Resolution No. 2012-010RESOLUTION NO. 2012-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING AND AUTHORIZING NOTICE INVITING SEALED PROPOSALS OR BIDS FOR THE PURCHASE OF TWO 2012 CHEVROLET TAHOE POLICE PATROL VEHICLES AND ONE 2011 FORD CROWN VICTORIA POLICE INTERCEPTOR FOR THE POLICE DEPARTMENT WHEREAS, the Police Department has determined that it needs to replace three (2) patrol vehicles, unit numbers 79, 81 and 86, because of continuous mechanical and electrical problems in said vehicles; and WHEREAS, the Police Department has determined that two (2) 2012 Chevrolet Tahoe Police Patrol vehicles and one (1) 2011 Ford Crown Victoria Police Interceptor (the "Vehicles") are the best vehicles to meet its needs; and WHEREAS, the Interim Chief of Police has recommended that authority be granted for the Purchasing Agent, or the Purchasing Agent's designee, to seek formal bids for the purchase of the Vehicles; and WHEREAS, a bid specifications for the purchase of the Vehicles has been presented to the City Council of the City of Vernon; and WHEREAS, the City Council of the City of Vernon has determined that it is in the best interests of the City of Vernon that bids be solicited in accordance with the Vernon City Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The bid specifications, which are attached hereto as Exhibit A, are hereby approved by the City Council of the City of Vernon. SECTION 3: The City Clerk of the City of Vernon is hereby directed to give notice, in writing, inviting sealed proposals or bids for the purchase of two (2) 2012 Chevrolet Tahoe Police Patrol vehicles and one (1) 2011 Ford Crown Victoria Police Interceptor, in accordance with the bid specifications, and in accordance with this resolution. SECTION 4: The City Clerk is hereby directed to publish said notice, or cause the same to be published, in the Vernon Sun. SECTION 5: The City Clerk of the City of Vernon is hereby directed to publish said notice forthwith and the first publication of said notice shall be at least ten (10) days before the opening of the bids for the proposed contract. Said notice shall provide that sealed proposals or bids will be received by the City of Vernon at the office of the City Clerk, or the City Clerk's designee, at the City Hall, 4305 Santa Fe Avenue, Vernon, CA 90058-1714. - 2 - SECTION 6: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. They shall be supplied as specified from the manufacturers new, unused and latest model complete with all necessary equipment and accessories. The vehicles shall be delivered completely assembled and ready to operate. All equipment normally furnished, as standard, shall be included. All separate units or components shall be new, unused, installed connected and delivered in good operating order. The subject vehicles shall conform in all respects and be equipped to operate legally on California State Highways as specified in the California Motor Vehicle Code. The vehicles shall meet all Califomia State and Federal safety and emission standards when delivered to the City of Vernon. purchase. All bids submitted shall include sufficient associated literature as required to fully describe and detail the items under consideration. This should include photographs, performance charts, components list, dimensional drawings, etc. The bidder shall clearly state any changes, exceptions or substitutions of equivalent equipment/materials to these specifications The successful bidder will arrange to demonstrate a similarly equipped 2012 Chevrolet Tahoe Police Patrol Vehicle (PPV), prior to purchase. Whenever materials or equipment are specified or described in the specifications by using the name of proprietary item or name of a particular manufacture, fabricator, supplier of distributor, the naming of the item is intended to establish the type, function and quality required. Unless the name is followed by words indicating that no substitution is permitted, materials or equipment of other manufacturers, fabricators, suppliers or distributors may be accepted by the City of Vernon if sufficient information is submitted prior to the purchase by the contractor to allow the City of Vernon to determine that the material or equipment proposed is equivalent to the named. The term "equivalent' as used in this specification, means "authorized equivalent' and acceptance of the equivalent' is subject to the approval of the City of Vernon. Warranties The manufacturers warranties on the vehicles and any added equipment shall be delivered to the City of Vernon without waiver by the city of any recourse under California law. Installation No installation is needed on this bid. Inspection The bidder shall arrange for a pre -delivery inspection and right of refusal by the City of Vernon Police Department. Delivery Date All bidders shall provide a date to deliver the vehicle. it is of utmost concern to the City of Vernon that the quoted delivery date be met. Any delay in the delivery shall be immediately reported in writing to the purchasing agent with a copy to the Police Department representative, Captain Rodin. Any change in the original quoted delivery date is subject to the approval by the City of Vernon. The City of Vemon reserves the right to cancel the purchase order for non- performance of delivery by the quoted date at no cost or obligation to the City of Vernon. Background The Police Department will be retiring 3 patrol units (Units 79 (2003), 81 (2003) and 86 (2004)). Two units are assigned to canine officers and the third is assigned to patrol division. The vehicles' mileage ranges from 94,000 to 130,000 miles and are no longer reliable due to continuous mechanical and electrical problems. Garage is in agreement with the need for replacements on the stated units. Unit #81 has already been taken out of service and will be used for spare parts. Upon replacement the other two units will also be retained for the same utilization. Ultimately these units will be declared as surplus. The approximate cost for the (2) 2012 Chevrolet Tahoes will be $71,775.00. These vehicles will provide sufficient cargo space for the canine and the necessary equipment. The (1) 2011 Ford Crown Victoria Police Interceptor's approximate cost is $26,100.00. The Interceptor is the selected model used for the patrol units. The new units will require new police vehicle equipment. The existing equipment on the units is now old and worn. The approximate cost for the new equipment and installation is estimated at $25,000.00. This purchase will be handled separately from the purchase of the new vehicles. Recommendation The Purchasing Department recommends a formal bidding process be authorized to obtain the best pricing for the 3 replacements. Fiscal Impact There will be no fiscal impact to the General Fund. Police Federal asset forfeiture funds will be used for the 3 patrol vehicles and related equipment/installation costs. Two patrol vehicles are assigned to canine officers and the third is assigned to the patrol division (Units 79, 81, and 86). These vehicles have been in service for a number of years and have significant wear and tear. The mileage for these three vehicles range from 94,000 to 130,000 miles. These vehicles are becoming increasingly unreliable as they are frequently taken out of service for mechanical reasons. Patrol unit #81 has already been taken out of service because of major electrical problems. The PD Fleet Manager has recommended to purchase two (2) 2012 Chevrolet Tahoe Police Vehicles and one (1) 2011 Ford Crown Victoria Police Interceptor. The two (2) Chevrolet Tahoe Vehicles will be used to replace the current canine vehicles. These vehicles will provide sufficient cargo space to house the necessary canine equipment. The Ford Crown Victoria will be used for regular patrol duties. The PD will also replace most of the related police vehicle equipment to outfit the new vehicles. Most of the equipment in the police vehicles has also been in use for a number of years and are in need of replacement. The cost for the police vehicle equipment and installation is estimated at $25,000.00. Recommendation Because of the aging police fleet and related equipment, I recommend that the PD receive authorization to purchase three (3) police vehicles and related equipment. Fiscal Impact General funds will not be used for this purchase. PD Federal asset forfeiture funds will be used for the purchase of these patrol vehicles and related equipment 1 installation costs.
