, the City Council of the City of
Vernon adopted Resolution No. 2011-127 approving a Memorandum of
Understanding ("MOU") with the Vernon Police Officers' Benefit
Association; and
WHEREAS, the Director of Personnel has recommended that the
EPMC Resolution be amended providing for those employees in the Vernon
Police Officers Benefit Association bargaining unit be responsible for
their PERS employee's contributions pursuant to Article Seven, Section
1 of the MOU; and
WHEREAS, the City Council of the City of Vernon wishes to
amend the EPMC Resolution to implement the aforementioned changes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon
hereby finds and determines that the recitals contained hereinabove
are true and correct.
SECTION 2: Effective July 5, 2011, the City Council of the
City of Vernon hereby amends the EPMC Resolution to provide for
employees in the Vernon Police Officers Benefit Association bargaining
unit be responsible for their PERS employee's contributions.
SECTION 3: The provisions of Resolution No. 9786, not
consistent with or in conflict with this Resolution are hereby
repealed; in all other respects, Resolution No. 9786 shall remain in
full force and effect.
SECTION 4: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this Resolution, and
the City Clerk of the City of Vernon shall cause this Resolution and
the City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.
