Resolution No. 2012-004RESOLUTION NO. 2012-04 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON RECITING THE FACT OF THE MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2011 AND THE SPECIAL MAILED BALLOT ELECTION HELD ON NOVEMBER 22, 2011, DECLARING THE RESULTS AND SUCH OTHER MATTERS AS PROVIDED BY LAW WHEREAS, a Municipal Election was held and conducted in the City of Vernon, California, on Tuesday, November 8, 2011, as required - by law; and WHEREAS, pursuant to Resolution No. 2011-86, as amended, the election was conducted entirely by vote -by -mail ballot pursuant to Section 4000, et seq., of the Elections Code of the State of California; and WHEREAS, a Special Mailed Ballot Election was held and conducted in the City of Vernon, California, on Tuesday, November 22, 2011, as required by law; and WHEREAS, pursuant to Resolution No. 2011-148, as amended, the election was conducted entirely by vote -by -mail ballot pursuant to Section 4000, et seq., of the Elections Code of the State of California; and WHEREAS, notice of the elections were given in time, form and manner as provided by law; and WHEREAS, election officers were appointed, vote -by -mail ballots were properly sent to all registered voters, and in all respects the election was held and conducted, the votes were cast, received and canvassed, and the returns were made and declared in the time, form and manner required by the City Charter and the Elections Code of the State of California; and WHEREAS, the City Clerk canvassed the returns of the elections and has certified the results to the City Council, which certification and results are received, attached and made part hereof as Exhibit A. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: One (1) voting precinct was established for the purpose of holding said Elections, consisting of the regular election precinct in the City as established for the holding of State and County elections. SECTION 3: The whole number of vote -by -mail voter ballots cast in the City for the Municipal Election held on November 8, 2011, was 53 and no provisional ballots were cast in the City. SECTION 4: The following measures voted upon at the November 8, 2011, Municipal Election was as follows: Measure A: Shall the Vernon.City Charter YES be amended to limit the number of terms a City Council member may serve at two terms, with a lifetime rro ban thereafter? 2 Measure B: Shall the Vernon City Charter YES be amended to reaffirm the City's longstanding policy of ensuring the payment of NO prevailing wages on public works projects? Measure C: Shall the Vernon City Charter YES be amended to remove the provision mandating at -will employment for City NO employees? Measure D: Shall Article VI of the YES Vernon City Charter be amended to eliminate restrictions on the City Council's authority to remove the City Administrator and to NO reduce the City Administrator's compensation? SECTION 5: The whole number of vote -by -mail voter ballots cast in the City for the Special Mailed Ballot Election held on _3- November 22, 2011, was 51 and no provisional ballots were cast in the City. SECTION 6: The following measures voted upon.at the November 22, 2011, Special Mailed Ballot Election was as follows: Measure E: Shall the Vernon City Charter YES _ be amended to require that the City maintain a Housing Commission? NO Measure F: Shall the Vernon City Charter YES be amended to ensure that an Independent Reform Monitor is retained for four years? NO — Measure G: Shall the Vernon City Charter YES be amended to require a special election to fill vacancies on the City Council and prohibit the appointment NO of council members by the City Council? 4 Measure H: Shall the Vernon City Charter YES be amended to prohibit council members from increasing their compensation NO in excess of cost -of -living adjustments? Measure I: Shall the Vernon City Charter YES be amended to remove restrictions on the use of revenues from the City's Light and Power enterprise NO deposited into the City's Light and Power Fund? Measure J: Shall the Vernon City YES _ Charter be amended to require the establishment of a process allowing for open and competitive bidding on NO _ City service contracts by City Council ordinance? 5 SECTION 7: The number of votes given in the one voting precinct in the City for and against the measures is as listed in Exhibit A attached hereto. SECTION 8: The City Council does declare and determine that as a result of the Municipal Election and Special Mailed Ballot Election, a simple majority of the voters voting on the above measures did vote in favor of all measures, and the measures were carried, and shall be deemed approved and adopted. SECTION 9: The City Clerk shall enter on the records of the City Council of the City, a statement of the result of the election, showing: (1) The whole number of votes cast in the City; (2) The measure voted upon; (3) The total number of votes given in the City for and against the measure. SECTION 10: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this Resolution, and the City Clerk of the City of Vernon shall cause this Resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Chapter 3.4 of Article III of the Charter of the City of Vernon is amended in its entirety to read as follows: "CH: 3.4 Election and Terms The regular election of councilmembers shall be held on the second Tuesday of April in each year, commencing in 2010. The terms of council members shall be staggered so that each council member shall serve a five year term and one council member shall be elected each year; provided, however, that in order to effect the election of council members according to staggered terms as set forth above, upon adoption of this section by the voters, the City Council shall assign each Council position a number, with the Council seats which expire in 2010 assigned numbers 1, 2 and 3 by lot, and Council seats which expire in 2012 assigned numbers 4 and 5 by lot. Council seat number 3 will be subject to election for five year terms commencing in 2010. Council seat number 1 will have its term extended one year to 2011, and will be subject to election for five year terms commencing in 2011.. Council seat number 2 will have its term extended two years to 2012, and will be subject to election for five year terms commencing in 2012. Council seat number 4 will have its term extended one year to 2013, and will be subject to election for five year terms commencing in 2013. Council seat number 5 will have its term extended for two years to 2014, and will be subject to election for five year terms commencing in 2014. No person may serve more than two terms of office as member of the City Council. This limitation on the number of terms of office shall apply prospectively only and terms of office that began before the effective date of this chapter shall not apply to the two term limit. The completion of any unexpired term to which a councilmember was elected shall not be considered a term for the purposes of this chapter. The City Council shall be the final judge of election results and the qualifications of its members. The City Council shall canvass the returns of an election on the first Tuesday following a city council election or such other date within fifteen days of the election as may be provided by ordinance. The terms of each elected council -member shall begin at the hour of the completion of the canvass of the election returns. In the absence of death, removal from office or disqualification, each councilmember shall serve until expiration of his or her term and until a successor qualifies." 2. Chapter 8.13 of Article VIII of the Charter of the City of Vernon will read as follows: "CH: 8.13 Prevailing Wages The provisions of California Labor Code 1770 et. seq. regarding the payment of prevailing wages on public works and related regulations, as now existing and as may be amended, are accepted, reaffirmed and made applicable to the City, its departments, boards, officers, agents and employees." 3. Chapter 7.6 of Article VII of the Charter of the City of Vernon will be deleted in its entirety. The provision previously read: "CH: 7.6 Employees All city employees shall serve at the will and pleasure of the city council. No city employee shall have any right to employment with the city unless that employee and the city have entered into a written contract which gives the employee a property right to employment with the city." 4. Article VI of the Charter of the City of Vernon is amended in its entirety to read as follows: "Article VI. City Administrator. CH: 6.1. Appointment. The city council shall appoint, by majority vote, a city administrator who shall be the chief administrative officer of the City of Vernon. The city administrator shall serve at the pleasure of the council except as may otherwise be provided by written contract. The city administrator shall engage in no other business or occupation except as may be permitted by the council. CH: 6.2. Compensation. Compensation for the city administrator shall be set by the city council. CH: 6.3. Duties. The city administrator shall be responsible to the city council for the proper and efficient management of all the affairs of the city and those specific duties assigned to the city administrator by this Charter or by the city council. The specific duties of the city administrator may be specified by ordinance, resolution or order of the city council. CH: 6.4. Noninterference. The power to direct the city administrator rests with the council as a governing body, not with its individual members. No individual member of the council, without authorization of the council, shall in any manner direct or request the city administrator to appoint any person to and/or remove any person from any office or position of employment with the city. No individual member of the city council, without authorization of the council, shall give orders or instructions publicly or privately to any person under the jurisdiction of the city administrator or otherwise interfere with the administrative staff of the city. No individual member of the city council, without authorization of the council, shall undertake to coerce or direct the city administrator with respect to any of the city administrator's duties, and/or any municipal contract, and/or in connection with the purchase of any municipal supplies. CH: 6.5. Eligibility. No person shall be eligible to be appointed city administrator while serving as a member of the city council or within two years following the termination of membership on the city council. CH: 6.6. Other positions. The city council may appoint the city administrator to any other office in the city and direct the city administrator to carry out the duties of that office or any other position of employment with the city in addition to his or her duties as city administrator." AMENDMENTS TO VERNON CITY CHARTER PASSED BY THE VOTERS ON NOVEMBER 22, 2011 S. Chapter 7.5 of Article VII of the Charter of the City of Vernon is amended in its entirety to read as follows: "CH: 7.5 Boards and commissions. The city council may, by ordinance, establish such boards and commissions as the council deems to be necessary, and shall provide for the method of selection, tenure, duties and any compensation of the boards and commissions so established. There shall be established .a Housing Commission, which shall oversee the day-to-day management, leasing and maintenance of city -owned housing stock." 6. Chapter 9.7 of Article IX of the Charter of the City of Vernon will be added to read as follows: "CH: 9.7 Independent reform monitor. For a period of four years from the adoption of this provision, there shall be a contract with an independent reform monitor who shall review the city's policies and procedures and recommend city governance reform measures and initiatives in the best interest of the city. The independent reform monitor shall execute these duties independently of the city council and any city officer. The independent reform monitor shall have the power to conduct audits of all city operations and budgets as well as review any proposed service contract that is substantial in nature. The independent reform monitor shall report back annually to the state legislature on the progress of the city's reform efforts and shall make recommendations on any additional reforms that may be necessary." 7. Chapter 3.7 of Article III of the Charter of the City of Vernon is amended in its entirety to read as follows: "CH: 3.7 Vacancy. If an election occurs at which one or more full terms and one or more unexpired terms are to be filled, no distinction between the full terms and the unexpired terms shall be made in nominating or voting. The person or persons elected by the highest number of votes shall be elected for the full term or terms and the person or persons elected with the fewest votes shall be elected for the unexpired term or terms." 8. Chapter 3.11 of Article III of the Charter of the City of Vernon is amended in its entirety to read as follows: "CH: 3.11 Compensation. The council may determine the base compensation of councilmembers by resolution adopted by a majority vote of the members of the council. Any change in the base compensation of councilmembers shall be effective on the first day of the following fiscal year or such other date as may be specified in the resolution. The council shall not increase the base compensation of councilmembers in excess of cost -of -living adjustments. In addition to such base compensation, individual councilmembers may be compensated for serving on city boards, commissions, committees or other city governmental bodies. Such additional compensation shall be set by resolution adopted by a majority vote of the members of the council. Any change in additional compensation of councilmembers shall be effective on the first day of the following fiscal year or such other date as may be specified in the resolution. The council shall not increase such additional compensation of councilmembers in excess of cost -of -living adjustments. Councilmembers sha11 also receive compensation for actual or anticipated expenses that may be incurred in the performance of their duties of office." 9. Chapter 8.12 of Article VIII of the Charter of the City of Vernon will be deleted in its entirety: 10. The city council shall have the power, by majority vote, to enter into any contract on behalf of the city. All contracts must be in writing, signed by the mayor or other officer authorized by resolution, and attested by the city clerk. There shall be no bidding requirements for any contract unless the city council otherwise provides by ordinance, with the exception that an open and competitive bidding process shall be established for service contracts. The city council shall establish by ordinance the specific provisions for such open and competitive bidding process." The city administrator shall be responsible to the city council for the proper and efficient management of all the affairs of the city and those specific duties assigned to the city administrator by this Charter or by the city council. The specific duties of the city administrator may be specified by ordinance, resolution or order of the city council. CH: 6.4. Noninterference. The power to direct the city administrator rests with the council as a governing body, not with its individual members. No individual member of the council, without authorization of the council, shall in any manner direct or request the city administrator to appoint any person to and/or remove any person from any office or position of employment with the city. No individual member of the city council, without authorization of the council, shall give orders or instructions publicly or privately to any person under the jurisdiction of the city administrator or otherwise interfere with the administrative staff of the city. The specific duties of the city administrator may be specified by ordinance, resolution or order of the city council. CH: 6.4. Noninterference. Senate Bill 7 facilitated the addition of Section 1782 to the California Labor Code. The new law restricts state funding or financial assistance to cities that are not in compliance with California's prevailing wage laws. It also requires the Director of Industrial Relations to maintain a list of charter cities that may receive state funding or financial assistance for their construction projects. A copy of the law is enclosed for your convenience. Section 1782 of the Labor Code prohibits charter cities from receiving or using state funding or financial assistance for a construction project unless the city requires contractors on its public works to comply with California's prevailing wage requirements. Specifically, charter cities may receive state funding or financial assistance if the city has a local prevailing wage ordinance, applicable to all of its public works contracts, that includes requirements that are equal to or greater than the state's prevailing wage requirements. Section 1782 excludes contracts for projects of $25,000 or less for construction work, or projects of $15,000 or less for alteration, demolition, repair, or maintenance work. The law does not apply to funding that was awarded or bids advertised or awarded prior to January 1, 2015. (a) A charter city shall not receive or use state funding or financial assistance for a construction project if the city has a charter provision or ordinance that authorizes a contractor to not comply with the provisions of this article on any public works contract. (b) A charter city shall not receive or use state funding or financial assistance for a construction project if the city has awarded, within the prior two years, a public works contract without requiring the contractor to comply with all of the provisions of this article. This subdivision shall not apply if the charter city's failure to include the prevailing wage or apprenticeship requirement in a particular contract was inadvertent and contrary to a city charter provision or ordinance that otherwise requires compliance with this article. (c) A charter city is not disqualified by subdivision (a) from receiving or using state funding or financial assistance for its construction projects if the charter city has a local prevailing wage ordinance for all its public works contracts that includes requirements that in all respects are equal to or greater than the requirements imposed by the provisions of this article and that do not authorize a contractor to not comply with this article. (d) For purposes of this section, the following shall apply: (1) A public works contract does not include contracts for projects of twenty-five thousand dollars ($25,000) or less when the project is for construction work, or projects of fifteen thousand dollars ($15,000) or less when the project is for alteration, demolition, repair, or maintenance work. (2) A charter city includes any agency of a charter city and any entity controlled by a charter city whose contracts would be subject to this article. (3) A "construction project" means a project that involves the award of a public works contract. (4) State funding or financial assistance includes direct state funding, state loans and loan guarantees, state tax credits, and any other type of state financial support for a construction project. State funding or financial assistance does not include revenues that charter cities are entitled to receive without conditions under the California Constitution. (e) The Director of Industrial Relations shall maintain a list of charter cities that may receive and use state funding or financial assistance for their construction projects. (f) (1) This section does not restrict a charter city from receiving or using state funding or financial assistance that was awarded to the city prior to January 1, 2015, or from receiving or using state funding or financial assistance to complete a contract that was awarded prior to January 1, 2015.
