A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON APPROVING AND ACCEPTING A UTILITY EASEMENT
DEED AND A FIRE LANE EASEMENT DEED FOR PROPERTY
LOCATED AT 4366 ALCOA AVENUE AND APPROVING AND
AUTHORIZING THE EXECUTION OF A CERTIFICATE OF
ACCEPTANCE IN RELATION THERETO
WHEREAS, Force-44th Street, LLC ("Force") has offered to
dedicate in fee a portion of the real property in the City commonly
known as 4366 Alcoa Avenue, City of Vernon (the "Property"); and
WHEREAS, Force has delivered to the City a utility easement
deed dated December 14, 2011, dedicating in fee the Property to the
City, a copy of which is attached hereto as Exhibit A; and
WHEREAS, Force has delivered to the City a fire lane easement
deed dated December 14, 2011, dedicating in fee the Property to the
City, a copy of which is attached hereto as Exhibit B; and
WHEREAS, the dedication will meet the City of Vernon's
Master Plan of Streets and will be used for the maintenance of
existing utilities and fire -fighting purposes; and
WHEREAS, by memo dated January 3, 2012, the Director of
Community Services and Water has recommended that the City accept the
Utility Easement Deed and Fire Lane Easement Deed and approve the
execution of the Certificate of Acceptance.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
accepts the interests in real property conveyed to the City of Vernon
by the Utility Easement Deed and the Fire Lane Easement Deed (the
"Easement Deeds"), approves the Easement Deeds and consents to the
recordation of the Easement Deeds.
SECTION 3: The City Council of the City of Vernon hereby
authorizes the Mayor or Mayor Pro-Tem to execute the Certificate of
Acceptance accepting the Easement Deeds for, and on behalf of, the
City of Vernon and the City Clerk, or Deputy City Clerk, is hereby
authorized to attest thereto.
SECTION 4: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to take whatever
actions are deemed necessary or desirable for the purpose of
implementing and carrying out the purposes of this Resolution and the
actions herein approved or authorized.
SECTION 5: The City Council of the City of Vernon hereby
authorizes the Director of Community Services & Water, or his
designee, to submit the Easement Deeds to the County Recorder.
SECTION 6: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of Resolutions
of the Council of this City.

The Community Services Department has reviewed and approved a Utility Easement Deed
and a Fire Lane Easement Deed for the property located at 4366 Alcoa Avenue.
The Fire Lane Easement Deed provides two 27-feet wide lanes along the previously vacated
44" Street and 45'h Street east of Alcoa Avenue for fire -fighting purposes. The Utility Easement Deed
provides a 50-feet wide easement along the previously vacated 44`h Street for the maintenance of
existing utilities.
It is my recommendation that the Utility and Fire Lane Easement Deeds and Certificates of
Acceptance be approved by resolution and the Mayor and City Clerk be authorized to execute. Please
