Resolution No. 2012-058RESOLUTION NO. 2012-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPOINTING MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NO. 23 AND RESTATING AND CONFIRMING THE APPOINTMENT OF MEMBERS AND ALTERNATE MEMBERS TO REPRESENT THE CITY OF VERNON ON THE BOARD OF DIRECTORS OF COUNTY SANITATION DISTRICT NOS. 1 AND 2 WHEREAS, the City of Vernon has been a member of Districts 1, 2 and 23 of the County Sanitation District (collectively, the "Districts") for many years; and WHEREAS, on July 13, 2009, the City Council of the City of Vernon adopted Resolution No. 10,013 appointing members and alternate members to represent the City on the Board of Directors of the Districts; and WHEREAS, due to a recent reorganization of the City Council, the City Council of_the City of Vernon desires to appoint members to represent the City of Vernon on the Board of Directors of the Districts. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby confirms the following members of the City Council of the City of Vernon who shall serve on the Board of Directors of County Sanitation District No. 23: William "Bill" Davis, Mayor Pro-Tem W. Michael McCormick, Councilman Richard J. Maisano, Councilman Michael A. Ybarra, Councilman SECTION 3: The City Council of the City of Vernon hereby confirms William "Bill" Davis, Mayor Pro-Tem of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District No. 1 and hereby appoints Richard J. Maisano, a member of the City Council, to serve as the City's alternate member on the Board of Directors of County Sanitation District No. 1. The alternate member of said District No. 1 Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 4: The City Council of the City of Vernon hereby confirms William "Bill" Davis, Mayor Pro-Tem of the City of Vernon, to serve as its Member on the Board of Directors of County Sanitation District No. 2 and hereby appoints W. Michael McCormick, a member of the City Council, to serve as the City's alternate member on the Board of Directors of County Sanitation District No. 2. The alternate member of said District No. 2 Board of Directors shall act in place of the presiding officer of City Council of the City of Vernon during his absence, inability or refusal to act as such member of said District 2 Board. Such appointments shall be effective until the death, resignation, disqualification or subsequent removal by the City Council of such representatives. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or the City Clerk's designee, to send a copy of this Resolution to: Kim Compton, Secretary of the County Sanitation District 1955 Workman Mill Road Whittier, CA 90601 SECTION 6: Any resolution or parts of a resolution or minute orders in conflict with this Resolution are hereby repealed. SECTION 7: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City. Whitworth, City Administrator le RE: County Sanitation District Appointments Background In light of the recent City Council reorganization, it is recommended that the resolution appointing members and alternate members to the Boards of Directors of County Sanitation Districts No. 1, 2, and 23, be updated. Pursuant to Health and Safety Code Section 4730, because District No. 23 lies wholly within the City of Vernon, the Vernon City Council is the Board of Directors for said district. Further, the presiding officer of the City is the designated member of the Boards of Directors of Sanitation Districts No. 1 and 2, and the City Council is required to select one of its members as an alternate in each case. Recommendation It is recommended that the City Council select one of its members to serve as the alternate member for Districts No. 1 and 2, and adopt the enclosed resolution memorializing such selection.
