Resolution No. 2012-104RESOLUTION NO. 2012-104 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VERNON APPROVING A LOT -LINE ADJUSTMENT FOR THE PROPERTIES LOCATED AT 2929 E. 54`I STREET AND 5215 & 5375 S. BOYLE AVENUE IN THE CITY OF VERNON WHEREAS, AMB Vernon Industrial Park, LLC, a Delaware Limited Liability Company, ("AMB") is the owner of two adjoining parcels of land (Assessor Parcel No. 6310-009-018 and 6310-009-019) located at 2929 E. 54th Street and 5215 & 53.75 S.'Boyle Avenue,�both located in the City's I -Zone, Industrial; and WHEREAS, AMB proposes to adjust the lot lines of the two parcels; and WHEREAS, the existing parcels that are proposed to be adjusted are described and shown on the attached Exhibit'A consisting of three (3) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, AMB desires to adjust the common boundary, between the parcels located at 2929 E. 54th Street and 5215 & 5375 S. Boyle Avenue, whereby said adjustment will increase existing parcel 2 and decrease the size of existing parcel 1 as shown on the attached Exhibit B consisting of five (5) pages which is incorporated herein by this reference as though fully set forth at length; and WHEREAS, a lot line adjustment pursuant to Government Code Section 66412(d), which provides that the Subdivision Map Act does not apply to the following; (d) A lot line adjustment between four or.fewer existing adjoining parcels, where the land taken.from one parcel is added to an adjoining parcel, and where a.greater number of parcels than originally existed is not thereby created, if the lot line adjustment is approved by the local agency, or advisory agency.... and WHEREAS, Government Code Section 66412(d) permits a local agency.to impose conditions or exactions on its approval of a lot line adjustment so long as they relate to a property's conformity with the local general plan, any applicable coastal plan,_ and zoning and building ordinances, or require the prepayment of real property taxes prior to the approval of the lot line adjustment, or facilitate the relocation of existing utilities, infrastructure, or easements; and WHEREAS, Section 28.2 of Chapter 28 of the City's Code requires all lot line adjustments to conform -to the City's General Plan and the City's Comprehensive Zoning Ordinance; and WHEREAS, the Director of Community Services & Water has recommended that said lot line adjustment be approved. NOW,.THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF VERNON AS FOLLOWS: SECTION 1: The City Council of the City of Vernon hereby finds and determines that the recitals contained herein -above are true and correct. SECTION 2: The City Council of the City of Vernon hereby finds that the proposed project is categorically exempt based on a Class 5 Categorical Exemption (Section 15305 of the -California Environmental Quality Act Guidelines) because the lot line adjustment is a minor alteration in a land use limitation in an area with an average slope of less than 20% that does not result in any changes in land use or density. The City Council hereby directs the City Clerk, or the City Clerk's designee, to file a Notice of Exemption for this -2- project with the County Clerk of the County of Los Angeles. SECTION 3: The City Council of the City of Vernon, in compliance with Section 28.2 of Chapter 28 of the City Code, and Government Code Section 66412(d), hereby makes the following finding: a. The parcels that will result from the lot line adjustment are consistent with the policies and goals of the City's. General Plan because the land use designations will not be changed by the lot line adjustment. Additionally this lot line adjustment will continue to encourage industrial and municipal uses at both parcels which is consistent with the policies in the General Plan. SECTION 4: The lot line adjustment adjusting the property lines of parcels 1 and 2 described in the attached Exhibit A, whereby said adjustment will change the property lines to the described parcels A and B in the attached Exhibit B is hereby approved in accordance with the recommendation of the Director of Community Services & Water. SECTION 5: The City Clerk of the City of Vernon shall certify to the passage, approval and adoption of this resolution, and the City Clerk of the City of Vernon shall cause this resolution and the City Clerk's certification to be entered in the File of Resolutions of the Council of this City.
