A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
VERNON AUTHORIZING THE ISSUANCE OF A REQUEST FOR
PROPOSAL FOR A 2012 FORD F-750 REGULAR CAB XLT
(F7F) ASPHALT TRUCK WITH A PB LOADER CORPORATION
UNITIZED PATCHER FOR THE DEPARTMENT OF COMMUNITY
SERVICES & WATER
WHEREAS, the City of Vernon is interested in obtaining
proposals from qualified dealers for the purchase a 2012 Ford F-750
Regular Cab XLT (F7F) Asphalt Truck with a PB Loader Corporation
Unitized Patcher, Shoveling Apron, Emulsion Sprayer, and Compactor
Lift Platform, which will be used for street paving projects,
resurfacing utility repair sites, and pot -hole repairs; and
WHEREAS, the Director of Community Services & Water has
requested the issuance of a Request for Proposal for a 2012 Ford F-750
Regular Cab XLT (F7F) Asphalt Truck with a PB Loader Corporation
Unitized Patcher (the "RFP") pursuant to Section 2.29-2 of the Vernon
City Code.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF VERNON AS FOLLOWS:
SECTION 1: The City Council of the City of Vernon hereby
finds and determines that the recitals contained hereinabove are true
and correct.
SECTION 2: The City Council of the City of Vernon hereby
instructs the City Administrator, or his designee, to issue in
accordance with Vernon City Code Section 2.29-2, the RFP, a copy of
which is attached hereto as Exhibit A, to one or more qualified
dealers, and to report to the City Council on the proposals received
with a recommendation for action.
SECTION 3: The City Clerk of the City of Vernon shall
certify to the passage, approval and adoption of this resolution, and
the City Clerk of the City of Vernon shall cause this resolution and
the City Clerk's certification to be entered in the File of
Resolutions of the Council of this City.

I. INTRODUCTION AND PROJECT
It is the intent of this specification is to provide for the purchase of one new and unused 2012 Ford
F-750 4x2 Regular Cab XLT; herein included in Attachment C. In addition, a PB Loader
Corporation Unitized Patcher Model B-4, Shoveling Apron Model 316, Emulsion Sprayer Model
144-CS, and Compactor Lift Platform PB Model 640, shall also be purchased and installed by the
selected dealer, per specification; herein included in Attachment D. The City of Vernon (City) has
evaluated different types of trucks and has determined that this product is best suited for the City's
needs in terms of safety, quality, performance, and standardization.
II. PROPOSAL SELECTION
In comparing proposals, consideration will not be confined to price only. The successful bidder
will be one whose product is judged shall best serve the interests of the City of Vernon when price,
product; safety, quality and delivery are considered. The City of Vernon reserves the right to
reject any or all bids or any part thereof, and to waive any minor technicalities. A contract will be
awarded to the bidder submitting the lowest responsible bid meeting the requirements of this
specification.
III. FORM OF CONTRACT
The City's standard form of contract shall be used, and includes other provisions not described here.
A Standard Vehicle Purchase Contract is attached for reference (Attachment A). The vendor shall
be required to execute a vehicle purchase agreement in substantially the same form as reflected in
Attachment A.
IV. INTERPRETATIONS
In order to be fair to all Proposers, no oral interpretations will be given to any Proposer as to the
meaning of the specification documents or any part thereof. Every request for such a consideration
shall be made in writing to the City of Vernon. Based upon such inquiry, the City may choose to
issue an Addendum.
V. GENERAL
The specification herein states the minimum requirements of the City. All bids must be regular in
every respect. Unauthorized conditions, limitations, or provisions shall be cause for rejection.
The City of Vernon will consider as "irregular" or "non -responsive" any bid not prepared and
submitted in accordance with the bid document and specification, or any bid lacking sufficient
technical literature to enable the Department to make a reasonable determination of compliance to
the specification.
It shall be the Proposers responsibility to carefully examine each item of the specification. Failure
to offer a completed bid or failure to respond to each section of the technical specification will
cause the proposal to be rejected without review as "non -responsive". All variances, exceptions
and/or deviations shall be fully described in the appropriate section. Deceit in responding to the
specification will be cause for rejection.

Attachment "D")
E. Compactor Lift Platform: PB Model 640 (Comprehensive specifications are included as
part of Attachment "D")
The vehicle and related equipment shall be in compliance with the South Coast Air Quality
Management District's vehicle emission standards specific to the State of California.
VIII. ADDENDA, CHANGES, AND AMENDMENTS TO THIS SOLICITATION
At any time prior to the due date for responses, the City may make changes, amendments, and
addenda to this solicitation, including changing the date due to allow respondents time to address
such changes.
IX. CONDITIONS FOR RESPONSES TO RFP
The following conditions apply to this RFP process:
A. Nothing contained in this RFP shall create any contractual relationship between the
respondent and the City.
B. This RFP does not obligate the City to establish a list of service providers qualified as
prime contractors, or award a contract to any respondent. The City reserves the right to
amend or cancel this RFP without prior notice, at any time, at its sole discretion.
C. The City shall not be liable for any expenses incurred by any organization in connection
with this RFP.
D. No conversations or agreements with any officer, agent, or employee of the City shall
affect or modify any terms of this RFP. Oral communications or any written/e-mail
materials provided by any person other than designated contact staff of City shall not be
considered binding.
E. The City reserves the right; in its sole discretion, to accept or. reject any or all Proposals

without prior notice and to waive any minor irregularities or defects in a Proposal. The City
reserves the right to seek clarification on a Proposal with any source.
F. The dates; times; and sequence of events related to this RFP shall ultimately be determined
by the City. The schedule shown above is subject to change, at the sole discretion of the
City, although the City will attempt to follow it and, if it must be altered, will attempt to
provide reasonable notice of the changes.
G. Respondents shall not issue any news release pertaining to this RFP, or the City without
prior written approval of the City.
H. All submitted proposals and information included therein or attached thereto shall become
public record upon delivery to the Community Services Department.
X. WARRANTY
The selected Vehicle, Unitized Patcher, Shoveling Apron, Emulsion Sprayer, and Compactor Lift
Platform shall include standard warranties.
XI. SERVICE MANUALS (WRITTEN PAPER MANUALS)
The vendor shall provide mechanical, electrical, and emissions repairs manuals. In addition, repairs
manuals shall be provided for the Unitized. Patcher, Shoveling Apron, Emulsion Sprayer, and
Compactor Lift Platform.
ML RIGHT BY THE CITY TO WITHDRAW THIS REQUEST
The City may, at its sole discretion and for any reason whatsoever, withdraw this solicitation at any
time.
XHI. DELIVERY
Acceptance shall be subject to the inspection and approval of the City of Vernon.
XIV. PROPOSAL SUBMITAL
The Proposal must be received in a sealed envelope and returned to the City of Vernon Finance
Department no later than Tuesday, June 5, 2012. Please mark the front of the Proposal: Attention

6. Entire Agreement. This Contract is the entire agreement of the parties,
CONTRACTOR represents that in entering into this Contract, it has not relied on any previous
representations or understandings of any kind or nature.
Benefit of Agreement. This Contract shall bind and benefit the parties hereto
and their heirs, successors, and permitted assigns.
8. Arbitration and Venue. Any dispute, claim or controversy arising out of or
relating to this Agreement or the breach, termination, enforcement, interpretation or validity thereof,
including the determination of the scope or applicability of this Agreement to arbitrate, shall be

determined by arbitration in Los Angeles, California. The arbitration shall be administered by JAMS
pursuant to its Streamlined Arbitration Rules and Procedures. The arbitrator shall be a retired judge.
All decisions of the arbitrator shall be in writing, and the arbitrator shall provide written reasons for their
decision. The arbitration decision shall be final and binding on the Parties. Judgment on the award may
be entered in any court having jurisdiction pursuant to this Agreement. Notwithstanding the foregoing,
the parties shall be permitted to access the court system to enforce any arbitration award. The exclusive
jurisdiction and venue under this Agreement shall be the Superior Court of California, Los Angeles
County.

These specifications describe a self-contained patch unit, which is permanently mounted
to a, truck chassis to be used for patching with hot asphalt.
Container:
The unit shall be 4 cubic yards.
Double wall constructed.
2" - 6 lb. density insulation throughout.
10 GA HR steel interior sides, 12 GA HR steel exterior.
The floor shall be 1/4 inch HR steel.
Flat bottom floor across the full width and length of the hopper
Material shall discharge by two hydraulically operated rear doors
Interior walls of loading lids have expansion corrugations.
Top loading doors are 2" double wall constructed.
Single hinged top lids open into a V with the inside surface acting as a funnel.

The Department of Community Services and Water (Department) is seeking permission to issue
Request for Proposals (RFP) to selected Ford dealerships to facilitate the purchase of a new 2012 Ford F-
750 Regular Cab XLT (F7F) Asphalt Truck with a PB Loader Corporation Unitized Patcher, Shoveling
Apron, Emulsion Sprayer, and Compactor Lift Platform, to be purchased and installed by the selected
dealer. The proposed truck will replace Unit No. 248, a 1987 F-700, that has 88,000 miles on it, is no
longer reliable, and is nearly obsolete with many of the parts no longer manufactured.
The Department did spend considerable time looking at various brands, types of Asphalt trucks,
and body configurations that would be compatible with the operational challenges encountered by City's
Street Division crews. The Asphalt Truck will be utilized for street paving projects, resurfacing utility
repair sites, and pot -hole repairs. The Ford F-750 meets the above -mentioned criteria in terms of safety,
quality, performance, and standardization.
The City Attorney's office has reviewed the subject RFP'and approved it, as to form. It is my
recommendation that the City Council approve the request to issue RFP's for the purchase of a new 2012
Ford F-750 Regular Cab XLT (F7F) Asphalt Truck with a PB Loader CorporationUnitized Patcher,
Shoveling Apron, Emulsion Sprayer, and Compactor Lift Platform at the May 15, 2012 meeting. Thank
