Resolution No. 2012-007RESOLUTION NO. 2012-07 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON AMENDING RESOLUTION NO. 2011-129 REGARDING THE COMPENSATION, COSTS AND BENEFITS OF ITS EMPLOYEES ("PERSONNEL RESOLUTION") BY AMENDING SECTIONS 9, 10 AND 15(c) AND SCHEDULE NO. III OF THE PERSONNEL RESOLUTION (AMENDMENT NO. 1) WHEREAS, on July 19, 2011, the City Council of the City of Vernon adopted Resolution No. 2011-129 to be effective on July 1, 2011, regarding the compensation, costs and benefits of its employees, (the "Personnel Resolution"); and WHEREAS, Section 9 of the Personnel Resolution provides for items regarding the longevity program for employees employed on or before June 30, 1994; and WHEREAS, Section 10 of the Personnel Resolution provides for items regarding the longevity program for employees employed on or after July 1, 1994; and WHEREAS, Section 15(c) of the Personnel Resolution provides for items relating to Police Management Employees; and WHEREAS, Schedule No. III, Exhibit C, of the Personnel Resolution provides for positions and salary scales of positions within the City Administration Department; and WHEREAS, by memo dated December 13, 2011, the City Administrator has recommended that (i) Sections 9, 10 and 15(c) of the Personnel Resolution regarding the Longevity Program and Police Management Employees be amended and (ii) that a salary scale for the position of Assistant to the City Administrator be created; and WHEREAS, the City Council of the City of Vernon wishes to amend Sections 9, 10, and 15(c) and Schedule No. III (Exhibit C) of the Personnel Resolution to implement the aforementioned changes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby amends Section 9 of the Personnel Resolution to delete subsection (g). SECTION 3: The City Council of the City of Vernon hereby amends Section 10 of the Personnel Resolution to read as follows: SECTION 10: LONGEVITY PROGRAM FOR EMPLOYEES ON OR AFTER JULY 1, 1994. The longevity program described in Section 10 herein will apply to all employees, except Department Heads and employees covered in a collective bargaining agreement, employed on or after Julv 1, 1994. a. miscellaneous Employees Employed on or After July 1, 1994 - Five (5) Years of Service. All eligible employees who are employed on or after July 1, 1994, who attain five (5) years of consecutive uninterrupted service shall receive an additional five percent (5%) per month of their base salary. Such employees upon reaching their 5th anniversary date shall be entitled to receive said five percent (5%) per month upon said anniversary date. Further, such employees will not be entitled to receive any additional percentage increase to their base salary for further service. This subsection shall only apply to employees hired on or after July 1, 1994 and shall not apply to Department Heads. 2 SECTION 4: The City Council of the City of Vernon hereby amends Section 15(c) of the Personnel Resolution in its entirety to read as follows: C. Police Management Employees. For the purposes of this resolution, Police Management Personnel are defined as the Police Chief, Police Captains and Lieutenants, and they shall receive the following employment conditions as set forth in the respective sections of the VPOBA MOU: (1) Bilingual Pay: Article III, Section 6 (2) "P.O.S.T." Certificate Incentive: Article III, Section 7 (3) Shooting Pay: Article III, Section 8 (4) FLSA Overtime: Article V, Section 2 (5) Comp Time: Article V, Section 3 (6) Court Attendance and "Standby" Time: Article V, Section 6 (7) Call Backs: Article V, Section 7 (8) Uniform Allowance: Article VI, Section 1 (9) Safety Equipment: Article VI, Section 3 (10) Retirees Medical: Article VII, Section 4 (11) "In -lieu" Holiday Time: Article VII, Section 6 (12) Sick Leave: Article VII, Section 7 (13) Bereavement Leave: Article VII, Section 8 a. Twenty-five (25) hours for Lieutenants assigned to patrol duties and twenty (20) hours for Lieutenants assigned to administrative duties. SECTION 5: Schedule No. III (Exhibit C) of the Personnel Resolution is hereby amended to add the position of Assistant to the - 3 - City Administrator and the related scale, a copy which is attached hereto as Exhibit A. SECTION 6: The amendments provided in this resolution shall take effect on January 1, 2012. SECTION 7: The provisions of Resolution No. 2011-129 not consistent with ors'n conflict with this resolution are hereby repealed; in all other respects, Resolution No. 2011-129, shall remain in full force and effect. SECTION 8: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this Resolution, and the City Clerk of the City of Vernon shall cause this Resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator RE: Amendment No.1 to Personnel Resolution for Fiscal Year 2011-2012 Background On July 19, 2011, the City Council adopted a new comprehensive personnel resolution for fiscal year2011-2012. The resolution so adopted erroneously neglected to include all necessary updates to the Police Management Employees subsection based on the new Police MOU recently approved. Those updates have been incorporated into Section 15(c) of the proposed Amendment No. 1 to the Personnel Resolution attached hereto. The proposed amendment also includes general corrections to Sections 9 and 10 respecting the longevity program to remove Section 9(g), Employees Employed After June 30, 1994, since Section 9 addresses the longevity program only for employees employed on or before June 30, 1994. Section 10 addresses the longevity program for employees employed on or after July 1, 1994. Lastly, the proposed amendment includes the creation of the Assistant to the City Administrator position and corresponding salary scale, originally requested in June 2011. The proposal for this position is dictated by the current on ongoing workload of the City Administration Department, including the implementation of numerous citywide reforms, ongoing financial, legislative, and policy matters, and regular communication with all City departments, outside consultants, and officials from other legislative bodies and organizations. The job description for the proposed position is attached. Recommendation It is recommended that the proposed Amendment No. 1 to the Personnel Resolution for fiscal year 2011-2012 be adopted. Assistant to the City Administrator DEFINITION: Under general direction, performs a wide variety of complex professional, administrative, analytical, and management support within the City Administrator's Department; develops, implements, and administers City projects procedures; conducts research; performs other related duties as required. DISTINGUISHING CHARACTERISTICS: The Assistant to the City Administrator is expected to independently perform the full scope of administrative, analytical, and management support duties within the City Administrator's Department and assigned areas. The incumbent is expected to handle confidential and sensitive assignments with an understanding of the impact that various projects have on Citywide operations. This classification is distinguished from the next higher classification of Assistant City Administrator, in that the latter has more broad and complex assignment areas and will serve as the City Administrator in his or her absence. SUPERVISION RECEIVED/EXERCISED: Receives general direction from the City Administrator. May exercise direct and indirect supervision over technical and office support staff. ESSENTIAL FUNCTIONS: (include but are not limited to the following) • Assists in the development and implementation of departmental, interdepartmental, and citywide goals, objectives, policies, programs, and procedures. • Serves as a liaison and advisor assisting department management and employees in a variety of matters. • Conducts studies of organizational, administrative, and operational issues; reviews and analyzes processes, procedures, and work methods; analyzes legislation; develops funding proposals, policy alternatives, and strategies; prepares and presents reports and recommendations; demonstrates an understanding of applicable policies, procedures, and work methods associated with assigned duties. • Performs analysis and review of administrative, financial, and operational systems; compiles and interprets statistical, and financial data; conducts studies and surveys and provides research on a variety of organizational issues. • Attends staff, City, Council and/or Commission Board meetings as assigned; assists in the preparation of the City Council Agenda. • Participates in the development and implementation of program budgets; assists in analyzing past and future revenue projections; participates in the forecast of necessary funds for staffing, materials, services, and supplies; monitors and assists in the administration of the approved budget. • Establishes positive working relationships with representatives of community organizations, state/local agencies and associations, City management and staff, and the public. OTHER DUTIES: (include but are not limited to the following) • May select, train, and supervise assigned support staff. • May develop Request For Proposals and see them through the hearing process; assists in screening, interviewing, and selecting consultants; coordinates the final hiring process. • May be exposed to confidential and privileged information during the course of duties, which should be maintained as such. • Performs other related duties as required. PHYSICAL, MENTAL AND ENVIRONMENTAL WORKING CONDITIONS: Position requires prolonged sifting, standing, walking, reaching, twisting, turning, kneeling, bending, squatting, and stooping in the performance of daily activities. The position also requires grasping, repetitive hand movement, and fine coordination in preparing reports using a computer keyboard. Additionally, the position requires near and far vision in reading written reports and work related documents. Acute hearing is required when providing phone and personal service. Additionally, need to lift, drag ,and push files, paper, and documents weighing up to 25 pounds is required. Some of these requirements may be accommodated for otherwise qualified individuals requiring and requesting such accommodations. QUALIFICATIONS: (The following are minimal qualifications necessary for entry into the classification.) Education and/or Experience: Any combination of education and experience that has provided the knowledge, skills, and abilities necessary for an Assistant to the City Administrator. A typical way of obtaining the required qualifications is to possess three years of progressively responsible administrative, analytical and technical experience, and a bachelor's degree in political science, business administration, public administration, accounting, or a related field, License/Certificate: Possession of, or ability to obtain, a valid Class C California driver's license KNOWLEDGE/ABILITIES/SKILLS: Knowledge of: Modern principles, practices, and methods of administrative and organizational analysis; public administration policies and procedures; GAAP accounting principles and financial statements; research and reporting methods, techniques and procedures; structure and organization of public sector agencies; budget development and implementation; basic principles of mathematics; applicable federal, state, and local laws, codes, and regulations; methods and techniques of scheduling work assignments; standard office procedures, practices, and equipment; modern office practices, methods and equipment, including a computer and applicable software; methods and techniques for record keeping and report preparation and writing; proper English, spelling, and grammar; occupational hazards and standard safety practices.
