Resolution No. 2012-078RESOLUTION NO. 2012-78 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON PROVIDING FOR THE APPROPRIATION OF THE CITIZENS OPTION FOR PUBLIC SAFETY (COPS) PROGRAM FUNDS RECEIVED FOR FISCAL YEAR 2011-2012 FOR FRONTLINE MUNICIPAL POLICE SERVICES WHEREAS, the State of California provides Citizens Option for Public Safety Program ("COPS Program") funding; and WHEREAS, the County of Los Angeles has established a Supplemental Law Enforcement Service Fund (SLESF) in accordance with Section 30061 of the Government Code to receive COPS Program funds which have been allocated for use in Los Angeles County; and WHEREAS, the City has established its own SLESF in accordance with Section 30061 of the Government Code; and WHEREAS, the City's SLESF will receive One Hundred Thousand ($100, 000,00) Dollars in COPS Program funds for fiscal year 2011-2012, which must be used to supplement existing frontline municipal police services; and WHEREAS, Section 30061(h) of the Government Code provides that funds received in any fiscal year be expended or encumbered no later than June 30 of the following fiscal year; and WHEREAS,.by memo dated may 14, 2012, the Interim Chief of Police has recommended that the Police Department be authorized to use the COPS Program funds received for fiscal year 2011-2012 and any interest in the SLESF account accumulated through June 30, 2012 (collectively, the "COPS Program - SLESF Funds"), to pay for a Vernon Service officer and/or a Civilian Court Officer in fiscal year 2012-2013 through fiscal year 2013-2014 and any other unbudgeted expenses for frontline municipal police services; and WHEREAS, the City Council has conducted a public hearing to consider the funding request from the Interim Chief of Police to use the COPS Program - SLESF Funds for frontline municipal police services. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained hereinabove are true and correct. SECTION 2: The City Council of the City of Vernon hereby directs that the City continue to maintain its own SLESF in accordance with California state law. SECTION 3: The City Council of the City of Vernon finds that all persons have had the opportunity to be heard or to file written Comments on the funding request from the Interim Chief of Police, and after due consideration of any and all evidence submitted at the public hearing determines that there are compelling reasons to justify the expenditure of COPS Program - SLESF Funds to pay for a Vernon Service officer and/or a Civilian Court Officer and any other unbudgeted expenses for frontline municipal police services and further finds that use of the funds in this manner will supplement, not supplant, existing frontline municipal police services. SECTION 4: The City Council of the City of Vernon hereby approves and authorizes the appropriation of COPS Program --SLESF Funds to pay for a Vernon Service officer and/or a Civilian Court Officer in fiscal year 2012-2013 through fiscal year 2013-2014 and to the extent there are any funds remaining, to pay,for any other - 2 - unbudgeted-expenses for frontline municipal police services in fiscal year 2012-2013. SECTION 5: The City Council of the City of Vernon hereby directs the City Clerk, or the City Clerk's designee, to deliver a copy of this Resolution to the appropriate person at the County of Los Angeles SECTION 6: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions,of the Council of this City. The Police Department is requesting authorization to use these funds to pay the salary for a Vernon Service Officers (VSO) and/or a Civilian Court Officer in FY 2012-2013 through FY 2013- 2014. The VSO and/or Court Officer position are positions that the City would not have as part of its frontline municipal police services without the grant funding. Thus, the services provided by either of these positions supplement, and do not supplant, existing frontline municipal police services. Background: State Assembly Bill 1913 was enacted in fiscal year 2000-2001 to continue funding for the Citizens Option for Public Safety (COPS) Program ("COPS Program"), and has been modified from time to time by the legislature (e.g., State Senate Bill 823 in 2002). Annually, the state legislature has continued to provide COPS Program funds. The COPS Program allows eligible cities to receive a proportionate share of COPS Program funds. The grant funds are administered and distributed through the Chief Executive Office of Los Angeles County. The Police Department received $100,000.00 through the COPS Program for fiscal year 2011-2012 (FY11/12). The funds must be deposited into the City's Supplemental Law Enforcement Services Fund (SLESF) established pursuant to Section 30061 of the Government Code. The SLESF is a separate interest bearing fund to record the receipt and expenditures of the monies received. These funds must be used to supplement, and not supplant, existing "frontline municipal police services" being provided by the City. State law authorizes the City Council to use the funds provided by the COPS Program — both existing and anticipated moneys — in accordance with the written requests of the Chief of Police (per Government Code § 30061(c)(2)). The City Council must hold a public hearing before acting upon such a written request. The request must be considered separate and apart from the process applicable to proposed allocations of the City's general fund. The Police Department has received all of the anticipated $100,000 of the allocated COPS Program funds for FY1 1/12. To date, none of the funds have been spent. COPS Program funds received for FY1 1/12 must be encumbered no later than June 30, 2012. A local agency that does not meet this requirement must remit unspent SLESF monies to the state. The Chief of Police makes the following request for use of the FY1 1/12 COPS Program - SLESF funds and any interest in the SLESF account accumulated through June 30, 2013: To pay for a Vernon Service Officers (VSO) in FY 2012-2013, and/or To pay for a Civilian Court Officer in FY 2012-2013, and To pay for any other unbudgeted expenses for frontline municipal police services. The VSO and Civilian Court Officer positions are positions that the City would not have as part of its frontline municipal police services without the grant funding. Thus, the services provided by these VSOs supplement, and do not supplant, existing frontline municipal police services. The Police Department has participated in the COPS Program grant process for several years. However, these funds must be used to supplement, and not supplant, existing "frontline municipal police services." Recommendation: I recommend City Council hold a public hearing to consider expenditure of COPS Program funds for fiscal year 2011-2012, and then approve a resolution authorizing the expenditure of the funds as requested in this report during the June 5, 2012, Council meeting. NOTICE OF PUBLIC HEARING The City of Vernon.will conduct a Public Hearing which you may attend. PLACE: Vernon City Hall City Council Chambers 4305 Santa Fe Avenue Vernon, CA 90058 DATE TIME: June 5, 2012, at 9:00 a.m., or as soon thereafter as the matter can be heard. PURPOSE: To consider the expenditure of Citizen Options for Public Safety (COPS) Funds for fiscal year 2011-2012. The use of these funds is for front- line municipal police services and supplement, not supplant, current front-line law enforcement services. These funds must be used or encumbered by June 30, 2012. Any interested person may attend and address the City Council at the time of the hearing, or may submit written.comments prior to the hearing. If you challenge the expenditure of COPS Funds as allocated, or any provision thereof in court, you may be limited to raising only those issues you or someone else raised at the hearing described in this notice or in written correspondence delivered to the City of Vernon at, or prior to, the meeting.
