Resolution No. 2011-177RESOLUTION NO. 2011-177 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON ACCEPTING THE WORK OF SULLY -MILLER CONTRACTING COMPANY IN ACCORDANCE WITH CONTRACT NO. CS-0020 OF THE CITY OF VERNON WHEREAS, Sully -Miller Contracting Company was awarded Contract No. CS-0020 for 26th Street improvements pursuant to Resolution No. 2010-181 of the City of Vernon; and WHEREAS, the Director of Community Services and Water has reported to the City Council of the City of Vernon that said work has been completed and recommends that the work be accepted and payment be made to the Contractor in accordance with the agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council.of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The work of Sully -Miller Contracting Company pursuant to Contract No. CS-0020 is hereby approved and accepted by the City Council of the City of Vernon. SECTION 3: The original contract amount was Eight Hundred Seventy -Three Thousand Two Hundred Twelve Dollars and Twenty -Four Cents ($873,212.24). Two change orders were issued for a total final contract amount of Eight Hundred Ninety -Nine Thousand Four Hundred Twenty -Seven Dollars and Twenty -Four Cents ($899,427.24). A final progress payment of Thirty -Eight Thousand Seven Hundred Ninety Dollars and Eighteen Cents ($38,790.18) is now due. The ten percent retention (10%) or the sum of Eighty -Nine Thousand Nine Hundred Forty -Two Dollars and Seventy -Two Cents ($89,942.72) is payable thirty-five (35) days after the recordation of the Notice of Completion, except such amounts as are required by law to be withheld by properly executed and filed notices to stop payment, or as may be authorized by the contract to be further retained. SECTION 4: The City Council of the City of Vernon hereby directs payment of said sums as set forth to Sully -Miller Contracting Company and instructs the City Clerk to file a Notice of Completion with the County Recorder. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. The original bids were received on October 27, 2010 and the contract was awarded to Sully -Miller Contracting Company in the total bid amount of $873,212.24 (Eight Hundred Seventy Three Thousand Two Hundred Twelve Dollars and twenty four cents) on December 6, 2010. Actual breakdown construction costs of 26'h Street Improvements project are as follow: (1) Relocation of 8 power poles at southeast corner of 261h Street and Soto Street, City of Vernon, Light and Power Dept. = $ 230,373.57 (2) 26`h Street Improvements, Sully -Miller Contracting Company = $ 899,427.24 (3) Material Testing and Inspection, Smith Emery Laboratories = $ 11,273.00 Total Construction cost = $ 1,141,073.81 The total construction cost (100%) for 26`h Street Improvements project will be reimbursed from two secured grant funds of $1,150,000.00 ($500,000.00 from American Recovery and Reinvestment Act (ARRA) fund and $650,000.00 from Phase II of the Truck Impacted Intersection, Gateway Cities fund). Therefore, no city fund is required for construction of this project. The Sully -Miller Contracting Company's final total contract amount including Change Orders No. 1 and 2 is $899,427.24 (Eight Hundred Ninety Nine Thousand Four Hundred Twenty Seven Dollars and twenty four cents). It is recommended that the project be accepted and the final progress payment of $38,790.18 (Thirty Eight Thousand Seven Hundred Ninety Dollars and eighteen cents) be paid.
