Whitworth, City Administrator (!tl RE: Repeal Amended and Restated Drug and Alcohol Policy Backaround At the July 17, 2012 City Council meeting, staff recommended and the City Council approved an amended and restated drug and alcohol testing policy to provide that random testing be administered to all City employees who operate City owned vehicles. Prior to proposing the amended and restated policy, the City inadvertently failed to meet and confer with the police and fire unions on the matter as required per their respective MOUs. As such, the City issued letters to the union presidents, with copies to their attorneys, stating the following: "We have heard your concerns regarding the recently adopted Amended and Restated Drug and Alcohol Testing Policy (Resolution No. 2012-136), and in response we have decided to recommend that the City Council rescind the policy at its August 21, 2012 meeting in favor of addressing it again later this year with the assistance and input of the newly appointed Human Resources Director and City Attorney. We look forward to working with you on a new policy at that time." Recommendation It is recommended that the City Council repeal Resolution No. 2012-136, which adopted the amended and restated drug and alcohol testing policy. Staff will work with all appropriate parties, including the police and fire unions through the meet and confer process, to develop a new policy to be proposed later in the year.
