RESOLUTION NO. 2012-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON GRANTING A VARIANCE TO JIN DONG CHANG FROM SECTION 26.5.1-6(f) OF THE COMPREHENSIVE ZONING ORDINANCE, FOR THE PROPERTY LOCATED AT 2021 38TH STREET IN THE CITY OF VERNON WHEREAS, Jin Dong Chang owns the property located at 2021 38`h Street, in the City of Vernon (hereinafter referred to as "the Property") and is requesting a variance from Section 26.5.1-6(f), Development Standards, of the Comprehensive Zoning Ordinance; and and WHEREAS, the Property is located in the I -Zone, Industrial; WHEREAS, the building will be used for warehousing and distribution which is consistent with the objectives of the General Plan and Zoning Ordinance; and WHEREAS, the building located at 2021 38`h Street has been vacant for a continuous period greater than two years and Jin Dong Chang is in the process on reconstructing the building; and WHEREAS, according to Section 26.5.3-2 such a building shall not be occupied except if it has been brought into conformity with all regulations of the zone in which it is located; and WHEREAS, the owner's development proposal would bring the property into conformity with applicable regulations with two exceptions; and WHEREAS, the exceptions involve the required unobstructed maneuvering area for auto and truck parking and loading, and the required size of truck stalks, thus prompting this variance application; and WHEREAS, the existing building is approximately 2,790 square feet in size on a lot of approximately 5,160 square feet; and WHEREAS, a restaurant -bar (Rackett's II) had previously occupied the site; and WHEREAS, the proposed site will be used for warehousing and distribution and, due to the dimensions of the property (40'x 129'), it is not possible to develop the site in accordance with the City's Comprehensive Zoning Standards unless an easement is granted on the adjoining property; and WHEREAS, the property owner is requesting to utilize smaller trucks at the property reducing the length of the trucks stalls and maneuvering required to park the trucks onsite which will still require an easement on the adjoining property for the ingress and egress; and WHEREAS, due to the narrow lot and existing building the property owner proposes to limit the length of truck spaces to 25, feet in length instead of the 75' feet required by the Code which, both of these truck stalls are 12, feet wide; and WHEREAS, Jin Dong Chang has agreed to execute an ingress and egress easement agreement with the property owner to the east, located at 2027 38th Street, in the City of Vernon; and WHEREAS, by acquiring the ingress and egress easement which is (25'x 521), it will provide an additional 25, feet of maneuvering area and will allow Jin Dong Chang auto and truck access without having to maneuver on the street; and WHEREAS, the Community Services Department has determined that the additional maneuvering area will allow the trucks to enter and exit the stalls easily and that the parking and loading arrangement is consistent with parking and loading goals of the Zoning ordinance; and - 2 - WHEREAS, as previously mentioned, due to the space constraints on their existing lot, the possibility of providing full conformity with truck parking and loading, and maneuvering for both automobiles and trucks is not possible unless an easement is granted on the adjoining property; and WHEREAS, Section 26.5.1-6(f) of the Zoning Ordinance specifies that each truck parking and loading space shall be a minimum of ten (10) feet wide, seventy-five (75) feet long and provide fifty (50) feet of unobstructed maneuvering area; and WHEREAS, Section 26.5.1-6, adequate off-street Parking and Loading Facilities, specifies that the facility is required to have 3 automobile parking spaces, 1 truck loading space, and 1 truck parking space; and WHEREAS, the proposed site complies with Section 26.5.1-6 by providing 3 automobile parking spaces, 1 truck loading space and 1 truck parking space, therefore, the proposed project complies with the required number of automobiles and truck parking and loading spaces as stated by the Comprehensive Zoning Ordinance; and WHEREAS, an ingress egress easement on the neighboring property will be required to allow proper auto and truck access; and WHEREAS, Jin Dong Chang has agreed to use shorter trucks that will not extend into the public right -of way and can be easily maneuvered onsite; and WHEREAS, the proposed use will not adversely affect the surrounding area because the site is surrounded by industrial and warehouse uses compatible with the proposed use; and WHEREAS, the City Council has received a Staff Report dated March 7, 2012, upon which it has relied in making the foregoing - 3 - recitals; and WHEREAS, the City Council of the City of Vernon held a hearing on said application for a variance on March 20, 2012; and WHEREAS, the circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of the applicant's building merely because it is infeasible to provide the required maneuvering aisle width of 27 feet for autos and 50 feet for trucks, however, by limiting the size of trucks to 25 feet in length and obtaining an easement on the neighboring property it will provide the required maneuvering aisle width for autos and sufficient maneuvering area for the shorter trucks; and WHEREAS, the variance will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the premises, the proposal is consistent with the objectives of the general plan and zoning ordinance, and the granting of a variance will not constitute the granting of a special privilege in that the effects, if any, of the decreased width of the maneuvering aisle will be confined to the property, and the applicant will be required to permit only trucks of a maximum length of 25 feet onto the property and install and maintain truck loading and parking stalls that are wider than that required under Section 26.5.1-6(f) to compensate for the decreased maneuvering aisle, however, should the City Council approve this variance the site shall retain its legal non -conforming status; and WHEREAS, the applicant has stated that all automobile and truck aisles will be maintained unobstructed at all times, and as long as the applicant complies with these conditions, the variance will be - 4 - consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: A variance from Section 26.5.1-6(f) Development Standards of the Comprehensive Zoning Ordinance is hereby granted to Jin Dong Chang for the property located at 2021 38t° Street. SECTION 3: The variance granted is subject to the following conditions: a. The facility shall be operated in accordance with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a variance. b. All parking and loading areas shall be striped in a manner acceptable to the Director of Community Services & Water and shall be paved with a hard durable surface material and shall be adequately drained, and kept free of dust, mud, trash and weeds. Where parking or maneuvering areas adjoin the public street, a barrier wall or landscaping shall be maintained to meet City standards. c. The building and parking area shall be maintained substantially in compliance with the site plan submitted, as part of this variance application. d. The building shall be structurally maintained to exclude rodents and the property shall be maintained rodent free. The site shall - 5 - maintain adequate drainage to eliminate potential mosquito harborage. e. The facility shall be operated in a manner that will prevent unsanitary conditions, odors or other nuisances. f. Servicing of vehicles, including but not limited to, washing, steam cleaning and repairing, shall not be permitted on the premises. No inoperative vehicles shall be stored on -site. g. All on -site construction or improvements shall be in compliance with the most current Building Codes (Building, Fire, Mechanical, Plumbing and Electrical) and current Health and Safety Codes and Regulations. Jin Dong Chang shall obtain all necessary building, fire, mechanical, plumbing, and electrical permits from the City of Vernon Community Services Department in addition to any required Vernon Environmental Health Department clearance prior to commencement of construction. h. A covenant shall be recorded with the Los Angeles County Recorders offices prior to construction advising all future property owners/tenants that all trucks entering the site to park or unload are limited to a maximum of 25 feet in length, that any violation of this requirement is subject to a maximum $500.00 fine, and that signs regarding the maximum length of the trucks permitted on the property are to be posted. i. The owner shall post a sign with a minimum 2" type at the driveway entrance that states "Maximum Length of trucks allowed in this site is 25 feet in length. All violations are subject to a fine not to exceed $500.00". - 6 - j. The property owner shall be subject to a fine not to exceed $500.00 for every truck that enters the site that violates the size requirement. k. The facility shall be operated in a manner, which will not impede traffic on 38th Street. All vehicles shall enter and exit the site in a front forward manner. No vehicle parking or staging associated with the facility shall take place on any public street within Vernon. 1. An ingress/egress easement as shown on the approved site plan (see attached site plan) for the maneuvering area on the adjoining property to the east (2027 38th Street) shall be recorded with the Los Angeles County Recorders office within 120 days from the date of approval. No changes shall be made in the site development except with the prior approval of the Director of Community Services and Water. m. The easement area shall at all times be maintained and kept clear and unobstructed. n. The easement agreement may not be modified, amended or terminated without the prior written consent from the Director of Community Services and Water. o. Noncompliance with any condition shall constitute sufficient grounds for the City Council of the City of Vernon to void this variance and require the applicant, Jin Dong Chang or any subsequent tenants or owners to vacate the building or bring the property into conformity with the City's standards. - 7 - SECTION 4: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Therefore, Jin Dong Chang has requested permission to allow the use of these two truck stalls with the understanding that all trucks entering the site shall be limited to a maximum of 25 feet in length at the non -conforming truck -loading spaces. 7M.r$1) "I t I C As previously mentioned, the property at 2021 38`h Street has been vacant for a continuous period greater than two years. As a result the building can not be occupied except if it has been brought into conformity with all regulations of the zone in which it is located. The property is an infill site with an existing building approximately 2,790 square feet in size. The lot is rectangular measuring 40 feet wide by 129 feet long and is approximately 5,160 sq. ft. in size. According to the Comprehensive Zoning Ordinance Section 26.5.1-6, adequate off-street Parking and Loading Facilities, specifies that the facility is required to have 3 automobile parking spaces, 1 truck loading space, and 1 truck parking space. The proposed site complies with this section by providing 3 automobile parking spaces, 1 truck loading space and 1 truck parking space. Therefore, the proposed project complies with the required number of automobiles and truck parking and loading spaces as stated by the Comprehensive Zoning Ordinance. However, the maneuvering area is inadequate and the truck stalls are shorter then required. Due to the width of the lot it is not possible to conform with automobile or truck parking, loading and maneuvering requirements unless an easement is granted on the adjoining property. Jin Dong Chang has proposed to limit the size of trucks accessing the site to 25 feet in length and obtain an ingress -egress easement measuring 25'x52' in length. In addition, the owner has proposed to widen each truck stall from the required 10 feet to a minimum of 12 feet. In effect, the proponent is providing adequate turning radius for the trucks to enter and exit the stalls to compensate for the shorter aisle width. Therefore, Jin Dong Chang is requesting a variance from the requirements of Section 26.5.1-6(f) of the Comprehensive Zoning Ordinance, Development Standards, be issued to it at this time for the non -conforming truck spaces with the condition that the property owner will utilize shorter trucks and obtain an easement on the neighboring property for maneuvering. The arrangement of the trucks stalls will not allow the trucks to extend into the street right-of-way. -2- VARIANCE METHODOLOGY The applicant is requesting a variance from Section 26.5.1-6(f) of the current City of Vernon Comprehensive Zoning Ordinance, which specifies that each truck parking and loading space shall be a minimum of 10' feet wide and 75' feet long and provide unobstructed truck maneuvering space fifty (50) feet. The nature of the Property and the circumstances surrounding the applicant's situation are unique in that other properties in the area do not have the same physical constraints that preclude installation of truck loading and parking stalls with a maneuvering aisle conforming to Section 26.5.1-6(f) of the current City of Vernon Comprehensive Zoning Ordinance, which specifies that each truck loading and parking space shall be a minimum of 10' feet wide and 75' feet long. Such circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of his building merely because it is infeasible to provide the required maneuvering aisle width of 27 feet for autos and 50 feet for trucks. As previously mentioned, the applicant has agreed to obtain an ingress -egress easement on the adjoining property, and limit trucks to 25 feet in length at the shorter non -conforming truck loading and parking spaces to ensure that all truck maneuvering will occur onsite and that trucks will not extend into the street right-of-way while parked in the loading and parking spaces In addition, they will provide wider truck loading and parking stalls. As long as the applicant complies with this condition, the variance will be consistent with the objectives of the Comprehensive Zoning Ordinance and General Plan. C"XID The proposed site is surrounded by industrial uses compatible with the proposed use. No potentially significant impacts are expected to result from noise, odor, dust, smoke, light or glare from the project. The project is categorically exempt under Section 15301 of the California Environmental Quality Act because it is an existing facility with no expansion of use. A Notice of Exemption will be prepared and filed with the County Clerk's office. STAFF FINDING AND CONDITIONS Staff finds the following to be true: a) The circumstances surrounding the applicant's situation are unique in that other properties in the area do not have the same physical constraints that preclude installation of truck loading and parking stalls with a maneuvering aisle conforming to Section 26.5.1-6(f), and such circumstances create a hardship to the applicant and justify the granting of a variance in that the applicant would be deprived of all productive use of his building merely because it is infeasible to provide the required maneuvering aisle width of 27 feet for autos and 50 feet for trucks, and provide 75 foot long truck loading and parking stalls, while it is feasible to limit the size of trucks and provide an easement for adequate maneuvering area. -3- Therefore, strict application of the truck loading and parking requirements of the ordinance at this time would cause an unreasonable hardship to the applicant at this time. b) The variance will not adversely affect the interests of the public or the interests of other residents and property owners within the vicinity of the premises, the proposal is consistent with the objectives of the general plan and zoning ordinance, and the granting of a variance will not constitute the granting of a special privilege in that the effects, if any, of the decreased width of the maneuvering aisle will be confined to the property, and the applicant will be required to permit only trucks of a maximum length of 25' feet onto the property and install and maintain truck loading and parking stalls that are wider than required under Section 26.5.1-6(f) to compensate for the decreased maneuvering aisle, and obtain an easement on the neighboring property to provide adequate maneuvering. c) The applicant's building at 2021 38th Street will be providing two non -conforming truck loading spaces measuring 12.0 feet in width and 25.0 feet in length. Due to the dimensions of the lot the possibility of providing full conformity with truck parking, loading and maneuvering is not possible unless an easement is granted on the adjoining property. The applicant has stated that all trucks entering the site shall be limited to a maximum of 25 feet in length at the shorter non -conforming truck loading spaces to ensure that trucks will not extend into the street right-of-way while in the parking and loading spaces. The applicant has also stated that all automobile and truck aisles shall be maintained unobstructed at all times. As long as the property owner obtains an easement on the neighboring property for both autos and truck maneuvering and complies with these conditions, the variance will be consistent with the objectives of the Comprehensive Zoning Ordinance and the General Plan. Therefore, it is recommended that the variance be granted with the following conditions imposed on the permit to adequately protect the public interests: a. The facility shall be operated in accordance with all current codes, rules, and regulations and subject to permit fees as adopted by the City of Vernon not otherwise addressed by this grant of a variance. b. After review of the application by the Community Services Department, it is recommended that the conditional use permit be granted. Herewith for your consideration are the following supporting documents: 1. Staff Report. 2. Variance application and supporting information. 3. Notice of Public Hearing, confirmation/proof of publication, and affidavit of mailing. The project is categorically exempt from CEQA because it is an existing facility as described in Section 15301.
